Hepresentsforourreviewwhetherthetrialcourterredbydenyingthedefendantsposttrialmotionforjudgmentofacquittalormotionforanewtrial,allegingthattheevidencewasinsufficienttosustainaconviction.Healsoassertsthetrialcourtcommittederrorinrulingonanobjectionconcerningcrossexaminationofawitness,andfurtherallegesthejurywasimproperlyinfluenced. Forthereasonsstatedherein,theappealisdismissed.@ ProceduralHistory  ThejuryreturnedaverdictonAugust22,1995,findingthedefendantguiltyoftheftinanamountgreaterthan$1,000.00.Thedefendantfiledatimelymotionforanewtrialandforjudgmentofacquittal. ThemotionswerearguedonNovember17,1995,andwereoverruledbyorderenteredonJanuary26,1996. Thedefendantwasplacedonprobation,pursuanttoT.C.A.4035313,byorderofJanuary26,1996,whichwasfiledFebruary2,1996.Theorderdeferredfurtherproceedingsandplacedthedefendantonsupervisedprobationwiththedefendantbeingrequiredtoperform200hoursofpublicservicework,payafineof$1,000.00,payrestitutionof$8,000.00,andpaycostswithinoneyear. OnFebruary29,1996,thetrialcourtenteredastayofexecutioninthismatter. OnMarch19,1996,thecourtenteredanotherorderofposttrialdiversionpursuanttoT.C.A.4035313recitingthesamebasicconditionssetforthintheJanuary26thorder. OnMarch21,1996,thedefendantwasdischargedfromactivesupervision,withthebalanceoftheperiodofprobationtoremainineffect. OnApril12,1996,thedefendantfilednoticeofappeal. Thiscourtfindsthatthenoticeofappealwasnottimelyfiled.Noticeofappealmustbefiledwithandreceivedbytheclerkofthetrialcourtwithinthirtydaysafterthedateofentryofthejudgmentappealedfrom.T.R.Crim.P.37(d);T.R.App.P.4(a).& ̜ TheorderoverrulingthemotionfornewtrialwasenteredJanuary26,1996,atthesametimethattheorderplacingthedefendantonposttrialdiversionwasentered.NoticeofappealwasnotfileduntilApril12,1996.ThiscourthasthoroughlyreviewedtherecordandfindsnoreasonintheinterestofjusticetowaivethetimelyfilingrequirementofthenoticeofappealrequiredbyRule4oftheRulesofAppellateProcedure. InreviewingtherecordthisCourtfurtherfindsthatnoerroroccurredsuchastorequirereversalunderRuleofCriminalProcedure52(b)orRuleofAppellateProcedure36(a). ThisCourtwillnotdisturbaverdictofguiltduetothesufficiencyoftheevidenceunlessthedefendantdemonstratesthatthefactscontainedintherecordandtheinferenceswhichmaybedrawntherefromareinsufficient,asamatteroflaw,forarationaltrieroffacttofindtheaccusedguiltybeyondareasonabledoubt.Statev.Brewer,932S.W.2d1,19(Tenn.Crim.App.1996).Accordingly,itistheappellatecourtsdutytoaffirmtheconvictioniftheevidence,viewedunderthesestandards,wassufficientforanyrationaltrieroffacttohavefoundtheessentialelementsoftheoffensebeyondareasonabledoubt.Tenn.R.App.P.13(e);Jacksonv.Virginia,443U.S.307,317,99S.Ct.2781,2789,61L.Ed.2d560(1979);Statev.Cazes,,875S.W.2d253,259(Tenn.1994).Thecourtdeterminestheevidencewassufficientforarationaltrieroffacttohavefoundtheessentialelementsoftheoffensebeyondareasonabledoubt. ThisCourthasfurtherreviewedtherulingofthetrialjudgeonobjectionsattrialandfindsnoerrorrequiringreversal. Theappellantallegesthejurywasimproperlyinfluencedbyextraneous,prejudicialinformation,allegingthatonejurormayhavebeenabletohearadiscussionabouttheappellantsometimebeforetrial.Noaffidavitortestimonyfromthejurorwaspresentedintherecord.Thetranscriptofevidencedidnotincludethevoirdireormotionfornewtrial.Weareunabletodeterminewhetherthatjurororanyjurorwasquestionedconcerninganypossibleextraneousprejudicialinformation.Wefindtheappellanthasnotcarriedhisburdentoshowthatthejurorwasinsomewaybiased,prejudiced,orinfluencedbyextraneous,prejudicialinformation.Bowanv.State,598S.W.2d809,812(Tenn.Crim.App.1980).̛̜ We,therefore,dismisstheappealandremandtothetrialcourtforenforcementoftheorderofdiversion.        ______________________________        Sp.JUDGEJOEH.WALKER,IIICONCUR:________________________JOEG.RILEY,JUDGE________________________CURWOODWITT,JUDGE
