Facts  t   Thedefendantandtwocodefendants,RaymondLokeyandMichaelWright,brokeintothe L  homeofKevinSadleraroundnoononDecember29,2000.Lokeyknockedonthedoorfirstto 8  ensurethatnoonewasathome.Then,Wrightandthedefendantenteredthehouseandbegantaking $ t thingsoutsidetoLokey,wholoadedthetruckandalsoservedasalookout.Whilethedefendant  ` andWrightwereinsidethehouse,DavidSadler,KevinSadlersfather,drovepastthehomeand  L  noticedthedefendantstruckparkedinthedriveway.Mr.Sadlerstoppedtoinvestigateandwasmet  8  outsidebyLokey,whohadahandgun.LokeypointedthegunatMr.Sadlerandorderedhiminside $  theresidence.Onceinside,Mr.SadlerobservedWrightinthekitchentakingthingsfromthe   cabinets.Mr.SadlerinformedLokeythat thelawwasontheway,andLokeyorderedMr.Sadler   tositonthecouch.Thedefendantexitedoneofthebedroomsandcoveredhisfacewithhishands.   AllthreemenquicklyleftwithoutsayinganythingelsetoMr.Sadler.Oneofthedefendantstore   outthephonelinesinsidethehouse,andWrightdroveawayinMr.Sadlerstruck.Afewblocks p away,WrightabandonedMr.SadlerstruckandgotintothetruckwithLokeyandthedefendant. \ Soonafterthedefendantsleft,Mr.Sadlerreportedtheburglarytothepolice.Ashorttimelater,all H threedefendantswereapprehendedbytheTennesseeHighwaypatrolwhileridinginthedefendants 4 truck.Mr.SadlerwastransportedtotheirlocationandpositivelyidentifiedLokeyandWrightbut  p wasunabletoidentifythedefendant.  \   Lokeytestifiedatthesentencinghearingthathewasthedefendantsroommateatthetime 4 oftheburglary.Themorningoftheburglary,thethreedefendantsdrovearoundlookingforahouse   toburglarize.Wright,whowasdriving,toldLokeytoknockonthedoortoseeifanyonewasinside   theSadlerresidence.LokeyknockedacoupleoftimesandWrighttoldhimtoknockagain,harder.  Thereafter,thethreeofthemwentaroundtothebackofthehouse.Wrighttookthegunanda  screwdriverandkickedthedooropen.Heandthedefendantthenwentinsidetocheckfor  occupants.AfterinformingLokeythatthehousewasclear,Wrightandthedefendantbegantaking l thingsfrominsidethehome.Lokeytestifiedthathewasthe loadman,whichessentiallymeans X  thatheremainedoutsidetoloadthetruckandactasalookout.AlthoughpositivethatWrighthad D! thegunwhenWrightkickedthedooropen,Lokeytestifiedthatthedefendantwasthepersonwho 0"  handedtheguntohim.Thedefendanttoldhimthatintheeventsomeoneapproachedthehouse, #l! Lokeywastoescorttheminside. $X"   LokeyalsoclaimedthatthedefendanttoldLokeytokillMr.Sadler,butherefused.He %0!$ furthertestifiedthatheonlytookthegunbecausehewasafraidofthedefendantandthattheinstant &"% offensewashisfirsttimetocommitaburglary.However,uponfurtherquestioningbythetrialjudge, '#& headmittedthathehadpreviouslyactedas loadmaninotherburglarieswhichwerecommitted (#' bythethreedefendantsinTrousdale.Healsoadmittedthathewasthepersonwhopossessedthe )$( gunduringthoseburglaries.Oncrossexamination,Lokeyadmittedthathehadtwochargespending |*%) forattemptedmurderinDavidsonCounty,whichalsoinvolvedagun.Thecrimeswerenot h+&* committedwiththedefendantorWright,butLokeyagainclaimedthatthegunheusedwasgiven  tohimbyanotherpersoninvolvedinthecrimes.    