4„ ÐÌà  àWithout€a€cellular€telephone,€Ms.€Wisdom€could€not€immediately€call€for€assistance€or€reportÐ  \ Ðthe€suspicious€behavior.€€She€saw€someone€driving€a€truck€in€the€adjoining€city€park,€and€went€toÐ øH Ðthe€driver€and€asked€to€use€his€cellular€phone€to€call€9„1„1.€€She€reported€the€burglary€in€progress€andÐ ä4 Ðwas€instructed€to€go€back€and€get€the€license€number€of€the€vehicle€parked€by€the€front€door€to€theÐ Ð  Ðschool.€€She€did€so.€€She€looked€down€to€get€something€to€write€on,€and€when€she€again€looked€atÐ ¼  Ðthe€vehicle,€she€observed€a€black€male€come€out€of€the€school€with€something€in€his€hand€andÐ ¨ø Ðapparently€place€it€in€the€passenger€side€of€the€vehicle€in€front€of€the€door.€€Ð ”ä ÐÌà  àThe€black€male€walked€around€the€vehicle€and€looked€inside€the€driverððs€window,€and€thenÐ l¼ Ðapparently€observed€Ms.€Wisdom.€€At€the€same€time€that€Ms.€Wisdom€observed€a€police€car€comingÐ X ¨ Ðeither€the€two€white€males€or€the€black€man€who€ran€back€inside€the€school€building.Ð $X" ÐÌà  àSeveral€police€officers€arrived€at€the€scene€within€moments.€€Corporal€Robert€Odom€testifiedÐ à%0!$ Ðthat€he€was€dispatched€at€5:56€a.m.€to€Centennial€Elementary€School.€€He€observed€a€maroon€vehicleÐ Ì&"% Ðunder€the€canopy€at€the€front€entrance€of€the€school.€€He€also€saw€Ms.€Wisdom€beside€her€vehicle.€Ð ¸'#& ÐMs.€Wisdom€told€Officer€Odom€the€direction€that€the€two€white€males€had€run.€€Odom€walked€overÐ ¤(ô#' Ðto€the€location€where€the€men€had€run€down€the€hill,€and€noticed€that€the€two€white€males€had€run€Ð )à$( Ðtoward€a€nearby€apartment€complex€known€as€Crosby€Terrace€West€Apartments,€which€could€beÐ |*Ì%) Ðseen€from€the€school€property.€€Ð h+¸&* Їà  àBrian€Johnson,€who,€at€the€time,€was€the€K„9€officer€for€the€Dickson€Police€Department,Ð ° Ðbrought€his€ð ðcertifiedðð€search€dog€to€the€scene€of€the€crime.€€A€perimeter€was€set€up€and€Johnson,Ð œì Ðalong€with€Officer€Odom€and€Sergeant€Mosley,€entered€the€school€to€see€if€anyone€could€be€found.€Ð ˆØ ÐNo€one€was€found€inside€of€the€building.€€However,€the€dog€picked€up€the€scent€of€two€tracks€outsideÐ tÄ Ðthe€building.€€One€track€was€picked€up€at€the€corner€of€the€school€building€where€Ms.€Wisdom€hadÐ `° Ðstated€that€the€two€white€males€had€run.€€This€trail€led€directly€to€apartment€16„B€of€Crosby€TerraceÐ L œ ÐWest€Apartments.€€Officer€Johnson€also€testified€that€there€was€a€split€of€the€tracks€of€a€person€orÐ 8 ˆ Ðpersons€at€a€culvert€between€the€school€and€Crosby€Terrace€West€Apartments.€€The€second€track€wasÐ $ t Ðheading€back€toward€Crosby€Terrace€West€Apartments€after€it€had€branched€away€from€the€firstÐ  ` Ðtrack,€but€the€K„9€search€dog€became€hot€and€tired€and€the€tracking€had€to€cease.€€Ð ü L  ÐÌà  àBooty€Reed,€director€of€the€Dickson€Housing€Authority,€testified€that€he€was€responsible€forÐ Ô$  Ðmanagement€of€the€Crosby€Terrace€West€Apartments.