InapostconvictionproceedingfiledafterMay10,1995,suchasthecaseatbar,thepetitionerhastheburdenofestablishinghisclaimsbyclearandconvincingevidence.Tenn.CodeAnn.4030210(f)(1997).Atrialcourt'sfindingsoffactfollowingapostconvictionhearinghavetheweightofajuryverdict.Brattonv.State,477S.W.2d754,756(Tenn.Crim.App.1971).Onappeal,thosefindingsareconclusiveunlesstheevidencepreponderatesagainstthejudgment.Butlerv.State,789S.W.2d898,900(Tenn.1990).  Thelowercourtdeterminedfromtheevidenceofrecordthatthepetitioner'sformercounselfulfilledhisdutiesofinvestigationtotheextentwhichshouldbeexpectedofareasonablyprudentattorneyandthatheyieldedtothepetitioner'swishestopleadguiltyandobtainedthebestpleaagreementϜpossible.Theevidenceonappealdoesnotpreponderatetothecontrary.