Mr.WrightstestimonyaboutthecircumstancesoftheburglarywassimilartoLokeys. t However,Wrightclaimedthatheneverpossessedthegun.Healsotestifiedthathe,notthe ` defendant,wasinthebedroomwhenLokeybroughtMr.Sadlerinsideatgunpoint.Hecoveredhis L  faceandthenexitedthehouse.WrightdidnothearthedefendanttellLokeytokillMr.Sadler.He 8  furthertestifiedthathedidnotbelievethedefendantwouldmakesuchastatement,explainingthat $ t itwasinconsistentwiththedefendantspersonality.AfterWrightexitedtheSadlerresidence,he  ` noticedthatMr.Sadlerstruckwasrunningand,withoutthinking,gotinsideanddroveaway.The  L  defendantandLokeyfollowedWrightoutofthehousebutgotintothedefendantstruck.Afew  8  minuteslater,WrightparkedMr.Sadlerstruckonthesideoftheroadandgotintothetruckwith $  hiscodefendants.AccordingtoWright,themotivationfortheburglarywastogetmoneytopay   therentdueonthedefendantsapartment.Wrighthadbeenlivingatthedefendantsapartment,   sleepingonacot,foraboutthreeweeks,andLokeyhadbeenlivingtherefortwomonths.     Thedefendantsfather,mother,uncleandgrandmotheralltestifiedthatthedefendanthad p beena straightAstudentwithfewproblemsuntilhismaternalgrandmotherdiedtwoyearsearlier. \ Hewasapparentlyveryclosetohisgrandmother,andsheliterallydiedinhisarms.Afterherdeath, H thedefendantmovedoutandwasinvolvedinanumberofburglaries.Atthetimeoftheinstant 4 offense,hewasonbailawaitingsentencingforastringofburglariesinWilliamsonCounty,allof  p whichwerecommittedononeday.Hewasalsoonprobationforamisdemeanortheftconviction,  \ whichwasallegedlycommittedbythedefendantscousin.Accordingtothedefendant,hiscousin H brokeintoacarwhilethedefendantwasinsidehisgirlfriendsapartment.Whenthedefendant 4 returnedtohistruck,hiscousinwaswaitingforhimandhadplacedthestolenmerchandiseinthe   truck.Laterthatday,hedefendantwaspulledoverbylawenforcementand,alongwithhiscousin,   chargedwithfelonyautoburglary.Thechargewaslaterreducedtotheftofpropertywithavalue  under$500.    Apolicedetectivewhointerviewedthedefendantafterhisarrestfortheinstantoffense l testifiedthatthedefendantvolunteeredinformationaboutotherunsolvedburglarieswhichhadbeen X  committedbythedefendant,Lokey,andWright.Thedefendantalsoassistedthedetectivein D! locatingstolenpropertywhichhadbeentakenduringthoseburglaries. 0"     @ Analysis  $X" .  Ashisfirstissue,thedefendantchallengesthelengthofhissentences,arguingthatthetrial %0!$ courtfailedtoconsiderorapplyappropriatestatutorymitigatingfactorsandmisappliedenhancement &"% factors.ThisCourtsreviewofthesentenceimposedbythetrialcourtisdenovowithapresumption '#& ofcorrectness.Tenn.CodeAnn.40-35-401(d).However,thispresumptionisconditionedupon (#' anaffirmativeshowingintherecordthatthetrialjudgeconsideredthesentencingprinciplesandall )$(  relevantfactsandcircumstances.Statev.Pettus,986S.W.2d540,543(Tenn.1999).Ifthetrial |*%) courtfailstocomplywiththestatutorydirectives,thereisnopresumptionofcorrectness,andour  reviewisdenovo.Statev.Poole,945S.W.2d93,96(Tenn.1997). Thetrialcourtmisappliedoneormoreenhancementfactorsforeachsentenceandfailedto   applyanadditionalmitigatingfactor.Accordingly,ourreviewmustbedenovowithoutany   presumptionofcorrectness.SeePoole,945S.W.2dat96. p    ENHANCEMENTFACTORS  H 81.AggravatedBurglary  p   Thetrialcourtenhancedthedefendantssentenceforaggravatedburglaryfromtheminimum H ofthreeyearstothemaximumofsixyears.Thetrialcourtfoundsevenenhancementfactors 4 applicabletotheaggravatedburglaryconviction:(1)thedefendantsprevioushistoryofcriminal   convictionsorcriminalbehavior;(2)thedefendantwasaleaderinthecommissionoftheoffense;   (3)theoffenseinvolvedmorethanonevictim;(8)thedefendantshistoryofunwillingnesstocomply  withtheconditionsofanalternativesentence;(9)thedefendantpossessedoremployedafirearm;  (10)thedefendanthadnohesitationaboutcommittinganoffensewithahighrisktohumanlife;  (13)(a)theoffensewascommittedwhilethedefendantwasonbailforapreviousfelonyconviction l andwasultimatelyconvicted;and(13)(c)theoffensewascommittedwhilethedefendantwason X  probationforapreviousfelonyconviction.Tenn.CodeAnn.40-35-114(1),(2),(3),(8),(9),(10), D! (13)(a),(13)(c). 