ThePetitioner,DarrellDouglasSheets,appealsthetrialcourtsorderdenyinghimhabeascorpusrelief.Hewasindictedforandconvictedofaggravatedrape.Hearguesthathisconvictionisvoidbecausetheindictmentcharginghimwiththeoffenseofaggravatedrapeisfatallydefectivebecauseitfailedtoallegetherequisitemensrea.Weaffirmthejudgmentofthetrialcourtdismissingthepetition. Inhishabeascorpuspetition,thePetitionerallegesthattheindictmentfailedtospecifythemensreafortheoffenseofaggravatedrapeandthus,hisconvictionwasvoid.ThePetitionerwasindictedforaggravatedrapeonMay4,1992.HepleadedguiltytothatoffenseonSeptember23,1992,andwassentencedtofifteenyearsincarceration.HefiledapetitionforwritofhabeascorpusonAugust19,1996.ThetrialcourtdismissedthepetitiononSeptember9,1996,withoutahearing.ThePetitionerfiledamotiontosetasidetheorderofdismissalandamotionforentryoffindingsoffactandconclusionsoflawonOctober1,1996.ThetrialcourtdeniedthemotiononDecember10,1996.ThePetitionernowappeals. ThePetitionerarguesthathisconvictionforaggravatedrapeisvoidbecausetheindictmentdidnotallegetherequisitemensreafortheoffense.Anindictmentorpresentmentmustprovidenoticeoftheoffensecharged,anadequatebasisfortheentryofaproperjudgment,andsuitableprotectionagainstdoublejeopardy.Statev.Trusty,919S.W.2d305,310(Tenn.1996);Statev.Byrd,820S.W.2d739,741(Tenn.1991);Statev.Lindsay,637S.W.2d886,890(Tenn.Crim.App.1982).Theindictment muststatethefactsinordinaryandconciselanguageinamannerthatwouldenableapersonofcommonunderstandingtoknowwhatisintended,andwithadegreeofcertaintywhichwouldenablethecourtuponconviction,topronouncetheproperjudgment.Wardenv.State,381S.W.2d244,245(Tenn.1964);Tenn.CodeAnn.4013202. Alawfulaccusationisanessentialjurisdictionalelement,thus,aprosecutioncannotproceedwithoutanindictmentthatsufficientlyinformstheaccusedoftheessentialelementsoftheoffense.Statev.Perkinson,867S.W.2d1,5(Tenn.Crim.App.1992);Statev.Morgan,598S.W.2d796,797Tenn.Crim.App.1979).Ajudgmentbasedonanindictmentthatdoesnotallegealltheessentialelementsoftheoffenseisanullity.Wardenv.State,381S.W.2dat245;McCrackenv.State,489S.W.2d48,53(Tenn.Crim.App.1972).Furthermore,theTennesseeCodeprovidesthat"[i]fthedefinitionofanoffensewithinthistitledoesnotplainlydispensewithamentalelement,intent,knowledge,orrecklessnesssufficestoestablishtheculpablementalstate."Tenn.CodeAnn.3911301(c). ThePetitionercitesarecentdecisionofapanelofthisCourtthatheldanindictmentinvalidwhichchargedtheoffenseofaggravatedrapeinlanguagenearlyidenticaltothatinthecasesubjudice.SeeStatev.RogerDaleHill,C.C.A.No.01C019508CC00267,WayneCounty(Tenn.Crim.App.,Nashville,June20,1996),revd,___S.W.2d___(Tenn.1997).Hearguesthattheindictmentfailstoassertareckless,knowingorintentionalmentalstateasrequiredbyTennesseeCodeAnnotatedsection3911301(c).Theindictmentreadsasfollows: 4   TheGrandJurorsoftheaforesaidStateandCountydulyempaneledandsworn,upontheiroath,presentthat:DarrellDouglasSheetsbetweenNovember1991andFebruary,1992intheStateandCountyaforesaid,andbeforethefindingoftheindictment,didunlawfullyhavesexualpenetrationof[A.M.L.],avictimlessthan13yearsofage,contrarytothestatute,andallofwhichisagainstthepeaceanddignityoftheStateofTennessee.     OursupremecourtrecentlyprovidedguidanceonthisissueinitsopinionreversingHill: 4   foroffenseswhichneitherexpresslyrequirenorplainlydispensewiththerequirementforaculpablementalstate,anindictmentwhichfailstoallegesuchmentalstatewillbesufficienttosupportprosecutionandconvictionforthatoffensesolongas `   (1)thelanguageoftheindictmentissufficienttomeettheconstitutionalrequirementsofnoticetotheaccusedofthechargeagainstwhichtheaccusedmustdefend,adequatebasisforentryofaproperjudgment,andprotectionfromdoublejeopardy;(2)theformoftheindictmentmeetstherequirementsofTenn.CodeAnn.4013202;and(3)thementalstatecanbelogicallyinferredfromtheconductalleged.    Hill,___S.W.2d___(Tenn.1997). Here,theindictmentclearlysatisfiestheconstitutionalnoticerequirements.TherewasadequatenoticethattheDefendantwaschargedwiththestatutoryoffenseofaggravatedrapeascodifiedinTennesseeCodeAnnotatedsection3913502(a)(4)(1991),whichcontainedtheessentialelementsoftheoffense.Heretoo,issufficientinformationbywhichthetrialjudgecouldpronouncejudgmentfortheoffenseofaggravatedrape.Finally,theDefendantisadequatelyprotectedagainstasecondprosecutionforanoffenseofaggravatedrapeofthevictimoccurringduringtheperiodofNovember1991toFebruary1992. Regardingthesecondrequirement,itisalsoapparentthattheindictmentwasdraftedsuchthatapersonofordinaryintelligencecouldunderstandwithwhatoffensehewascharged.Thelanguageintheindictmentclearlytracksthelanguageofthestatute.Likewise,thethirdrequirement,thatthementalstatebelogicallyinferredfromtheindictment,hasbeensatisfied.OnecaninferfromthechargedactthatthePetitioner didunlawfullyhavesexualpenetration,thattherequiredmentalstateofreckless,knowing,orintentionalwaspresentinthenatureoftheallegedcriminalconduct.Hill,___S.W.2dat___.Therefore,weconcludethattheindictmentinthiscaseadequatelyinformedtheDefendantofthechargesagainsthimanddoesnotprovidesufficientgroundsforhisclaimforhabeascorpusrelief.
