Ðthe€appellee,€State€of€Tennessee.Ð #`" ÐÓ§ÓÌà@@OO&ìàò òOPINIONó óÔ#†¼%»XXFéÖ#ÔÔ‡XFéX»¼%ÔÐ è$8 $ ÐÌòòóóÔ#†¼%»XXFé™ #ÔÔ‡XFéX»¼%ÔÓ  Óà@ìàòòò òI.€€Factual€Backgroundó óóóÔ#†¼%»XXFé÷ #ÔÔ€XFéX»¼%ԈРÀ&"& Ðà  àà ` àOn€December€6,€2000,€Joan€Benton€invited€the€appellant€to€a€prayer€meeting€at€herÐ ¬'ü"' Ðhome.€€The€meeting€lasted€from€8:00€a.m.€until€9:30€a.m.€€Approximately€one€and€one„half€hoursÐ ˜(è#( Ðafter€the€conclusion€of€the€prayer€meeting,€Benton€noticed€that€her€credit€card€was€missing€from€theÐ „)Ô$) Ðkitchen.€€Benton€assumed€she€had€lost€the€card€until,€two€weeks€later,€she€received€a€credit€card€billÐ p*À%* Ðwhich€reflected€unauthorized€charges€totaling€almost€five€thousand€dollars.€€All€of€the€unauthorizedÐ \+¬&+ Ðcharges€were€made€after€Benton€discovered€the€card€was€missing.€€An€investigation€determined€thatÐ H,˜', Ðthe€appellant€had€taken€the€credit€card€and€incurred€the€charges.€€There€were€fifteen€differentÐ 4-„(-ý ÐÔ_Ôunauthorized€charges€on€the€bill;€however,€only€one€of€the€charges€occurred€in€Williamson€County.€Ð ° ÐAll€other€charges€occurred€in€Davidson€County.€€The€Williamson€County€offense€resulted€from€theÐ œì Ðappellantððs€charges€of€€$768.46€worth€of€merchandise€at€Cool€Springs€Target€in€Franklin.Ð ˆØ ÐÌà  àà ` àAs€a€result€of€the€charges,€the€appellant€pled€guilty€in€the€Williamson€County€CircuitÐ `° ÐCourt€to€forgery€involving€a€value€of€more€than€$500€but€less€than€$1,000,€and€to€fraudulent€use€ofÐ L œ Ða€credit€card€involving€a€value€of€more€than€$500€but€less€than€$1,000.׃×Ý ƒ#ÃÝòòÚ  Ú1Ú  ÚóóÝ  Ý×  ×€€The€plea€agreement€left€allÐ 8 ˆ Ðsentencing€determinations€up€to€the€discretion€of€the€trial€court.€€Ð $ t ÐÌà  àà ` àAt€the€sentencing€hearing,€Benton€testified€to€the€facts€underlying€the€offenses.€Ð ü L  ÐBenton€related€that€the€appellant€was€the€only€individual€to€go€into€her€kitchen€during€the€prayerÐ è 8  Ðmeeting,€after€which€meeting€she€discovered€the€credit€card€missing.€€Additionally,€a€security€cameraÐ Ô$  Ðat€Target€recorded€the€appellant€using€the€card.€€Benton€told€the€court€that€she€felt€ð ðextremelyÐ À  Ðbetrayed€and€violatedðð€as€a€result€of€the€offenses.€€She€also€observed€that€the€appellant€did€not€seemÐ ¬ü  Ðdestitute€at€the€time€of€the€offenses.€€Notably,€the€appellant€lived€in€a€ð ðlovely€homeðð€with€aÐ ˜è  Ðswimming€pool,€drove€a€nice€vehicle,€and€sent€her€children€to€private€school.€€Benton€informed€theÐ „Ô  Ðcourt€that€the€appellantððs€previous€attorney,€John€Nefflin,€had€contacted€Benton€and€her€husband€inÐ pÀ Ðan€effort€to€resolve€the€case€ð ðout€of€court.ðð€€One€week€prior€to€trial,€the€Bentons€received€a€letterÐ \¬ Ðwhich€the€appellant€denoted€as€her€ð ðattempt€to€apologize.ðð€€Benton€further€related€that€the€appellantÐ H˜ Ðhad€not€been€prosecuted€for€the€Davidson€County€offenses€and€she€thought€it€unlikely€that€theÐ 4„ ÐDavidson€County€District€Attorney€Generalððs€office€would€initiate€charges€against€the€appellant.