OnAugust13,1997,AppellantfiledherprosepetitionforpostconvictionreliefintheLincolnCountyCircuitCourt.Inherpetition,shealleged,interalia,ineffectiveassistanceofcounselandexpostfactoapplicationoflawsbothinthesentencingandpostconvictionproceedings.ThetrialcourtdismissedthepetitionwithoutahearingonAugust9,1997. PriortotheadoptionoftherecentPostConvictionProcedureAct,petitionslikethepresentonehadtobefiledwithinthreeyearsofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealwastaken.Tenn.CodeAnn.4030102(1995,Repl.).However,thenewPostConvictionProcedureAct,whichtookeffectonMay10,1995,subsequentlyshortenedthethreeyearstatuteoflimitationstooneyear.Tenn.CodeAnn.4030201etseq.(Supp.1996).AppellantsstatuteoflimitationsforthefilingofapetitionforpostconvictionreliefbegantorunonJune12,1995,thedatethattheTennesseeSupremeCourtdeniedherapplicationtoappeal,andexpiredoneyearlateronJune12,1996.AppellantfiledherpetitiononAugust13,1997,morethanoneyearaftertheexpirationofthelimitationsperiod.WeconcludethatthetrialcourtproperlydismissedtheAugust19,1997petitionasbeingbarredbythestatuteoflimitations.
