InNovember1996,thepetitionerwasapparentlyconvictedoffirstdegreemurderandsentencedtolifeimprisonmentwithoutthepossibilityofparole.Thepetitionerfiledthepresentpetitionforpostconvictionreliefattackinghispreviousconvictionsbecausetheywereusedasanaggravatingcircumstanceinthesentencingphaseofhis1996murdertrial.However,noneofthejudgmentsheetsarecontainedintherecord.Thetrialcourtdismissedthepresentpetitionfindingthattheoneyearstatuteoflimitationshasexpired.  T.C.A.4030202(a) 3   כprovidesthatapersonincustodyunderasentenceofacourtofthisstatemustpetitionforpostconvictionreliefwithinoneyearofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealistakenor,ifnoappealistaken,withinoneyearofthedateonwhichjudgmentbecamefinal.ThePostConvictionProcedureActprovidesseverallimitedexceptionstotheoneyearstatuteoflimitations,howevernoneofthemareapplicabletothepresentcase.See4030202(b).Thepetitioninthiscasewasfiledwellbeyondtheapplicablestatuteoflimitations,andis,therefore,untimely. 4     Moreover,T.C.A.4030202(c)providesthatnomorethanonepetitionforpostconvictionreliefmaybefiledattackingasinglejudgment,andmandatesthatthetrialcourtshallsummarilydismissanysecondorsubsequentpetitionifapriorpetitionwasfiledandresolvedonthemeritsbyacourtofcompetentjurisdiction.SincethepetitionerpreviouslyfiledatleastonepetitionthatwasresolvedonthemeritsbythetrialcourtandbythisCourtonappeal,thepetitioner'spresentpetitionwasproperlydismissed.Additionally,afterreviewingtheentirerecordonappeal,wefindthatthepetitionersclaimdoesnotfallwithinoneofthelimitedcircumstancesunderwhichapriorpetitionmaybereopened.SeeT.C.A.4030217.  Forthereasonsstatedabove,weconcludethatthetrialcourtdidnoterrindismissingthepetitionerspetitionforpostconvictionrelief.Accordingly,itisherebyORDEREDthatthejudgmentofthetrialcourtisaffirmedinaccordancewithRule20,RulesoftheCourtofCriminalAppeals.