€€Ð  p ÐÌà  àà ` àKim€Camp€testified€on€behalf€of€the€appellant.€€Camp€related€that€she€had€known€theÐ øH Ðappellant€for€eight€or€nine€years€and€considered€her€to€be€a€ð ðfaithful,€loving€friend.ðð€€Camp€indicatedÐ ä4 Ðthat€the€appellant€had€a€troubled€marriage€which€ended€in€a€bitter€divorce.€€Nevertheless,€she€statedÐ Ð  Ðthat€the€appellant€remained€concerned€about€providing€a€ð ðstable€environmentðð€for€her€two€children.€Ð ¼  ÐCamp€also€knew€that,€prior€to€these€offenses,€the€appellantððs€mother€had€passed€away€and€theÐ ¨ø Ðappellant€had€witnessed€a€horrendous€car€accident€in€which€the€appellantððs€daughter,€Haley;€theÐ ”ä Ðappellantððs€best€friend,€Alice€Freeman;€and€Freemanððs€son,€Will,€were€involved.€€The€crashÐ €Ð Ðultimately€claimed€the€life€of€Freeman.€€Camp€asserted€that€these€events€were€ð ðtraumaticðð€for€theÐ l¼ Ðappellant,€rendering€her€ð ðemotionally€devastated.ðð€€Camp€theorized€that€the€trauma€of€these€eventsÐ X ¨ Ðcompelled€the€appellant€to€return€to€€past€patterns€of€unwise€behavior.€€Regardless,€Camp€assertedÐ D!” Ðthat€the€appellant€recognized€her€wrongdoing€and€was€seeking€help€from€friends,€doctors,€andÐ 0"€  Ðcounselors.€€She€maintained€that€the€appellant€had€recently€obtained€a€ð ðdreamðð€job€and€had€movedÐ #l! Ðinto€a€good€neighborhood.€€Camp€conceded€that,€at€the€time€of€the€offenses,€the€appellant€was€notÐ $X" Ðdestitute€and€was€living€beyond€her€means.€€Camp€further€admitted€that€the€appellant€had€alsoÐ ô$D # Ðpreviously€stolen€her€credit€card€and€made€unauthorized€charges€on€two€occasions.Ð à%0!$ ÐÌà  àà ` àNext,€the€appellant€called€David€Pratt,€the€probation€officer€who€prepared€herÐ ¸'#& Ðâ âpresentence€report.€€Pratt€related€that€the€appellant€owed€$768.46€restitution€to€Citibank€for€theÐ ¤(ô#' ÐWilliamson€County€case.€€In€response,€the€appellant€immediately€tendered€to€Pratt€a€certified€checkÐ ° Ðfor€the€full€restitution€amount.Ð œì Ðâ âÌà  àà ` àThe€appellant€also€presented€the€testimony€of€Joe€Chilberg,€a€long„time€friend€of€theÐ tÄ Ðappellant.€€Chilberg€testified€that€the€appellantððs€life€had€been€tumultuous€for€two€to€three€years€priorÐ `° Ðto€the€incident,€and€the€appellant€was€ð ðmore€than€remorseful.ðð€€He€had€recommended€to€the€appellantÐ L œ Ðthat€she€seek€counseling€and€soon€thereafter€the€appellant€followed€Chilbergððs€advice.€€Ð 8 ˆ ÐÌà  àà ` àThe€appellant€testified€on€her€own€behalf.€€She€related€that€she€was€a€thirty„eight„year„Ð  ` Ðold€mother€of€two€children.€€She€explained€that€she€had€recently€accepted€a€position€as€theÐ ü L  Ðdevelopment€director€for€the€Nature€Conservancy€of€Tennessee.€€The€appellant€indicated€that€she€hadÐ è 8  Ðbeen€through€a€difficult€divorce€and€lost€her€mother€and€her€best€friend,€all€within€the€last€few€years.