Undertheseprinciples,anycomplaintabouttheconstitutionalvalidityofthepredicateconvictionsoroftheMVHOprocessmustfail.Similarly,giventhecivilnatureoftheproceeding,thedefendanthasnoconstitutionalrighttotheappointmentofcounsel.Likewise,nosuchstatutoryrightexists. Theremainingissueiswhethersufficientpredicateconvictionsexistedtojustifythedefendantbeingdeclaredahabitualmotorvehicleoffender.Onthispoint,thedefendantassertsthattheDUIconvictionofMay10,1996,wasnotfinalbecauseitwasonappealtothiscourtwhenthetrialcourtenteredtheMVHOjudgment.Therecordbearsthisout,eventhoughthedefendanthasfailedtomakethetranscriptoftheMVHOhearingapartoftherecordonappeal.Wetakejudicialnoticeofthefactthatthecasewasonappealatthetimeofthetrialcourthearing.SeeStatev.Robert  M.Sneed,No.03C019610CR00371,SullivanCounty(Tenn.Crim.App.Sept.30, d\ 1997). ThedefendantnotesthattheMVHOactdefinesaconvictionforitspurposesasa finalconviction.Tenn.CodeAnn.5510603(1).HeassertsthatthismeansthataconvictionthatisonappealmaynotbeusedasapredicateconvictioninanMMVHOproceeding. Inresponse,thestatereliesuponStatev.Loden,920S.W.2d261(Tenn. ,%* Crim.App.1995),adrivingonarevokedlicensecase.InLoden,thedefendant .', claimedthatbecausetheDUIconvictionthatledtolicenserevocationwasstillonappeal,therevocationwasnoteffectiveatthetimethathewaschargedwithDRL.HerelieduponTenn.CodeAnn.5550501,whichrequiresthedepartmentofsafetytorevokealicenseuponreceiptofarecordofaconvictionforcertainoffenses,includingDUI, whensuchconvictionhasbecomefinal.InTenn.CodeAnn.5550503, 706  :   :   :   :   :   :   :   :  convictionisdefinedforthepurposesoftheDriverLicenseschapterasa final :   :   :   :  conviction.
