Ðequipment€was€charged€on€€December€30,€1996,€a€$465€television€set€was€charged€on€January€1,Ð °"  Ð1997,€and€a€$227.93€videocassette€recorder€was€charged€on€January€4,€1997.€€Lantrip€stated€that€theÐ  #ð! Ðhospital€did€not€have€an€employee€named€Janet€Watson,€and€that€it€had€neither€authorized€theseÐ $à" Ðpurchases,€nor€received€any€of€these€items.€€Consequently,€the€hospital€had€not€paid€the€charges.Ð €%Ð # ÐÌà  àCindy€Ann€Coffman,€K„Mart€cashier€from€November€€1996€until€June€1997,€testified€that€Ð `'°"% Ðon€January€4,€1997,€a€woman€charging€items€to€the€hospital€had€passed€through€her€checkout€line.€Ð P( #& ÐCoffman€said€that€the€woman€had€filled€in€the€lines€on€the€storeððs€receipt€with€the€name€and€addressÐ @)$' Ðof€the€hospital,€and€had€signed€the€receipt€with€the€name€ð ðJanet€Watson.ðð€€Coffman€had€not€askedÐ 0*€%( Ðâ âfor€any€identification.€€She€had,€however,€asked€for€the€hospitalððs€tax€exempt€number,€which€theÐ  +p&) Ðwoman€had€provided.€€Coffman€identified€the€defendant€as€the€woman€who€had€charged€items€to€theÐ ° Ðhospital.€€Ð  ð Ðâ âÌà  àCoffman€said€that€she€had€known€on€January€4,€1997,€that€the€defendant€was€not€authorizedÐ €Ð Ðto€purchase€items€for€the€hospital.€€She€had€been€told€by€store€security,€however,€to€notify€them€ifÐ pÀ Ðthe€defendant€came€into€the€store,€and€to€let€them€handle€the€situation.€€She€notified€security€onÐ ` ° ÐJanuary€4òòóó,€but€the€defendant€was€able€to€leave€the€store€with€the€items.Ð P   ÐÌà  àCoffman€saw€the€defendant€in€the€store€again€on€February€5,€1997.€€On€that€day,€theÐ 0 € Ðdefendant€was€originally€in€Coffmanððs€checkout€line,€but€then€moved€to€a€line€staffed€by€€ð ðRosie,ðð€Ð  p  Ðwho€was€working€the€checkout€line€next€to€Coffman.€€Coffman€said€that€she€heard€the€defendant€askÐ `  ÐRosie€if€she€needed€a€tax€exempt€number,€and€that€the€defendant€then€left€the€checkout€line€and€theÐ P  Ðstore€and€did€not€come€back.€€Coffman€testified€that€she€watched€the€defendant€for€the€approximatelyÐ ð@  Ðfive€minutes€that€she€was€in€the€checkout€lines.€€Coffman€stated€that€she€later€picked€the€defendantððsÐ à0  Ðphotograph€out€of€six€photographs€shown€to€her€by€Detective€Bill€White.€€She€was€positive€that€theÐ Ð  Ðdefendant€was€the€woman€who€signed€the€January€4,€1997,€òòóóreceipt€with€the€name€ð ðJanet€Watson.ðð€Ð À ÐÌà  àThe€prosecution€sought€to€introduce€the€testimony€of€€Abby€Roseanna€(ð ðRosieðð)€Silva,€theÐ  ð ÐK„Mart€cashier€who€handled€the€February€5,€1997,€transaction€with€the€defendant.€€The€defenseÐ à Ðraised€a€Tennessee€Rule€of€Evidence€403€objection€to€this€testimony,€arguing€that€its€probative€valueÐ €Ð Ðwas€outweighed€by€the€danger€that€it€would€cause€unfair€prejudice€to€the€defendant.€€The€trial€courtÐ pÀ Ðoverruled€the€objection,€instructing€the€jury€that€the€testimony€was€to€be€considered€for€identificationÐ `° Ðpurposes€only.€€Ð P  ÐÌà  àSilva€testified€that€on€February€5,€1997,€the€defendant€moved€to€her€checkout€line€fromÐ 0€ ÐCoffmanððs€line.€€Silva€said€that€the€defendant€handed€Silva€her€driverððs€license€for€identification.€Ð  p ÐThe€name€on€the€license€was€that€of€the€defendant,€Stinson.€€Silva€€positively€identified€the€defendantÐ ` Ðas€the€woman€who€passed€through€her€line€that€day.€€She€said€that€she€had,€without€any€difficulty,Ð P Ðpicked€the€defendant€out€of€a€group€of€photographs€later€shown€to€her€by€Detective€White.