€€He€testified€that€apartment€16„B€was€leasedÐ À  Ðto€Crystal€Merrill,€and€that€apartment€7„B€was€leased€to€Jamie€Simco.€€Richard€Darden€testified€thatÐ ¬ü  Ðhe€worked€for€an€agency€that€ð ðhad€connectionsðð€with€Dale€Merrill€and€Defendant.€€Dale€Merrill€hadÐ ˜è  Ðgiven€his€address€as€16„B€Crosby€Terrace€West,€and€Defendant€had€given€his€address€as€7„B€CrosbyÐ „Ô  ÐTerrace€West.Ð pÀ ÐÌà  àGary€Brunett,€the€principal€at€Centennial€Elementary€School,€testified€that€he€examined€theÐ H˜ Ðextensive€damage€done€during€the€July€7,€2000€incident.€€He€further€testified€as€to€the€value€ofÐ 4„ Ðproperty€taken€and€damages€done€to€the€property.€€Pamela€Brock,€a€teacher€at€Centennial€ElementaryÐ  p ÐSchool,€also€worked€in€the€extended€daycare€at€Centennial€Elementary€during€the€summer€of€2000.€Ð  \ ÐShe€had€closed€down€the€school€at€the€end€of€the€day€on€July€6,€2000.€€After€the€burglary,€it€wasÐ øH Ðdiscovered€that€her€name€tag€was€missing.€€Ms.€Brock€testified€that€she€had€never€been€to€CrosbyÐ ä4 ÐTerrace€West€Apartments€in€her€life.€€Ð Ð  ÐÌà  àOrville€ð ðBubbaðð€Sesler,€an€officer€with€the€Dickson€Police€Department,€testified€that€he€wasÐ ¨ø Ðdispatched€to€Centennial€Elementary€School€shortly€after€the€incident€was€reported.€€While€en€route,Ð ”ä Ðhe€was€redirected€by€the€dispatcher€to€Crosby€Terrace€West€Apartments.€€He€arrived€at€6:04€a.m.€Ð €Ð ÐHe€stopped€near€apartment€16„B.€€Sesler€observed€the€Defendant€running€toward€apartment€16„B,Ð l¼ Ðstop€at€the€door€of€16„B,€and€begin€beating€on€the€door€in€an€effort€to€have€someone€let€him€in.€Ð X ¨ ÐDefendant€had€come€running€from€behind€some€of€the€other€nearby€apartments.€€Sesler€approachedÐ D!” Ðthe€Defendant€and€brought€him€back€to€the€police€vehicle€for€investigation.€€Sesler€went€to€apartmentÐ 0"€  Ð16„B,€along€with€an€officer€from€the€Dickson€County€Sheriffððs€Department,€and€knocked€on€theÐ #l! Ðthrough€photographs,€the€route€taken€by€him€to€arrive€at€the€school€grounds.€€Trooper€MillerððsÐ $X" Ðtestimony€was€that€a€person€sitting€in€the€area€where€Defendant€claimed€to€be€sitting,€would€haveÐ ô$D # Ðbeen€unable€to€see€the€highway€patrol€car€arrive,€due€to€the€contour€and€shape€of€the€premises.Ð à%0!$ ÐÌà  àDale€Merrill€was€called€by€defense€counsel€to€testify€at€the€trial.€€Merrill€had€already€pledÐ ¸'#& Ðguilty€because€of€his€participation€in€the€burglary,€vandalism,€and€theft€at€Centennial€ElementaryÐ ¤(ô#' ÐSchool.€€Merrill€testified€that€he,€Rodney€Nichols,€and€Tim€Justice€broke€into€Centennial€ElementaryÐ )à$( ÐSchool€in€the€early€morning€hours€of€July€7,€2000.€€òòóóMerrill€stated€that€Defendant€was€not€present.€Ð |*Ì%) ÐProof€showed€that€Dale€Merrill€and€Tim€Justice€are€white€males.