Inthisappeal,thepetitionerarguesthattrialcounselwasineffectiveforhavingfailedto  adequatelyinvestigatethecaseand,inparticular,havingfailedtocallEllaJoBurrowasawitness. t ThepetitionercontendsthatMs.Burrowwouldhavetestifiedthatshehadseenthevictimofthe ` murdercarryingaweaponearlieronthedayofthemurder.Becausethepetitionerclaimedself L  defense,hearguesthatMs.Burrow'stestimonymighthaveproducedadifferentresult.The 8  petitionerfurthercomplainsthathistrialcounselfailedtointerviewDetectiveStanleyHilgadiack, $ t theleadinvestigatorforthestate.Thepetitioneralsopointsout,withnosupportingargument,that  ` histrialcounselfailedto"fullyapprisehimselfofthefactswithregardtoseveralwitnesses"and  L  "failedtofileamotiontosuppress"statementsmadebythepetitionertoinvestigatingofficers.  8    DuringtheearlymorninghoursofFebruary23,1995,officersoftheGallatinPolice   Departmentwereconductinganinvestigationofthreeshootingincidentsoveratwohourperiod.   Duringtheinvestigation,policefoundthedeceasedvictim,ChuckieVaughn,whohadbeenshotto   death.Hehadsixwounds.Aloadedshotgunandseveralunfiredshotgunshellslaynearthevictim.   Therewasnoevidencethattheshotgunhadbeenfiredbut.22calibershellcasingswerediscovered p within30feetofthevictim.Therewerenosignsofastruggle.SheritaBennetttoldpolicethatshe \ hadseenthepetitionerintheareaofSouthBlakemoreandChurchStreetsduringtheveryearly H morninghours.Aboutaweeklater,a.22caliberrifletiedtoarockwasfoundinTownCreek. 4   Thepetitionerimmediatelybecameasuspectaftertheshooting.Ultimately,headmittedto  \ killingthevictimandanaudiotapeofhisstatementtopolicewasplayedforthejuryatthetrial. H   Thepetitionerstatedtopolicethatheshotthevictimfromabout50yardsawaywitha.22   caliberrifleandwasnotsurewhetherhehadstruckhimornot.Thepetitionerclaimedthatatthe   timeoftheshooting,thevictimwasfiringshotstowardsanotherresidence.Thepetitioneradmitted  thathewashiddenjustbeforehefiredtheshots.Heclaimedselfdefense,explainingthatifhehad  run,thevictimwouldhaveshothimintheback.Inaseparate,unrecordedstatement,thepetitioner  toldDetectiveHilgadiackthatheandthevictimhadbeeninvolvedinashootoutearlierinthe l evening. X    Atthetimeoftheshooting,firstdegreemurderrequiredproofof"intentional,premeditated 0"  anddeliberatekillingofanother."Tenn.CodeAnn.3913202(a)(1)(1991).Onappeal,the #l! petitionercontendedthatthestateprovedneitherpremeditationnordeliberation.Thiscourt $X" determinedthattheproofindicatedthatthepetitionershotandmissedthevictimfromapproximately $D # 50yardsbeforehe"hidhimself,lyinginwaitforthevictim,"andthatwhenthepetitionerobserved %0!$ thevictimwalkingnearby,he"immediatelyfiredatleastsixshotswhichhitthevictim." &"%   Attheevidentiaryhearing,EllaJoBurrowtestifiedthatshehadheardgunshotsonthe (#' eveningofthemurderbuthadneverlookedoutsidetoidentifywhowasfiringtheshots.Ms. )$( Burrowadmittedseeingthevictimwithagun,afactnotatissueatthetrial,butdeniedhavingseen |*%) himfiretheweapon.Shesaidshelastsawthevictimabout10:00P.M.,asmuchasthreehours h+&* beforethemurder.Shewasnotpresentwhenhewasshot.Shestatedthatsheotherwiseknew  nothingaboutthemurder.    Trialcounseltestifiedattheevidentiaryhearingthathereliedonthestatementsthatthe t petitionerhadprovidedpolicetopresenttheissueofselfdefense.Hestatedthatheconductedhis ` owninvestigationandmetwiththepetitionerseveraltimespriortotrial.Trialcounseladmittedthat L  throughoversight,hehadfailedtofileanapplicationforpermissiontoappeal.Becausetherewas 8  nolegalbasistofileamotiontosuppressthedefendant'sstatementstopolice,hedecidednottofile $ t sucharequest.ItwashisbeliefthatMs.Burrow'stestimony,hadshebeenproducedasawitness  ` attrial,mighthaveprovidedsomeassistancetotheclaimofselfdefense.Trialcounselalsotestified  L  thathedidnotbelievethatthepetitioner,whodidnottestify,wouldbeaneffectivewitness.Trial  8  counselwasawarethatthepetitionerhadadmittedthatthe.22riflefoundinthecreekwasthe $  murderweapon.
