The  following  issueshavebeenpresentedforreview:  X 4(I) < whetherthetrialcourtshouldhaveheldahearing < beforetherevocationofhissuspendedsentenceandimpositionofgreatersentences;and(II) < whetherthejudgmentformsandordersreflect 4  illegalsentences.     4 vXh   The  judgmentof  revocationisaffirmed;thesentencesaremodifiedasprovidedherein.    Thisappealinvolvessentencingforthreeseparateconvictions.OnJune28,1991,incasenumber35815,thedefendantwasgivenaRangeI,twoyearsentencetobeservedonprobationfortheattemptedsaleofascheduleIIcontrolledsubstance,aClassDfelony.OnSeptember2,1992,probationonthetwoyeartermwasrevokedandthedefendantwasorderedtoservethefullsentenceincustody,lesscredit  for  serviceof105daysinjail.OnDecember22,1992,  T  t he  DepartmentofCorrectionplacedthedefendanton  determinate   probation  pursuanttoTenn.CodeAnn.4035501.  Whileouton  determinateprobation  forthetwoyearsentence,thedefendantincurredadditionalcharges.OnDecember8,1993,incasenumber47804,hereceivedaRangeI,eightyearsentenceinTDOCforpossessionofcocainewithintenttosell,aClassBfelony;thesentencewassuspendedandhewasplacedoncommunitycorrectionsforelevenyears.  Onthesamedate,  incasenumber49817,hereceivedaRangeI,threeyearsentenceforsaleoflessthanonehalfgramcocaine,aClassCfelony;thesentencewassuspendedandhewasplacedoncommunitycorrectionsforelevenyears.Thethreeyearsentencewasto  9/5 beservedconsecutivelytotheeightyearsentence.         #  1            `    Revocationwarrantswereeventuallyfiledforall  offenses.On  July21,1995,thetrialcourtheldabrief  hearing;no  proofwaspresented.     Apparently k ,thedefendantconcededthat     thetermsofthealternativesentenceshadbeenviolated.The  stateandthedefenseappearto  haveagreedthatthetrialjudge  should  revokethealternativesentencesandthenincreasethe  term,  aslongasthedefendantwasnotorderedtoserveanytimeincustody.Thetrialcourtaskedthedefendant,"You...understandIintendtoincreaseyoursentencesignificantlynow;sothat,ifyoudofail,youaregoingtospendsometimeinthepenitentiary."Thedefendantresponded,"Awholelot,yes."Thetrialcourtthenruledfromthebenchasfollows:X 4 < HereiswhatIhavegot.IhaveaneightyearsentenceandaBfelony.SothatcanbeincreasedtouptotwelveyearsasarangeIoffenderandathreeyearsentencein49817,whichisaCfelonyandincreasethattosixyears,foratotalsentenceofeighteenyears. < Now,Idonotknowhowtodealwiththispendingdeterminateprobation,becausethatwasnotfiguredinwhenweoriginallyputMr.MaxwellonC.A.P.P.inthesecases....IamgoingtoputhimonC.A.P.P.fortwoyearsinthiscase,also,andrunthatC.A.P.P.timeconcurrent....[H]iseffectiveC.A.P.P.sentencesiseighteenyears. '! 4 oXa}Ӝ" "   Thecourtalsoenteredawrittenorderonthatdate:X 4[I]ncaseno.35815,thedefendant'sStateProbation...is...revoked;andthedefendantplacedonCAPPforeighteen(18)yearstoexpireJuly21,2013.Incaseno.47804,thedefendant'sCAPPrevoked,sentenceincreasedfromeight(8)yearstotwelve(12)years,however,thedefendantisplacedbackonCAPPforeighteen(18)yearstoexpireJuly21,2013.Incaseno.49817,thedefendant'sCAPPrevoked,sentenceincreasedfromthree(3)yearstosix(6)years,however,thedefendantisplacedbackonCAPPforeighteen(18)yearstoexpireJuly21,  2013.   4 X  Sometimelater,onJanuary6,1997,  another  revocationwarrantwasfiled.  Attherevocationhearing,    Tamela     Wheeler,whosupervisedthedefendanton      C.A.P.P     .    ,  testified  thatthedefendanthadabscondedandthatshe  had  nocontact  from  May1996untilJanuary1997. I d.  d  .   