0"    Thedefendantdoesnotchallengethetrialcourtsapplicationofenhancementfactors(1),(8), $X" or(13)(a).However,thedefendantmaintainsthetrialcourterredinapplyingenhancementfactor $D # (2)thedefendantwasaleaderinthecommissionoftheoffense,(3)theoffenseinvolvedmorethan %0!$ onevictim,(9)thedefendantpossessedoremployedafirearm,(10)therewasnohesitationin &"% committinganoffensewithhighrisktohumanlife,and(13)(c)thedefendantwasonprobationfor '#& afelonywhentheoffensewascommitted.Wedisagreewithdefendantsargumentconcerningfactor (#' (2).Withrespecttofactor(2),thedefendantarguesthattheevidencecontradictsafindingthathe )$( was theleader.However,enhancementfactor(2)canapplyevenifthedefendantisnotthesole |*%) leader,butrather aleader.Statev.Hicks,868S.W.2d729(Tenn.Crim.App.1993).Testimony h+&* byseveralwitnessesrevealedthatthedefendantinstigatedtheinstantoffensebyinformingtheco  defendantsthattheyneededto jackahouseinordertogetmoneytopaytherentdueonthe  defendantsapartment.Inaddition,thedefendanthandedaguntoLokeyandinstructedhimthat  shouldanyoneapproachthehouse,hewastoescorttheminside.Thereafter,thedefendantand t WrightwentinsidetheSadlerresidenceandtookitemsoutsideforLokeytoloadintohistruck. ` Thus,theevidencesupportsthetrialcourtsfindingthatthedefendantwas aleaderinthe L  commissionofthisoffense. 8     `     h   Weagreewiththedefendantscontentionthatthetrialcourtmisappliedenhancementfactor  ` (9),butwedonotreachourconclusionbasedonthedefendantsreasoning.Enhancementfactor(9)  L  applieswhenproofexiststhat thedefendantpossessedoremployedafirearm,explosivedeviceor  8  otherdeadlyweaponduringthecommissionoftheoffense.Tenn.CodeAnn.40-35-114(9).The $  defendantarguesthatitwasLokeywhopossessedtheweaponduringthecommissionofthe   burglary.Theindictmentallegedthedefendantunlawfullyenteredthehabitation withtheintent   tocommit...theft.Thecrimeofburglaryiscompleteandhasbeencommittedwhenanentryhas   beenmadewithoutconsentandwiththeintenttocommitafelonyonceinside.Statev.Lindsay,637   S.W.2d886,889(Tenn.Crim.App.1982);seeTenn.CodeAnn.39-14-402(a),-403(a).This p casepresentscircumstancessimilarthoseinStatev.Teague,wherethisCourtrejectedthetrial \ courtsapplicationofthisenhancementfactor.Statev.Teague,No.02C01-9704-CC-00132,1997 H Tenn.Crim.App.LEXIS814,at*(Tenn.Crim.App.August27,1997,atJackson)(holdingthat 4 applicationofenhancementfactor(9)isnotproperlyappliedtoenhanceaggravatedburglary  p convictionwhererecordisdevoidofevidencethatdefendantpossessedaweaponwhile effecting  \ entryinto[thevictims]home)).Thereisnoevidencethatthisdefendant possessedoremployed H aweaponwhileeffectingtheentryinto[thevictims]home.󀀀Tothecontrary,thetestimony 4 establishedthatWrightwasthepersonwhopossessedtheweaponwhileeffectingentryintothe   house.Atsomepointafterthedefendantsgainedentrytothehouse,thedefendantagainacquired   possessionofthegunandhandedittoLokey.    