àThe€Defendant,€David€William€Smith,€appeals€as€of€right€pursuant€toÏRule€3€of€the€Tennessee€Rules€of€Appellate€Procedure.€€On€August€30,€1994,ÏDefendant€entered€pleas€of€guilty€to€three€charges€of€aggravated€burglary€andÏthree€charges€of€theft€over€$1,000.€€Defendant€received€four€years€on€eachÏconviction€to€run€concurrently,€and€a€probation€order€was€entered€that€sameÏday.€€Defendantððs€probation€was€revoked€on€February€15,€1995,€and€he€wasÏordered€to€serve€his€sentence€on€Community€Corrections.€€On€July€14,€1995,€anÏOrder€was€entered€returning€Defendant€to€probationary€status€subject€to€theÏCommunity€Corrections€Supervision€Order.€€€On€December€1,€1995,€anotherÏarrest€warrant€was€issued€for€Defendantððs€violation€of€probation.€€€Following€aÏprobation€hearing€in€the€Circuit€Court€of€Sullivan€County,€€Defendantððs€probationÏwas€revoked€and€he€was€ordered€to€serve€the€sentence€in€confinement.€€In€hisÏsole€issue€on€appeal,€the€Defendant€argues€that€the€trial€court€abused€itsÏdiscretion€in€revoking€Defendantððs€probation€and€ordering€him€to€serve€hisÏsentence.€€We€affirm€the€judgment€of€the€trial€court.ÌÌà àOn€November€28,€1995,€at€approximately€10:15€p.m.,€Officers€DennisÏBanks€and€Fred€Overby€responded€to€2207€Anderson€Street€in€Bristol,ÏTennessee€to€pick€up€a€runaway€juvenile.€€While€placing€her€in€custody€theyÍwere€met€by€Defendant,€who€was€the€juvenileððs€boyfriend.€€The€Defendant€hadÏwords€with€the€officers€and€made€threats€that€he€could€handle€all€of€them€due€toÏhis€karate€knowledge.€€He€said€that€he€could€ð ðtake€them€out€anytime€he€wantedÏto.ðð€€The€officers€left€with€the€female€juvenile€and€drove€to€the€location€of€1301ÏAnderson€Street€where€they€stopped€to€attend€to€her€medical€needs.€€TheÏDefendant€approached€to€check€on€his€girlfriend,€and€again€threatened€theÏofficers€with€bodily€harm.€€At€this€point€Officer€Overby€called€for€back€up.€€ÏOfficers€Lloyd€Heaton,€Steve€Terry€and€Keith€Feathers€responded€to€the€call.€€ÏOfficers€Feathers€and€Terry€escorted€Defendant€away€from€the€scene.€ÏDefendant€told€these€officers€that€he€had€driven€to€the€location€and€that€his€carÏwas€parked€in€a€nearby€alley.€Ìà àÌà àA€few€minutes€later,€as€the€officers€were€standing€near€a€patrol€car€on€theÏright€side€of€the€street,€Officer€Terry€saw€a€car€approach.€€The€car€turned€off€itsÏheadlights,€accelerated,€and€then€swerved€to€the€right€towards€the€group€ofÏofficers.€€The€car€narrowly€missed€the€officers€and€then€sped€away.€€Some€ofÏthe€officers€pursued€the€vehicle€until€it€struck€two€utility€poles€and€stopped.€€TheÏdriver€got€out€of€the€vehicle€and€fled€on€foot.€€The€license€plate€on€the€car€wasÏregistered€to€the€Defendant.€€He€was€ultimately€apprehended€near€the€scene€ofÏthe€wreck€a€short€time€later.€€Defendant€had€to€be€chased€on€foot€after€he€wasÏrecognized€by€an€officer.ÌÌà àDefendant€was€charged€with€five€counts€of€Attempted€First€DegreeÏMurder€in€relation€to€the€events€on€November€28,€1995.€€A€Violation€of€ÏProbation€warrant€was€issued€on€December€1,€1995,€and€Defendant€wasÏarrested€the€same€day.€€The€probation€violation€alleged:€(1)€Violation€of€RuleÏOne€„€failure€to€obey€the€law€by€the€arrest€for€the€offenses€of€Attempted€FirstÏDegree€Murder€(five€counts);€(2)€Violation€of€Rule€Two€„€failure€to€immediatelyÏreport€the€new€arrest;€(3)€Violation€of€Rule€Seven€„€drinking€to€excess€in€relationÏto€the€events€of€November€28,€1995;€and€(4)€Violation€of€Rule€Eight€„€failure€toÏpay€fees€for€the€months€of€July€1995€through€November€1995.€€ÌÌà àAt€trial€on€the€attempted€murder€counts,€the€jury€acquitted€the€Defendant€ofÏAttempt€to€Commit€First€Degree€Murder,€five€counts,€but€reached€an€impasse€onÏall€lesser€included€offenses€which€were€still€pending€at€the€time€of€the€revocationÏhearing.€€€The€drinking€to€excess€violation€was€dismissed€and€the€court€madeÏno€finding€concerning€the€failure€to€pay€fines€or€failure€to€report€new€arrestÏcharges.€€The€trial€judge€did€find€sufficient€evidence€that€the€Defendant€was€theÏperson€driving€the€car€that€almost€hit€the€officers,€thus€violating€Rule€One,€failureÏto€obey€the€law.