at83.Thetrialjudgeisnotrequired d tofindthataviolationofthetermsofprobationhasoccurredbeyondareasonabledoubt.Stampsv.State,614S.W.2d71,73(Tenn.Crim.App.1980).Rather,the \  existenceofaviolationofprobationneedonlybesupportedbyapreponderanceoftheevidence.  Tenn.  CodeAnn.40-35-311(d). X$XX X$  Thedefendantconcedesheviolatedthetermsofhiscommunity , correctionssentenceanddoesnotcontesttherevocation.  Instead,  hecomplainsthatthetrialcourterredbyincreasinghissentencewithoutahearingandthattheordersreflectillegalsentences.   I  9  OnJuly21,1995,thetrialcourt   increased  theeightyearsentencetotwelveyearsandthethreeyearsentencetosixyears.Thetrialcourtdidsowithouthavingreceivedanyproofandwithoutmakingreferencetoanyofthesentencingprinciplesofthe1989Act.Thedefendantarguesthatbecausethetrialjudgefailedtoconductanappropriatehearingbeforeincreasingthesentences,thecaseshouldberemanded"forfurtherproceedingswhichconformwiththe[defendant's]rightstodueprocessoflaw."   The  timeforappealingtheorderenteredonJuly21,1995,haslongsincepassed.Thedefendanthadthirtydaystofileanoticeofappeal.Tenn.R.App.P.4(a).Thetimelyfilingmaybewaived"intheinterestofjustice."Id.  Under L6,2 thecircumstances,however,  wearenotinclinedtodo  so.  Thedefendantagreedto 8.4 theincreaseinsentence.Atthehearing,defense  counsel ,  statedtothetrialcourt:X 4Ithinkthatyouweregoingtoaddadditionaltimetohissentence.Thatwasoneoftheconditionsofreleasinghim,andthatiswhatMr.Maxwellwantstodo.SoIamgoingtoaskthatyoudo  that.   4 >X>>   Clearly,  thedefendantagreedtotheadditionaltime,inexchangefornotbeingplacedincustodyafterthe  revocation.  Itisonly  becausehenow   has   toactually to serve  theagreeduponsentencethathecomplains.  Whenacommunitycorrectionssentenceisrevoked,thetrialcourtmayincreasethesentence.Tenn.CodeAnn.4036106(e)(4);Statev.Griffith, F 787S.W.2d340(Tenn.1990).Theincreasesfromeight  to  twelveyearsandfromthreetosixyearsarebothwithinthestatutorilypermissiblerange.Generally,beforethetrialcourtincreasesthesentence,asentencinghearingshouldbeheld.Statev.        Ervin     ,939S.W.2d581,583(Tenn.Crim.App.1996).Nonetheless,itisapparent v thesentenceswere   thepro  cu   ductofnegotiations. partofabargainedforexchange. There  arenocircumstancesherewhichwouldwarrant  th is  e   court review ing  of  ajudgmentwhichbecamefinalthreeyearsago.   II  TE  Thedefendantnextcomplainsthatheiseitherbeingforcedtoserveanillegalsentenceorthatthewrittenorderscontainclericalerrors.Inourview,thewrittenorderscontainedintherecorddocontainerrorswhichshouldbecorrected.  Thus,thecaseisremandedfor  modificationof    theorders  consistentwiththisopinion.  SeeTenn.R.  Crim  .P.36.     Thedefendant'sfirstcomplaintconcernsthetwoyearsentencehereceivedin1991.Hecomplainsthat"nowhissentenceappearstobeeighteenyearsinthestatepenitentiary."ThewrittenorderenteredonJuly21,1995,doesprovidethat"thedefendantisplaced...onCAPPforeighteen(18)years...."ThewrittenorderenteredonMarch20,1997,however,provides"theoriginaljudgmentofthisCourtonJune28,1991isputintofullforceandeffect."  Tofurtherconfusematters  Also ,  thetranscript 8/5 of  the  hearingheldin1995provides   that he  wastoservetwoyearsonC.A.P.P.concurrentwithhisothersentences.Thestateagrees  " itisclear that  thedefendant'stwo(2)yearsentenceincasenumber35815wasnotincreased."     ThetrialcourtiswithoutauthoritytoorderaneighteenyearcommunitycorrectionssentenceforaRangeIoffenderconvictedofaClassDfelony.Tenn.CodeAnn.4036106(e)(2);Tenn.CodeAnn.4035112.Whenimposingacommunitycorrectionssentence,"thecourtshallpossessthepowertosetthedurationofthesentence...atanyperiodoftimeuptothemaximumsentencewithintheappropriatesentencerange."  Tenn.