Weagreewiththedefendantthatenhancementfactor(3),theoffenseinvolvedmorethanone  victim,wasnotapplicabletothisconviction.ThisCourthasheldthattheterm victim,asusedin l TennesseeCodeAnnotatedsection40-35-114(3), islimitedinscopetoapersonorentitythatis X  injured,killed,hadpropertystolen,orhadpropertydestroyedbytheperpetratorofthecrime.State D! v.Raines,882S.W.2d376,384(Tenn.Crim.App.1994).Aggravatedburglaryisdefinedasthe 0"  burglaryofahabitation,andonecommitsburglarybyenteringabuildingwithouttheconsentofthe #l! ownerwiththeintenttocommitafelonyortheft.Tenn.CodeAnn.39-14-402(a),-403(a).Under $X" theproofinthiscase,theburglarywascommittedforthepurposeofcommittingtheft.Thereisonly $D # onepropertyownerallegedintheindictment,andthetestimonyofthehomeowner,KevinSadler, %0!$ doesnotindicatethattheseparatepropertyofanothervictimwasstolen.Finally,thedefendanthas &"% beenseparatelyconvictedfortheaggravatedassaultofMr.Sadler,theonlypersonpresentduring '#& theburglary.ThisCourthaspreviouslyrecognizedthatenhancementfactor(3)doesnotapplywhen (#' thereareseparateconvictionsforeachvictim.Therefore,thetrialcourterredinapplyingfactor(3) )$( toenhancethedefendantsaggravatedburglaryconviction. |*%)  h+&*   Therecorddoesnotsupporttheapplicationofenhancementfactor(10),thattherewasno  hesitationincommittinganoffensewithahighrisktohumanlife.Inourviewoftheevidence,the  defendantsdidhesitatetocommitacrimethatposedahighrisktohumanlife.Theychoseto  burglarizetheSadlerresidenceduringtheday,atimewhentheoccupantswereunlikelytobeat t home.Inaddition,theyknockedonthedoortoensurethatnoonewasathome.Theyevenknocked ` asecondtime,louder,toensurethatnoonewassleepingintheresidenceandunabletohearthefirst L  knock.Inshort,thedefendantstookstepstoavoidcontactwithanyoccupantsofthehome. 8      Finally,factor(13)(c),thedefendantwasonprobationforafelonywhentheoffensewas  ` committed,isalsoinapplicabletotheinstantdefendant.Therecordrevealsthatthedefendantwas  L  onunsupervisedprobationforamisdemeanortheftconviction.Becausefactor(13)requiresthatthe  8  underlyingconvictionbeafelony,thetrialcourtmisappliedthisfactor. $  2.AggravatedAssault     Thetrialcourtenhancedthedefendantssentenceforaggravatedassaultfromtheminimum   ofthreeyearstofiveyearsbyapplyingsixenhancementfactors:(1)thedefendantsprevioushistory p ofcriminalconvictionsorcriminalbehaviorinadditiontothosenecessarytoestablishhisrange,(8) \ thedefendantshistoryofunwillingnesstocomplywiththeconditionsofasentenceinvolving H releaseintothecommunity,(9)thedefendantpossessedoremployedafirearm,(10)thedefendant 4 hadnohesitationaboutcommittinganoffensewithahighrisktohumanlife,(13)(a)theoffensewas  p committedwhilethedefendantwasonbailforafelonyandwasultimatelyconvicted,and(13)(c)  \ theoffensewascommittedwhilethedefendantwasonprobationforapreviousfelonyconviction. Furthermore,theuseofadeadlyweaponnecessarilycreateshighrisktohumanlife.Althoughthis 0"  Courthasfoundthatfactor(10)maystillbeappliedifpersonsotherthanthevictimareplacedin #l! dangerbytheactionsofthedefendant,thatdidnotoccurintheinstantcase.Statev.Sims,909 $X" S.W.2d46,50(Tenn.Crim.App.1995).Therefore,factor(10)wasalsomisapplied. $D # 3.Theft &"%   Thetrialcourtenhancedthedefendantssentencefortheftofpropertyfromtheminimumof (#' threeyearstofouryears.Thetrialcourtproperlyappliedenhancementfactors(1),(8),and(13)(a) )$( tothetheftconviction.However,forthereasonstatedabovefactor(13)(c)wasmisapplied. |*%)    h+&*   Insummary,thetrialcourtproperlyappliedenhancementfactors(1),(2),(8),and(13)(a)to  enhancethedefendantsaggravatedburglaryconviction,and(1),(8),and(13)(a)toenhancethe  defendantsaggravatedassaultconvictionandtheftconvictions.     