OnJuly2,1997,theappellantfiledapetitionforpostconvictionreliefclaimingthattheindictmentsagainsthimwerefatallydefectiveinthattheyfailedtoallegethepropermensrea.TheappellantpreviouslypledguiltytothreecountsofrapeofachildonMarch23,1993.ThejudgmentorderswereenteredonMarch31,1993.  Thetrialcourtdismissedtheappellantspetitionforpostconvictionreliefbecauseitwasfiledoutsidethestatuteoflimitation,itcouldnotbeconsideredasahabeascorpuspetitioninthatithadbeenfiledinthewrongcourt,andonthemerits,theappellantwasnotentitledtorelief.  Atthetimetheappellantpledguilty,thePostConvictionProcedureActprovidedthatapetitionerundersentenceofacourtofTennesseehadthreeyearsfromthedateofthefinalactionofthehigheststateappellatecourttowhichanappealistakentofileapetitionforpostconvictionrelief.SeeT.C.A.4030102(repealed1995).EffectiveMay10,1995,thestatuteoflimitationwasreducedtooneyear.SeeT.C.A.4030202(a).Considerationofapetitionfiledaftersuchtimewasbarredunlessthepetitionercouldshowthatoneofthethreeenumeratedexceptionsapplied.SeeT.C.A.4030202(b)(1995).Subsequently,onMay13,1996,thePostConvictionProcedureActwasamendedtoreflectthatnocourtshallhavejurisdictiontoconsiderapetitionfiledaftertheoneyearstatuteoflimitationunlessoneofthethreeenumeratedexceptionsapplied.SeeT.C.A.4030202(b).Inthepresentcase,theappellantspetitionforpostconvictionistimebarredundereitherstatuteoflimitation.  Moreover,thetrialcourtproperlydeterminedthatitcouldnotconsidertherequestforreliefasapetitionforhabeascorpus.ThepetitioninthiscasewasfiledinWilliamsonCounty,Tennessee,thecountyinwhichtheappellantwasoriginallyconvicted.HispetitionshowsthatheispresentlyincarceratedinJohnsonCounty,Tennessee.Apetitionforhabeascorpusmustbefiledinthecountywhichisthemostconvenientinpointofdistancetotheapplicantunlessasufficientreasonbegiveninthepetitionfornotapplyingtosuchcourt.T.C.A.2921105(1980).ThepetitionwasnotfiledinJohnsonCountynorwasthereanyallegationastowhyitwasnotfiledinsaidcounty.  TheCourtfindsthatthetrialcourtcorrectlyheldthattheappellantspostconvictionpetitionwastimebarred.Moreover,thetrialcourtwascorrectindeterminingthatitcouldnotconsidertherequestforreliefasapetitionforhabeascorpusrelief.  ITIS,THEREFORE,ORDEREDthatthestatesmotiontoaffirmthejudgmentofthetrialcourtunderRule20,TennesseeCourtofCriminalAppealsRules,isgranted,andthejudgmentofthetrialcourtisaffirmed.Theappellantbeingindigent,costsaretaxedtothestate.