€€When€questioned€as€to€RodneyÐ h+¸&* ÐNicholsðð€race,€Merrill€testified€that€ð ðI€believe€heððs€mixed.€€I€donððt€know€what€heððs€mixed€with,€butÐ ° Ðheððs€light„skinned.ðð€€Merrill€testified€that€the€three€first€began€shooting€Merrillððs€.22€caliber€rifleÐ œì Ðaround€the€school,€and€shot€out€a€couple€of€the€windows.€€They€began€looking€inside€the€school€andÐ ˆØ Ðsaw€televisions€and€computers.€€He€said€it€was€a€spur„of„the„moment€decision€to€break€in€and€getÐ tÄ Ðitems€to€make€some€money.€€Merrill€testified€that€he€sent€Rodney€Nichols€to€go€back€to€apartmentÐ `° Ð16„B€to€get€Timððs€Blazer€automobile.€€However,€Nichols€came€back€with€Jennifer€Smithððs€vehicle.€Ð L œ ÐMerrill€stated€that€he€and€Tim€Justice€were€loading€a€television€and€a€computer€in€the€vehicle€andÐ 8 ˆ ÐRodney€Nichols€was€inside€the€school.€€He€observed€a€car€come€around€the€corner€and€he€and€JusticeÐ $ t Ðbegan€running.€€Merrill€ran€to€apartment€16„B€at€Crosby€Terrace€West€Apartments.€€He€took€off€hisÐ  ` Ðyellow€shirt,€laid€it€by€the€door,€and€climbed€into€the€closet€attic.€€He€testified€that€Rodney€NicholsÐ ü L  Ðwas€wearing€a€shirt€like€a€tank€top€during€the€burglary.€€During€cross„examination,€Merrill€admittedÐ è 8  Ðto€having€been€previously€convicted€of€prior€felonies,€including€theft,€burglary,€and€vandalism.€€HeÐ Ô$  Ðhad€known€Defendant€for€about€five€years.€€Merrill€could€not€explain€why€Defendant€would€haveÐ À  Ðgiven€a€statement€to€police€that€ð ðBenjiðð€and€ð ðJokerðð€had€committed€the€burglary€at€the€school.Ð ¬ü  ÐÌà  àMerrillððs€testimony€was€impeached€with€testimony€from€his€own€guilty€plea€submission.€€AtÐ „Ô  Ðthat€hearing,€he€stated€that€it€was€he,€rather€than€Nichols,€who€had€taken€Jennifer€Smithððs€vehicle€toÐ pÀ Ðthe€school.€€Merrill€had€also€testified€at€his€guilty€plea€submission€that€Tim€Justice€was€inside€theÐ \¬ Ðschool€when€the€first€car€drove€up€(Ms.€Wisdomððs€vehicle)€and€that€he€and€Rodney€Nichols€ran€offÐ H˜ Ðtogether€away€from€the€school.€€He€claimed€that€he€had€the€names€mixed€up€at€the€guilty€pleaÐ 4„ Ðsubmission€hearing.Ð  p ÐÌà  àDetective€Fleaner€was€again€called€as€a€witness€during€the€Defendantððs€proof.€€He€identifiedÐ øH Ða€shirt€and€a€pair€of€pants€that€Defendant€was€wearing€at€the€time€he€was€taken€into€custody€on€theÐ ä4 Ðmorning€of€July€7,€2000.€€He€also€testified€that€mud€on€the€clothing€could€be€attributed€to€crawlingÐ Ð  Ðunder€a€fence€which€was€between€Centennial€Elementary€School€and€Crosby€Terrace€WestÐ ¼  ÐApartments.€€The€shirt€was€not€a€sleeveless€or€tank€top€shirt.€€Ð ¨ø ÐÌà@òò&ìàò òANALYSISó óˆÐ €Ð ÐÌà  àò òI.€€Sufficiency€of€the€EvidenceÐ X ¨ Ðó óÌà  àWhen€an€accused€challenges€the€sufficiency€of€the€evidence,€this€court€must€review€theÐ 0"€  Ðrecord€to€determine€if€the€evidence€adduced€during€the€trial€was€sufficient€"to€support€the€findingÐ #l!
