OnMarch16,1995,threeaffidavitsofcomplaintandtheresultingarrestwarrantswerefiledagainstthedefendantforthreecountsofinsurancefraud.OnApril14,1995,anappearancebondintheamountof$30,000waspostedonbehalfofthedefendantbyappellantAABondingCompanyassurety.ThatappearancebondwastosecuredefendantspresenceinCriminalCourtonMay16,1995.However,defendantfailedtoappearandacapiaswasissuedforhisarrest.Atthattime,thetrialcourtorderedaconditionalforfeitureagainstAABondingCompany.ScirefaciaswasissuedandservedonappellantonJune16,1995. OnNovember9,1995,thetrialcourtgrantedappellantsmotiontoextendthetimeoffinalforfeiture180daysfromDecember15,1995.Sevenmonthslaterthedefendanthadstillnotbeenreturnedtocustodyandthetrialcourtenteredjudgmentforfinalforfeitureofthe$30,000bondonJuly17,1996.AABondingCompanyreturneddefendanttocustodywithin24hoursoftheorderoffinalforfeitureandpetitionedthecourtforrelieffromitsearlierjudgment.Appellantsoughtfullexonerationfromliabilityonthe$30,000bondunderTennesseeCodeAnnotatedsection4011203. Afterahearing,thetrialcourtagreedthatappellantwasentitledtosomereductionintheforfeiturebecausethedefendantwasultimatelyreturnedtocustody.However,itdeclinedtograntfullexonerationtoappellantandinsteadrelieveditof$15,000ofthejudgmentandorderedappellanttopaytheremaining$15,000.Appellantnowappeals,allegingthatthetrialcourtabuseditsdiscretioninfailingtograntfullexoneration. TennesseeCodeAnnotatedsection4011203grantstrialcourtsdiscretiontoexonerateabondingcompanyfromliabilitywherethedefendantisreturnedafterfinalforfeiturehasbeenordered.Thediscretionaffordedthetrialcourtinsuchmattershasbeendescribedas broadandcomprehensiveandistobeexercisedinaccordancewiththetrialcourtsconceptionofjusticeandright.Statev.Shredeh,909S.W.2d833,835(Tenn.Crim.App.1995)(quotingBlackv.State,290S.W.20,21(Tenn.1927)). Theauthoritytorelievesuretiesonabondshouldbeexercisedonlyinextremecases,suchasthedeathofthedefendantorsomeotherconditionmakingitimpossibleforthesuretiestosurrenderthedefendant.Statev.Frankgos,85S.W.79,81(Tenn.1905);Statev.LeQuire,672S.W.2d221,222(Tenn.Crim.App.1984).Thegoodfaitheffortsofthesuretyortheexpensesincurredarenotexcuses.Id.Inthiscase,theappellantfailstoshowthatthetrialcourtabuseditsdiscretion. Atthehearingforfullexoneration,FredWeaver,theownerofAABondingCompanytestifiedthatthefailuretoreturnthedefendantbeforefinalforfeiturewasduetoanerrantemployee.HetestifiedthattheemployeeconcealedtheconditionalforfeitureandtheextensionoftimeuntilFebruary,1996.Hetookoverthefileand,fromthattimeforward,diligentlyworkedtolocatethedefendant.However,Weavertestifiedthathewasunawareofthedateforfinalforfeitureuntiltwodaysbeforethehearing.AlthoughthedefendantwaslocatedwithintheStateandreturnedtocustodywithinonedayfollowingthefinalforfeiture,over13monthshadpassedfromentryoftheconditionalforfeiture. Initsruling,thetrialcourtnotedthatitwasunfortunatethatMr.Weaverhadanirresponsibleemployee.However,thetrialcourtstatedthattheresultingsituationwas intolerable,notingthatithadbeenverylenientandgrantedappellantsubstantiallymoretimethanispermittedbystatute. .   ׀Moreover,itstatedthatMr.WeavershouldhavenotifiedthecourtofhisdifficultiesinFebruarytofacilitatethereturnofthedefendantandavoidfinalforfeiture.Nevertheless,thetrialcourtfoundthatappellantwasentitledtosomerelieffortheeventualreturnofthedefendantandreducedthejudgmentbyonehalf.