€ÌÌà àBoth€the€granting€and€denial€of€probation€rest€in€the€sound€discretion€ofÏthe€trial€judge.€€òòState€v.€Mitchellóó,€810€S.W.2d€733,€735€(Tenn.€Crim.€App.€1991).€ÏIn€determining€whether€or€not€to€revoke€the€probation,€the€trial€judge€need€not€findÏbeyond€a€reasonable€doubt€that€a€violation€of€the€terms€of€probation€hasÏoccurred.€€The€existence€of€a€violation€need€only€be€supported€by€aÏpreponderance€of€the€evidence.€€Tenn.€Code€Ann.€ðð€40„35„311(d)€(1990).€€ÌÌà àThe€trial€judge€must,€however,€adduce€sufficient€evidence€during€theÏprobation€revocation€hearing€to€allow€him€to€make€an€intelligent€decision.€ÏòòMitchellóó,€810€S.W.2d€at€735.€€The€determination€made€by€the€trial€court,€if€madeÏwith€conscientious€judgment,€is€given€the€weight€of€a€jury€verdict.€€òòStamps€v.ÏStateóó,€614€S.W.2d€71,€73€(Tenn.€Crim.€App.€1980),€òòpermóó€òòtoóó€òòappealóó€òòdeniedóó,€òòidóó.Ï(Tenn.€1981).ÌÌà àWhen€a€probation€revocation€is€challenged,€the€appellate€courts€have€aÏlimited€scope€of€review.€€For€an€appellate€court€to€be€warranted€in€finding€a€trialÏjudge€erred€in€determining€that€a€violation€has€occurred,€it€must€be€establishedÏthat€the€record€contains€no€substantial€evidence€to€support€the€conclusion€of€theÏtrial€judge.€€òòState€v.€Harkinsóó,€811€S.W.2d€79,€82€(Tenn.€1991).€€If€the€violation€isÏso€supported€by€the€record,€the€judgment€of€the€trial€court€revoking€probation€willÏnot€be€disturbed€on€appeal€unless€is€appears€that€the€trial€court€acted€arbitrarilyÍor€otherwise€abused€its€discretion.€€òòState€v.€Williamsonóó,€619€S.W.2d€145,€146Ï(Tenn.€Crim.€App.),€òòpermóó€òòtoóó€òòappealóó€òòdeniedóó,€òòidóó.€(Tenn.€1981).€€ÌÌà àAlthough€the€evidence€presented€at€the€hearing€was€mostlyÏcircumstantial,€it€was€sufficient€to€allow€the€trial€court€to€make€a€conscientiousÏand€intelligent€finding€of€a€violation€of€probation€by€a€preponderance€of€theÏevidence.€€The€Defendant€threatened€the€officers€by€making€repeated€commentsÏabout€ð ðtaking€them€out,ðð€evidently€in€response€to€his€girlfriend€being€taken€intoÏcustody.€€Defendant€approached€the€officers€again€after€they€stopped€on€theÏside€of€the€road€to€attend€to€his€girlfriendððs€medical€needs,€and€once€again,ÏDefendant€acted€in€an€extremely€threatening€manner€towards€the€officers.€€AfterÏbeing€escorted€away€from€the€scene,€Defendant€told€the€officers€that€his€carÏwas€in€a€nearby€alley,€and€a€few€moments€later€a€car€accelerated€and€thenÏswerved€towards€the€officers€in€an€attempt€to€strike€them.€€The€officers€pursuedÏthe€car€until€it€wrecked.€€It€was€discovered€that€the€license€plate€on€the€car€wasÏregistered€to€the€Defendant.€€A€few€minutes€later,€the€Defendant€wasÏapprehended€near€the€scene€where€the€car€wreck€occurred.€€ÌÌà àThe€trial€court€made€the€following€findings:€ð ð[t]he€act,€if€the€defendantÏcommitted€it,€would€I€think€constitute€a€violation€of€the€defendantððs€condition€toÏprobation€because€such€act€would€be€unlawful,€irregardless€of€the€degree€of€theÍoffense€involved.€€The€Court€is€aware€that€we€have€had€a€jury€trial€on€thatÏoffense.€€The€jury€did€reach€a€finding€of€not€guilty€of€attempt€to€commit€first€degreeÏmurder,€a€multiple€count€involving€the€officers€and€they€basically€had€a€hung€juryÏon€the€lesser€included€offense.€€But€in€this€hearing,€this€Court€s[i]ts€as€finder€ofÏfact.ðð€€Later€in€its€ruling€from€the€bench,€the€trial€court€stated€that€it€found€beyondÏa€reasonable€doubt€(while€recognizing€that€a€preponderance€of€the€evidenceÏwas€all€that€was€necessary)€that€Defendant€was€the€driver€of€the€vehicle€thatÏalmost€struck€the€officers.Ìà àÌà àThere€was€substantial€evidence€supporting€the€trial€courtððs€conclusion€that€ÏDefendant€was€the€driver€of€the€car.€€The€trial€court€properly€found€that€theÏDefendant€had€engaged€in€criminal€activity€constituting€a€violation€of€a€conditionÏof€Defendantððs€probation.€€This€issue€is€without€merit.€€€We€affirm€the€judgmentÏof€the€trial€court.€ÌÓÓœ›Ó