MITIGATINGFACTORS `  f  Thetrialcourtappliedonemitigatingfactor,(9)thedefendantassistedtheauthoritiesin 8  uncoveringoffensescommittedbyotherpersonsorindetectingorapprehendingotherpersonswho $ t hadcommittedtheoffenses.Thedefendantassertsthatthetrialcourtshouldhaveappliedthe  ` followingadditionalmitigatingfactors:(1)thedefendantsconductneithercausednorthreatened  L  seriousbodilyinjuryduringtheaggravatedburglaryorthetheftofMr.Sadlerstruck,(4)the  8  defendantplayedaminorroleinthecommissionofaggravatedassaultandtheftofMr.Sadlers $  truck,(6)thedefendant,becauseofyouthoroldage,lackedsubstantialjudgmentincommittingthe   offenses;(7)thedefendantwasmotivatedbyadesiretoprovidenecessities;(10)thedefendant   assistedtheauthoritiesinlocatingorrecoveringanypropertyorpersoninvolvedinthecrime,and   (11)thedefendantcommittedthetheftofMr.Sadlerstruckundersuchunusualcircumstancesthat   itisunlikelythatasustainedintenttoviolatethelawmotivatedtheconduct.SeeTenn.CodeAnn. p 4035113(1),(4),(6),(7),(10),(11). \   Weagreewiththedefendantscontentionregardingmitigatingfactor(1)butconcludethat 4 theremainingfactorswereproperlyrejectedbythetrialcourt.Asweheldpreviously,thecrimeof  p aggravatedburglaryiscompletedonceentryintoaresidencehasbeenmadewithoutconsentand  \ withtheintenttocommitafelonyinside.Statev.Lindsay,637S.W.2d886,889(Tenn.Crim.App. H 1982).BecausethevictimoftheaggravatedassaultdidnotarriveattheSadlerresidenceuntilafter 4 thecrimeofaggravatedburglarywascomplete,thedefendantsconductdidnotcauseorthreaten   seriousbodilyinjuryduringthecommissionoftheburglary.Likewise,thevictimwasaloneinside   theresidencewhenWrightdecidedtostealhistruckfromthedrivewayandwasneverthreatened  orharmedduringthecommissionofthetheft.Therefore,thedefendantsconductneitherthreatened  norcausedseriousbodilyharmduringthecommissionofthetheft.Althoughthetrialcourtshould  haveappliedmitigatingfactor(1)totheaggravatedburglaryandtheftconvictions,weconcludethat l itisentitledtoverylittleweightgiventhedefendantsroleinbringingtheweaponwithhim. X    Asforthedefendantsargumentthatheplayedaminorroleinthecommissionofthe 0"  aggravatedassaultandtheftofMr.Sadlerstruck,weagreewiththetrialcourtthatfactor(4) isnot #l! applicableatall,especiallyto[thedefendant].Thedefendantsuppliedanessentialelementofthe $X" aggravatedassaultconvictionbybringingthegunwithhimandgivingittoLokey.Furthermore,we $D # declinetoviewthedefendantsroleininstigatingtheentirecriminalepisodeasminor,especially %0!$ forthecrimeoftheftwhichwashisadmittedpurposeforbeingattheSadlerresidence. &"%   Withregardtomitigatingfactor(6),thedefendantfailedtodemonstratethathelacked (#' substantialjudgmentorthathewasunabletoappreciatethenatureofhiscriminalconductdueto )$( youth.Thetrialcourtfoundthatthedefendant,ageeighteen, knewexactlywhat[he]wasdoing. |*%) [He]hasdoneitbefore.Weagreethatthedefendantwasnotsufficientlyyouthfultoapplythis h+&* factor.Factor(7),whichmayallowmitigationforcrimesmotivatedbyadesiretoprovide  necessities,isalsoinapplicableinthedefendantscircumstances.Althoughallthreedefendants  