€Ð Ô$  ÐShe€stated€that€she€considered€Benton€to€be€a€friend€and,€on€December€6,€2000,€went€to€BentonððsÐ À  Ðhouse€to€pray.€€She€claimed€that,€during€the€meeting,€she€began€to€feel€ð ðanxiousðð€and€ð ðpressuredððÐ ¬ü  Ðand€took€Bentonððs€credit€card.€€She€used€the€card€to€purchase€necessities€and€Christmas€presents€forÐ ˜è  Ðher€family€and€other€friends.€€The€appellant€admitted€that€her€behavior€was€ð ðridiculousðð€and€ð ðoverÐ „Ô  Ðthe€top.ðð€€She€further€acknowledged€that€she€was€sorry€and€was€seeking€help.€€Contrary€to€BentonððsÐ pÀ Ðtestimony,€the€appellant€contended€that€the€reason€her€previous€attorney,€Nefflin,€contacted€theÐ \¬ ÐBentons€was€to€explain€that€the€appellant€was€responsible€for€all€of€the€unauthorized€charges€on€theÐ H˜ Ðcredit€card.€€Moreover,€the€appellant€maintained€that€she€had€been€diagnosed€with€bipolar€disorderÐ 4„ Ðand€had€previously€taken€anti„depressant€medication.€€She€also€asserted€that€she€wanted€to€getÐ  p Ðinvolved€in€a€mental€health€inpatient€program€to€help€her€understand€why€she€committed€these€acts.€Ð  \ ÐFinally,€she€expressed€her€desire€to€make€full€restitution.€Ð øH Ðà  àà ` àÌà  àà ` àOn€cross„examination,€the€appellant€told€the€court€that,€prior€to€her€death,€FreemanÐ Ð  Ðhad€obtained€a€credit€card€account€in€Freemanððs€name€with€an€additional€card€issued€to€the€appellantÐ ¼  Ðso€the€appellant€could€use€the€card€in€an€emergency.€€However,€the€appellant€confessed€that,€afterÐ ¨ø ÐFreeman€was€killed€in€the€car€accident,€the€appellant€used€the€card€to€make€ð ðirrationalðð€purchases,Ð ”ä Ðincluding€the€purchase€of€a€chair€for€Freemanððs€husband.€€The€appellant€quickly€asserted€thatÐ €Ð ÐFreemanððs€husband€was€reimbursed€for€the€charges.€€The€appellant€further€admitted€that,€while€livingÐ l¼ Ðin€Maryland€several€years€before€these€offenses,€she€took€a€credit€card€from€ð ðMr.€and€Mrs.Ð X ¨ ÐChamberlainðð€and€used€the€card€without€their€prior€approval.€€Additionally,€she€acknowledged€thatÐ D!” Ðshe€had€used€the€credit€cards€of€two€other€friends,€Camp€and€ð ðMr.€and€Mrs.€Bach,ðð€without€obtainingÐ 0"€  Ðtheir€permission.€€Ð #l! Ðthe€others.ðð€€òòId.óó€Ð à%0!$ ÐÌà  àà ` àThe€trial€court€thoroughly€considered€the€factors€concerning€judicial€diversion,Ð ¸'#& Ðremarking€that,€ð ðat€first€blush,ðð€the€appellant€appeared€to€be€an€appropriate€candidate€for€diversion.€Ð ¤(ô#' ÐThe€court€noted€the€following€factors€weighing€in€favor€of€the€granting€of€judicial€diversion:€theÐ )à$( Ðappellantððs€amenability€to€correction,€her€social€history,€her€lack€of€prior€criminal€convictions,€herÐ |*Ì%) Ðgood€attitude€toward€dealing€with€her€problems,€her€family€responsibilities,€the€attitude€of€lawÐ h+¸&* Ðenforcement,€her€acknowledgment€of€responsibility,€and€her€remorse.€€òòSeeóó€òòLewisóó,€978€S.W.2d€atÐ ° Ð566.€€Furthermore,€the€court€noted€that€the€appellantððs€ð ð[g]eneral€reputation€seems€to€be€good,€otherÐ œì Ðthan€she€steals€from€her€friends.