TheDefendantwasconvictedonajuryverdictofseconddegreemurder.ForthisClassAfelonyoffense,hewassentencedtoservetwentyyearsintheDepartmentofCorrectionasaRangeIstandardoffender.Heappealsthelengthofhissentence.Weaffirmthejudgmentofthetrialcourt. ` AtapproximatelymidnightontheeveningofFebruary18,1995,afifteenyearoldhighschoolsophomorewaskilledafterafightbrokeoutamongseveralindividualsinashoppingcenterparkinglot.Thecauseofdeathwasasinglestabwoundtothevictimschestwhichpenetratedhisheart.Immediatelypriortothekilling,thegroupofyoungpeoplegatheredontheparkinglothadbeeninvolvedinsomesortofanaltercation.AlthoughtheevidencedemonstratedthattheDefendantinflictedthefatalknifewoundtothevictim,theDefendantarguedthatheactedinselfdefense.Thejuryrejectedhisdefenseandfoundhimguiltyofseconddegreemurderascharged.Afterconductingasentencinghearing,thetrialjudgesentencedtheDefendantasaRangeIstandardoffendertotwentyyearsintheDepartmentofCorrection,whichisamidrangesentenceforthisClassAfelony.ItisfromthelengthofthesentenceimposedbythetrialjudgethattheDefendantappeals. ` Whenanaccusedchallengesthelength,range,ormannerofserviceofasentence,thiscourthasadutytoconductadenovoreviewofthesentencewith 4~+, apresumptionthatthedeterminationsmadebythetrialcourtarecorrect.Tenn.CodeAnn.4035401(d).Thispresumptionisconditionedupontheaffirmative 8^/0 showingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169 P  (Tenn.1991). ` Ifourreviewreflectsthatthetrialcourtfollowedthestatutorysentencingprocedure,imposedalawfulsentenceafterhavinggivendueconsiderationandproperweighttothefactorsandprinciplessetoutunderthesentencinglaw,andthatthetrialcourt'sfindingsoffactareadequatelysupportedbytherecord,thenwemaynotmodifythesentenceevenifwewouldhavepreferredadifferentresult.Statev.Fletcher,805S.W.2d785,789(Tenn.Crim.App.1991). @,"$  ` ThepresentencereportreflectsthatatthetimeofsentencingtheDefendantwastwentyoneyearsoldandunmarried.Hedroppedoutofhighschoolintheeleventhgrade.Thereportreferencedahistoryofalcoholanddrugabuse.Hisratherbriefemploymenthistoryhadbeeninconstructionwork.Hisjuvenilerecordconsistedofadjudicationsfortheft,destructionofproperty,beingunruly,unauthorizeduseofemergencyequipment,andviolationofprobation. 9p02 Asajuvenile,hewascommittedtotheDepartmentofYouthDevelopment],]underwhosecustodyheremaineduntilhewasdischargedafterhisnineteenthbirthday.Atthetimeofhissentencing,burglaryofanautomobileandtheftchargeswerependingagainsthiminanothercounty. ` InsentencingtheDefendant,thetrialcourtfoundandappliedasenhancementfactorsthattheDefendanthadahistoryofcriminalconvictionsorcriminalbehavior,thattheDefendantwasaleaderinthecommissionoftheoffense,thattheoffensewascommittedtogratifytheDefendantsdesireforpleasureorexcitement,andthattheDefendantpossessedoremployedadeadlyweaponduringthecommissionoftheoffense.Tenn.CodeAnn.4035114(1),(2),(7),(9).Thetrialcourtfoundnomitigatingfactorsapplicable. ` TheDefendantarguesthatthetrialcourterredinsettinghissentenceattwentyyearsbecausetheevidencedoesnotestablishthathewasaleaderinthecommissionofanoffenseinvolvingtwoormorecriminalactors.Wedisagree.WebelievetherecordestablishesthattheDefendantandhiscompanionsproceededtotheparkinglotthatnightlookingforafight.TheDefendantletitbeknowntohiscompanionsthathewasarmedwithaknifeandindicatedthathewoulduseitifnecessary.TheDefendantstatedthathe wonderedwhatitfeltlikeifsomeonegotcut.AlthoughitappearsclearthattheDefendantactedaloneinstabbingandkillingthevictim,wecannotconcludethatthetrialjudgeerredinfindingthattheDefendantwasaleaderinthecommissionofanoffenseinvolvingtwoormorecriminalactors. 5,.   7.0  ` TheDefendantalsopointsoutthatthetrialjudgefoundtheDefendantwas not remorsefulabouthisconductandarguesthatthecourtimproperlyappliedthisfindingasa nonstatutoryenhancementfactor.AlthoughthetrialcourtwasclearlyconcernedovertheDefendantsapparentlackofremorseforkillingthevictim,webelievetherecordisclearthatthecourtdidnotapplyhislackofremorseasanenhancementfactor.Thecourtspecificallyfoundandappliedonlythefourenhancementfactorsstatedabove. ` TheDefendantalsoarguesthatthetrialcourterredinfailingtofindandapplythefollowingmitigatingfactorsprovidedbyTenn.CodeAnn.4035113:ϜtheDefendantactedunderstrongprovocation;substantialgroundsexisttendingtoexcuseorjustifytheDefendantscriminalconduct,thoughfailingtoestablishadefense;theDefendant,becauseofyouthoroldage,lackedsubstantialjudgmentincommittingtheoffense;theDefendant,althoughguiltyof]]thecrime,committedtheoffenseundersuchunusualcircumstancesthatitisunlikelythatasustainedintenttoviolatethelawmotivatedthecriminalconduct;andtheDefendantexpressedremorse,cooperatedwiththeauthoritiesandwithdrewfromthefightoncehis attackerslefthimalone.SeeTenn.CodeAnn.^__^_4035113_a P* " a_(2),_bb_(3),_cc_(6),_dd_(11),_ee_(13)._`.`Basedonourreviewofthisrecord,wesimplycannotconcludethatthetrialjudgeerredbynotfindingorapplyinganyofthesemitigatingfactors. `
