H   ThepresentencereportreflectsthatatthetimeofsentencingtheDefendantwasthirtyfour  d yearsold,ahighschoolgraduate,andunmarried.Hehadaratherlengthyhistoryofcriminal  J convictions,mostofwhichresultedfromhisalcoholanddrugabuseproblems.Inspiteofhis  0 criminalhistory,hehadbeenfairlyregularlyemployedbyacarwashingbusiness.Hewasdescribed    asan excellentworkerwhenhewashere.Notalwaysdependable.Goodnaturedandfriendlywhen    sober.     TheDefendantreportedheavyalcoholusefromagetwelveuntilthetimeofhisarrest,along ^  withtheuseofXanax,Valiumandmarijuanafromageeighteenuntilthetimeofhisarrest.He D  reportedthathehadcompletedathirtydaydrugtreatmentprogramin1995andasevendaydrug *z  treatmentprogramin1999.TheDefendanttestifiedathissentencinghearing.Heacknowledged ` hislongstandingdrugandalcoholabuseproblems.Hestatedthatduringthetwentyfourhour F periodbeforehecommittedtheoffensesattheWalgreendrugstore,hehadtakenaboutthirtyXanax , pillsandhadalsobeendrinkingbeer.Heacknowledgedthathewentintothedrugstoretogetmore  Xanaxpills.Atthetimeofsentencing,hehadbeenincarceratedforseveralmonthsandhad  completedanotherdrugtreatmentprogram.Hisrecordofcriminalconvictionsincludedfelony  attempttoobtaindrugsbyfraud,misdemeanorattempttoobtainprescriptiondrugsbyfraud, t possessionofmarijuana,possessionofdrugparaphernalia,twoDUIconvictions,recklessdriving, Z publicintoxicationandtwofelonyrecklessendangermentconvictions.Atthesentencinghearing, @ herequestedprobation,stating, Imean,uh!!it!!itstimeformetogrowupandtake &v responsibilityformy[life]andquitusingdrugsandalcoholandbecomeaproductivememberof  \ society.ThatswhatIvecomeintocourtandaskachancetobecomenow. B   Onappeal,theDefendantdoesnotarguethatheshouldhavereceivedprobation.Hedoes  arguethatthetrialjudgeerredinsettinghissentenceatthemaximumoftenyears,andheasksthis  Courttoreducethelengthofhissentence.InsettingtheDefendantssentenceattenyears,thetrial   judgeconsideredthefactsandcircumstancesoftheoffense,particularlythattheDefendantwas p!  pleadingtoareducedchargeofrobberyandthattheaggravatedassaultinvolvingtheothervictim V"! hadbeendismissed. #  3      ׀Asanenhancementfactor,thetrialjudgeconsideredthattheDefendanthad <#" aprevioushistoryofcriminalconvictionsorcriminalbehaviorinadditiontothatbeingnecessary "$r# toestablishtheappropriaterange.TheDefendantdoesnotdisputetheapplicabilityofthatfactor. %X $ SeeTenn.CodeAnn.4035114(1). %>!% _  &$"&   Thetrialjudgealsofoundandappliedasanenhancementfactorthatthefelonyresultedin   deathorbodilyinjuryorinvolvedthethreatofdeathorbodilyinjurytoanotherpersonandthe  Defendanthadpreviouslybeenconvictedofafelonythatresultedindeathorbodilyinjury.Seeid. | 4035114(11).ThetrialjudgebasedthisfactorontheDefendantspriorconvictionsforfelony b recklessendangermentbecauseitappearedthattheconvictionsinvolvedtheuseofaknife. H However,theStateconcedesthatthetrialjudgeerredinapplyingthisfactorbecausethereisno . ~ indicationintherecordthatthepreviousconvictionsforrecklessendangermentresultedinbodily  d injurytoavictim.Infact,therecordreflectsthatnoonewasinjuredinthosecrimes. #  4        J   TheDefendantarguesonappealthatthetrialjudgeerredbynotfindingasamitigatingfactor    thattheDefendant,althoughguiltyofthecrime,committedtheoffenseundersuchunusual    circumstancesthatitisunlikelythatasustainedintenttoviolatethelawmotivatedthecriminal   conduct.Seeid.4035113(11).Healsoarguesthatthetrialcourtshouldhaveappliedas x  mitigatingfactorstheDefendantsexpressedremorseforhisconductandhisdemonstrateddesire ^  tocontinuetreatmentforhisdrugandalcoholaddictionproblem.Seeid.4035113(13).Based D  onourreviewoftherecord,wecannotconcludethatthetrialjudgeerredbyrefusingtoapplyeither *z  ofthesemitigatingfactorstotheDefendantssentence. `   InadditiontonotingtheDefendantslengthyrecord,thetrialjudgepointedoutthatthe , seriousandviolentnatureoftheDefendantscriminalconductappearedtobeescalating.Inthis  case,theDefendantdemonstratedviolentbehavioragainsttwoseparatevictims.Also,eventhough  thetrialjudgemisappliedoneenhancementfactor,theStatepointsoutthattheDefendanthasinthe  pastcommittedcrimeswhileonprobationforpreviousconvictions,demonstratingaprevioushistory t ofunwillingnesstocomplywiththeconditionsofapriorsentenceinvolvingreleaseinthe Z community.Seeid.4035114(8). @   Thesentencingrangeestablishedbythepleaagreementwaseighttotenyears.Basedonour  \ reviewoftherecord,wecannotconcludethatthetrialjudgeerredorabusedhisdiscretioninsetting B thelengthoftheDefendantssentenceattenyears.Thejudgmentofthetrialcourtisaccordingly ( affirmed.     `     h     ___________________________________      `     h     DAVIDH.WELLES,JUDGE