ðð€€The€court€also€observed€that€the€appellantððs€mental€and€physicalÐ ˆØ Ðhealth€ð ðweighs€both€ways,ðð€and€concluded€that€the€appellantððs€emotional€stability€was€questionable.€Ð tÄ ÐIn€turning€to€the€factors€weighing€against€the€grant€of€judicial€diversion,€the€trial€court€placedÐ `° Ðsignificant€weight€on€the€fact€that€the€appellant€abused€a€position€of€private€trust€and€also€recognizedÐ L œ Ðthe€need€for€deterrence,€specifically€noting€that€the€appellant€had€previously€committed€acts€similarÐ 8 ˆ Ðto€the€instant€offenses.€€Ultimately,€the€trial€court€found€that€to€allow€the€appellant€to€continue€thisÐ $ t Ðtype€of€behavior€without€sanction€would€not€serve€the€ends€of€justice€for€the€appellant€or€society.Ð  ` ÐÌà  àà ` àThe€appellant€complains€that€the€majority€of€the€factors€to€be€considered€inÐ è 8  Ðdetermining€whether€to€grant€judicial€diversion€weigh€in€her€favor;€therefore,€the€trial€court€abusedÐ Ô$  Ðits€discretion€by€denying€diversion.€€Specifically,€the€appellant€argues€that€Ð À  Ðà8  àà8` Ð Ð à[a]t€the€hearing,€proof€was€introduced€th[at]€the€Appellantððs€nameÐ ¬ü  Ðwas€on€[Freemanððs]€card€.€.€.€and€she€was€a€joint€card€holder.€€As€farÐ ˜è  Ðas€the€other€incidents€[of€unauthorized€credit€card€usage]€areÐ „Ô  Ðconcerned,€the€record€is€mostly€silent.€€What€is€obvious€from€theÐ pÀ Ðrecord€is€that€no€criminal€charges€were€ever€filed.€€Perhaps€the€otherÐ \¬ Ðparties€forgave€her€for€what€she€allegedly€did€or€perhaps€gave€herÐ H˜ Ðpermission€after€the€fact.€€The€record€is€silent€in€this€regard€and€the€Ð 4„ ÐCourt€can€not€draw€facts€out€of€thin€[air].Ð p` x` x ÐÌà  àà ` àWe€acknowledge€that€much€of€the€appellantððs€history€is€positive€and,€at€first€blush,Ð øH Ðindicates€her€favorable€candidacy€for€judicial€diversion.€€However,€we€agree€with€the€trial€court€thatÐ ä4 Ðthe€need€for€deterrence€is€a€significant€factor€in€this€case.€€Our€supreme€court€recently€outlinedÐ Ð  Ðseveral€factors€to€be€considered€in€determining€when€deterrence€is€correctly€employed€to€denyÐ ¼  Ðprobation.€€òòState€v.€Hooperóó,€29€S.W.3d€1,€10„12€(Tenn.€2000).€€We€note€that€ð ð[d]eterrence€in€judicialÐ ¨ø Ðdiversion€cases€is€to€be€considered€in€the€same€manner€as€it€is€in€probation€cases.ðð€€òòState€v.€Parkeróó,Ð ”ä Ð932€S.W.2d€945,€959€(Tenn.€Crim.€App.€1996).€€However,€the€applicable€guidelines€ð ðare€moreÐ €Ð Ðstringently€applied€to€diversion€applicants.ðð€€òòState€v.€Hollandóó,€661€S.W.2d€91,€93€(Tenn.€Crim.€App.Ð l¼ Ð1983).€òòóó€The€following€factors€may€indicate€a€need€for€deterrence:Ð X ¨ Ðà8  àà8` Ð Ð à(1)€the€defendantððs€crime€was€the€result€of€intentional,€knowing,€orÐ D!” Ðreckless€conduct€or€was€otherwise€motivated€by€a€desire€to€profit€orÐ 0"€  Ðgain€from€the€criminal€behavior€[and]Ð#l!` x` x ÐÌà8  àà8` Ð Ð à(2)€the€defendant€has€previously€engaged€in€criminal€conduct€of€theÐ ô$D #
