Statev.Lowe,661S.W.2d701,703(Tenn.Crim.App.1983).However,in1995legislationwas  enactedsoastoauthorizethoseconvictedofsecondoffenseDUItosecureworkreleaseunder  certainconditions.SeeTenn.CodeAnn.412128(c)(Supp.1995).Nevertheless,weconclude  thisstatutehasnoapplicationtothecasebeforeus. p   Thisstatuteislimitedinapplication.Tenn.CodeAnn.412128(a)expresslyprovidesthat P thisworkreleaseprogramisformisdemeanantssentencedtothecounty workhouse.Thestatute @ furtherprovidesthat thecourtofgeneralsessionsmay,uponapplicationofthesheriff,enteralike 0 orderforthesamepurposeforjailprisoners.Id.Thedefendantwasnotsentencedtothecounty  p  workhouse,butwassentencedtothecountyjail.Thedefendantwasnotsentencedtothecounty ` jailbythegeneralsessionscourt,butwassentencedbythecriminalcourt. #  1      ׀Itwould,therefore, P appearthatthedefendantisineligibleforworkreleaseunderTenn.CodeAnn.412128.See @ Tenn.Atty.Gen.Op.97021(March5,1997)(opiningthatTenn.CodeAnn.412128doesnot 0 applytosecondoffenseDUIoffenderssentencedbythecriminalcourttothecountyjail).     DefendantarguesthathisworkreleaseisauthorizedbyTenn.CodeAnn.412129(d) "  whichprovidesasfollows: #! 8  8`   Asanalternativetotheproceduresdescribedinsubsections(a),(b) % # and(c),thesentencingcourtmayplaceaprisoneronworkrelease p&!$ subjecttothetermsandconditionsthatthesheriffandthesentencing `'"% courtmayagreeupon.P(#&` x` x ЇHowever,bothTenn.CodeAnn.412128and412129wereoriginallyenactedatthesametime  anddidnotcreateseparateworkreleaseprograms.See1967PublicActs,Chapter259.Although  Tenn.CodeAnn.412129(d)wasaddedin1991,wedonotbelievethelegislatureintendedto  createaseparateworkreleaseprogram.See1991PublicActs,Chapter383.Thus,Tenn.CodeAnn.  412129simplyregulatesthedisbursementofthewagesofthosegrantedworkreleasepursuant p toTenn.CodeAnn.412128. `    DefendantnextarguesthatheiseligibleforworkreleasepursuanttoTenn.CodeAnn.41 @  2134.ThisstatutemakesnoreferencetothosesentencedforDUIoffenses.Tothecontrary,Tenn. 0  CodeAnn.412128(c)(1)providesthatsecondoffenseDUIoffendersmaybesentencedtowork  p  release pursuanttothissection,makesnoreferencetoTenn.CodeAnn.412134,andhas `  numerousrestrictiveconditionswhichdonotappearinTenn.CodeAnn.412134.We,therefore, P  concludethattheworkreleaseprogramauthorizedbyTenn.CodeAnn.412134wasnotintended @  forDUIoffendersduringtheirmandatoryminimumperiodofincarceration. 0    TheCriminalSentencingReformActauthorizesanysentencingcourttoorderworkrelease  asapartofasentenceforadefendantsentencedtothelocaljailorcountyworkhouse.SeeTenn.  CodeAnn.4035315.However,thisstatuteexpresslyprovidesthatitappliesonlytoDUI  offenders afterthemandatoryminimumsentenceshavebeenserved.Id.Defendantwas,  therefore,noteligibleforworkreleasepursuanttoTenn.CodeAnn.4035315.    WeconcludethatthisdefendantwasnoteligibleforworkreleasepursuanttoTenn.Code ` Ann.412128,412129,412134,4035315oranyotherprovisionsoftheCodeduringthe P minimummandatoryperiodofincarcerationforsecondoffenseDUI. @ @FF% CONCLUSION  p    ThereareseveralstatutesinourCodedealingwithworkrelease.Thiscourtcanonly P interpretandapplythesestatutesinaccordancewiththeirlanguage.Itmaywellbeappropriatefor @ thelegislaturetorevisittheprovisionsofthevariousstatutes;however,thatisforthelegislatureand 0 notthiscourt.
