Thetrialcourtorderstates,withoutfurtherexplanation,thatthepetitionis dismissedbecauseoflackofjurisdiction.Thisactionresultedfromthestatesresponsetothepetitionthatessentiallyclaimedthatthepetitionersallegationsonlyinvolved releaseeligibilitycomputationsnotsubjecttothetrialcourtsdeterminationsandthattheallegations,ifallowableatall,couldonlybebroughtthroughapostconvictionreliefpetition.Onappeal,althoughacknowledgingthatthepetitionerisclaimingthathiscommutationrevocationwasinvalidandthathissentenceshave,therefore,alreadyexpired,thestaterespondsthathis assertionsarewithoutbasisinfact.Also,thestatecontendsthatthepetitionerdoesnotunderstandthescopeofawritofhabeascorpus,thathisconvictionsarenotvoidandthathissentenceshavenotexpired.Itassertsthatthetrialcourtwascorrectindismissingthepetitionwithoutahearing. Unfortunately,misapprehensionisnottheexclusiveprovinceofthepetitionerinthiscase.Simplyput,thepetitionerassertsthathisoriginalsentence,commutedtotwentyyears,expiredbeforethecommutationrevocationwasundertaken.Suchacircumstancewould,infact,rendertherevocationandreinstatementoftheoriginalsentencevoid.SeeRowellv.Dutton,688S.W.2d474,477(Tenn.Crim.App.),app.denied,(Tenn.1985).Further,thepetitionerclaimsthatbothhiscommutedsentenceoftwentyyearsandhissubsequentsentenceoftwelveyearshaveexpiredwhensentencingcreditsareconsidered.Certainsentencereductioncreditshavebeenconsideredbythiscourtpreviouslyfordeterminingwhether,infact,aparticularsentencehasexpired.Id.;seeRicksv.State,882S.W.2d387(Tenn.Crim.App.),app.denied,(Tenn.1994).Moreover,thiscourthasrecognizedthatapetitionercanbeentitledtoanevidentiaryhearingandtheappointmentofcounseltoassistindeterminingwhetherthepetitionerssentenceshaveexpiredashispetitionsuccinctlyclaims.SeeCarrollv.Raney,868S.W.2d721(Tenn.Crim.App.1993). Underthesecircumstances,weareunabletodeterminethereasonforthetrialcourtsconclusionthatitlackedjurisdiction.Likewise,thestatespositioninthetrialcourtrelativeto releaseeligibilitydoesnotaddresswhatweseetobetheprimarycomplaintsbythepetitioner.Thesameistrueforthestatesbriefonappeal.Finally,webelievethattherecordisinsufficientforustodetermine,asthestatenowclaims,thatthepetitioners assertionsarewithoutbasisinfact.Insum,thecaseisremandedtothetrialcourtfordeterminationofwhetherthecommutationrevocationisvoidandtheactualsentencesexpired,giventhesentencecreditstowhichthepetitionerisentitled.Accordingly,thejudgmentisreversed.      ______________________________      JosephM.Tipton,JudgeCONCUR:___________________________JohnH.Peay,Judge___________________________DavidH.Welles,Judge
