Also,Idisagreewithmycolleaguesviewoftheproprietyofthetrialcourtsuseofa preferencetostartinmidrangeinmisdemeanorsentencingwithapparentadjustmentupordowndependingupontheexistenceofenhancementormitigatingfactors.Theyrightfullynotethatthe1989SentencingReformActdoesnotspecifywhereintherangethetrialcourtshouldstarttheprocessofsentencingmisdemeanants.However,Ibelievetheyaremistakenwhentheyconcludethatthismeansthattrialcourtshavethediscretiontostartatmidrange. d9\28S Ї IbelievethatStatev.Moss,727S.W.2d229(Tenn.1986),reviewingthe  1982SentencingReformAct,isdirectlyonpoint.isdirectlyon  point.񛀀InMoss,aseconddegreemurdercase,thetrialcourtnotedthatthe1982  SentencingReformActdidnotsayanythingaboutapresumptivestartingpointanddeterminedthatitwasappropriateforittostartitssentencinganalysisatthehalfwaypointintherange.Onappeal,thiscourtconcludedthatthe1982Actembodiedapolicyofthestartingpointbeingtheminimumsentencefortherange.However,oursupremecourtrejectedboththetrialcourtsandthiscourtsstartingpoints,statingthattheActcontemplates thatsentencesshouldbeconsideredonacasebycasebasisandthatthesentencingcourtshouldexerciseguideddiscretionwithinthetermsoftheAct,withoutadoptinganypresumptivesentencingmethod.Id.at238. 4,  Theprinciplesandpurposesofthe1982ActuponwhichMosswasbased  areessentiallythesamethatexistinthe1989Actandwhichapplytomisdemeanorsentencing.Inthepresentcase,thetrialcourtessentiallystartedatsixmonthsandincreasedthesentencetoelevenmonthsandtwentyninedays.Wehavenowayofknowingwhatthesentencewouldbeinconsiderationoftherelevantenhancementingandmitigatingfactorsandtheprinciplesandpurposesofthe1989Actbutwithoutamidrangestartingpoint.Aresentencingshouldoccur.    h      p _____________________________    h      p JosephM.Tipton,Judge