testifiedthatthemotivationforthecrimeswastoobtainmoneytopaythedefendantsrent,itis  nonsensicaltocondoneaggravatedburglaryasasolutiontopossiblelaterentpayments.Weagree t withthetrialcourtsfindingthat thereisanalternativeanditscalledwork.Apparently,the ` defendanthadbeenoutofworkforafewweeks.However,thereisnothingintherecordtoindicate L  thatthedefendanthadbeentryingtosecureemploymentduringthattime.Instead,therecordreveals 8  thatthedefendanthadbeendiligentlypursuinghischosenoccupation,burglary. $ t   Factor(10),thedefendantassistedtheauthoritiesinlocatingorrecoveringanypropertyor  L  personinvolvedinthecrime,isinapplicabletotheinstantconvictions.TennesseeCodeAnnotated  8  section4035113(10)providesthatadefendantmayreceivecreditinmitigationfor assist[ing]the $  authoritiesinlocatingorrecoveringanypropertyorpersoninvolvedinthecrime.Therefore,the   defendantmusthaveassistedtheauthoritiesinrecoveringpropertytakenduringthecommissionof   theinstantoffensesinorderforthisfactortobeproperlyapplied.Althoughthedefendantassisted   authoritiesinrecoveringpropertytakenduringapreviousburglary,thepropertytakenduringthe   commissionoftheinstantburglarywasinthetruckwiththedefendantswhentheywere p apprehended.Thus,thedefendantprovidednoassistanceinrecoveringthatpropertyotherthanhis \ unintendedineptness. H    CONSECUTIVESENTENCES   p >    Thedefendantarguesthatthetrialcourterredbyorderingconsecutivesentences.Thetrial H courtranthedefendantssentenceforaggravatedburglaryconsecutivelytothesentencefor 4 aggravatedassaultandthesentencefortheftofpropertyconcurrentlywiththeothertwosentences.   TennesseeCodeAnnotatedsection40-35-115establishesvariousbasesforimposingconsecutive   sentences.Ofthese,thetrialcourtrelieduponthedefendantsextensiverecordofcriminalactivity,  hisstatusasadangerousoffender,andthecircumstancethatthepresentoffenseswerecommitted  whilehewasonprobation.Tenn.CodeAnn.40-35-115(b)(2),(4),(6).     `     h   Weobserveinitiallythatitisquestionablewhethertherecordcontainsabasisforapplying X  factor(2),the defendantisanoffenderwhoserecordofcriminalactivityisextensiveor(4),that D! thedefendantwasa dangerousoffenderwhosebehaviorindicateslittleornoregardforhumanlife 0"  andnohesitationaboutcommittingacrimeinwhichtherisktohumanlifeishigh.SeeTenn.Code #l! Ann.40-35-115(b)(2),(4).Nevertheless,weneednotspendtimeandlineageanalyzingthe $X" proprietyofthesefactors.Thetrialcourtneedonlyfindoneofthestatutorycriteriatoexisttojustify $D # consecutivesentencing.Inthepresentcase,therecordcompetentlysupportstheapplicationoffactor %0!$ (6),thathecommittedthepresentoffenseswhileonprobation.SeeTenn.CodeAnn. &"% 40-35-115(b)(6).Thus,thetrialcourtwasallowedtoorderthetwosentencestobeserved '#& consecutively.Thedefendanthasfailedtodemonstratehowtheevidencepreponderatesagainstthe (#' trialcourtsorderingconsecutivesentences. )$(    @ CONCLUSION h+&* Ї     Baseduponourdenovoreviewoftherecord,wefindthatthelengthofthedefendants  sentencesforaggravatedassaultandtheftwasproperduetothegreatweightofenhancementfactors  (1),(8),and(13)(a).Furthermore,thedefendantssentenceforaggravatedburglarywasalsoproper  basedonenhancementfactors(1),(2),(8),and(13)(a).Finally,thetrialcourtsimpositionof t consecutivesentenceswasproperbaseduponthedefendantsprobationstatuswhentheinstant ` offenseswerecommitted.