€€Ð ð@ ÐÌà  àOver€the€objection€of€the€defense,€the€trial€court€allowed€the€prosecution€to€present,€forÐ Ð  Ðidentification€purposes€only,€the€testimony€of€Joann€Gaylor,€resource€coordinator€of€purchasing€atÐ À! ÐRidgeview,€who€testified€that€she€knew€the€defendant,€and€that€she€saw€her€in€the€K„Mart€store€onÐ °"  ÐFebruary€5,€1997.€€Ð  #ð! ÐÌà  àOak€Ridge€Police€Detective€William€T.€White€testified€that€he€investigated€the€thefts€afterÐ €%Ð # ÐK„Martððs€loss€prevention€manager€reported€it€to€the€police€on€€February€5,€1997.€€White€said€that€heÐ p&À!$ Ðinterviewed€Coffman€on€April€1,€1997,€and€that€at€that€time€she€had,€without€hesitation,€picked€theÐ `'°"% Ðdefendantððs€photograph€out€of€a€group€of€photographs€that€he€showed€her.€€White€stated€thatÐ P( #& ÐCoffman€positively€identified€the€defendant€as€the€woman€who€charged€the€items€to€the€hospitalððsÐ @)$' Ðaccount.€€In€a€separate€interview,€Silva€positively€identified€the€defendant€by€choosing€herÐ 0*€%( Ðphotograph€out€of€the€same€group€of€six€photographs€that€he€had€shown€Coffman.Ð  +p&) ÐÐ ,`'* Ðà  àThe€defendant€presented€alibi€testimony€in€an€attempt€to€prove€that€she€had€not€been€at€€K„Ð ° ÐMart€on€January€1,€1997.€The€defendantððs€mother,€Joann€Smith,€testified€that€she€talked€by€telephoneÐ  ð Ðwith€the€defendant€several€times€during€the€afternoon€of€January€1,€1997.€€Smith€said€that€herÐ à Ðdaughter€had€been€at€her€mother„in„lawððs€house€when€Smith€called€her€that€afternoon.€€TheÐ €Ð Ðdefendantððs€husband€testified€that,€although€he€could€not€be€sure,€€he€believed€that€the€defendant€hadÐ pÀ Ðbeen€with€him€at€his€motherððs€house€on€January€1,€1997.€€The€defendantððs€friend,€Lana€McDowell,€Ð ` ° Ðtestified€that€she€had€a€definite,€specific€memory€of€the€defendant€babysitting€for€her€on€January€1,Ð P   Ð1997.€Ð @  ÐÌà  àThe€State€sought€to€rebut€the€defendantððs€alibi€with€testimony€of€Audra€Lee€Gipson,Ð  p  Ðinvestigator€for€the€district€attorney€generalððs€office.€€The€defense€objected€on€the€grounds€that€theÐ `  ÐState€had€not€notified€€the€defense€of€the€witnessððs€identity€prior€to€trial.€€After€first€having€theÐ P  Ðprosecution€examine€the€witness€with€the€jury€excused,€the€trial€court€permitted€the€witness€to€testifyÐ ð@  Ðin€the€presence€of€the€jury.€Ð à0  ÐÌà  àGipson€testified€that€he€had€interviewed€alibi€witnesses€Joann€Smith€and€Lana€McDowellÐ À Ðbefore€trial.€€Gipson€said€that€when€he€interviewed€her,€Smith€stated€that€she€believed€her€daughterÐ ° Ðhad€been€at€Smithððs€home€with€her€on€January€1,€1997.€€Gipson€testified€that€McDowell€told€himÐ  ð Ðthat€she€believed€the€defendant€babysat€for€her€on€January€1,€1997,€but€was€not€absolutely€certainÐ à Ðthat€she€had.€€On€cross„examination,€Gipson€admitted€that€Smith€had€not€mentioned€whether€it€wasÐ €Ð Ðmorning,€afternoon,€or€evening€that€the€defendant€spent€at€her€home.€€Ð pÀ ÐÌà  àThe€jury€found€the€defendant€guilty,€and€on€October€14,€1998,€the€trial€court€enteredÐ P  Ðjudgment€on€the€juryððs€verdict.€€The€trial€court€sentenced€the€defendant€to€a€four„year€prison€term,Ð @ Ðwith€three€years€suspended,€and€denied€the€defendantððs€motion€for€a€new€trial.€€The€defendant€filedÐ 0€ Ða€timely€appeal€to€this€court.Ð  p ÐÌà@òò&ìàòòò òANALYSISˆÐ P ÐÌóóó óà@| | ìàò òI.€€Testimony€of€the€Stateððs€Rebuttal€WitnessˆÐ à0 ÐÌà  àó óThe€first€issue€the€defendant€presents€is€whether€the€trial€court€erred€in€allowing€the€State€toÐ À! Ðwas€in€the€store€on€February€5€and€was€the€woman€who€showed€the€ð ðStinsonðð€driverððs€license€toÐ °"  ÐSilva.Ð  #ð!
