Thenoticeofappealisnotjurisdictionalincriminalcases,anditsuntimelyfilingmaybewaived intheinterestofjustice.Tenn.R.App.P.4(a).DefendantwassentencedinDecember1994,andthemotionfornewtrialwasfiledinJanuary1995.ThemotionconvertingthenewtrialrequestintoaTenn.R.Crim.P.35(b)hearingwasnotfiledandhearduntilJune1996,someyearandahalflater.Therecordisunclearastowhythedelaywassolengthy.Weseenoreasontowaivetheuntimelyfilingintheinterestofjustice. We,therefore,willreviewthedenialoftheTenn.R.Crim.P.35(b)requestforareductioninthesentence. '   כ@ RULE35STANDARDOFREVIEW   Tenn.R.Crim.P.35(b)authorizesatrialjudgetoreconsiderapreviouslyimposedsentenceandreduceitifsuchareductionis intheinterestofjustice.Tenn.R.Crim.P.35(b),AdvisoryCommissionComments.IncontrasttothestandardofreviewapplicabletosentencingappealsperfectedunderTenn.CodeAnn.4035401(d),appellatereviewofRule35(b)rulingsisgovernedbythe abuseofdiscretionstandard.Statev.Irick,861S.W.2d375,376(Tenn.Crim.App.1993). Inadditiontothepresentdrugconvictions,defendanthadpriorconvictionsforpossessionofmarijuana,possessionofdrugparaphernaliaandfelonypossessionofmarijuanawithintenttosell.Hewasonprobationforthelatterfelonyoffensewhenhecommittedthedrugparaphernaliaoffense. Defendanthadbeendoingvariousdrugsforovertwenty(20)yearsandconsideredhimselfadrugaddictforatleastfifteen(15)years.Hebegansellingdrugsinthelate1980's.Hisemploymenthistorywassporadic.Hereceivedsignificantfinancialassistancefromhismother.Itisalsoapparentheprofitedgreatlyfromthesaleofdrugsovertheyearseventhoughheusedmuchofthisprofittopurchasedrugsforpersonaluse. ThedefendantconcededthathewouldtraveltoNashvilleapproximatelytwiceaweekandpurchaseapproximatelyfivetosevengramsofcocaineforresale.Althoughthepurchasepriceapproximated$50pergram,defendantsresaleofthecocainewasforapproximately$50perhalfgram.Thetrialcourtfoundthatdefendantwasa professionalcriminaland anoffenderwhoserecordofcriminalactivityisextensive.Tenn.CodeAnn.4035115(b)(1)and(2).Accordingly,thetrialcourtfoundthatrunningtwoofthetenyearsentencesconsecutivelywasappropriate.Weagree.Thetestimonyofthedefendantsupportsthesefindingsofthetrialcourt. Thetrialcourtproperlyconcludedthatthedefendanthadbeensellingdrugsforaminimumofeightyears.Therecordsupportstheneedtoprotectsocietyagainstfurthercriminalconductbythedefendant,andthattheconsecutivesentencesarereasonablyrelatedtotheseverityoftheoffensescommitted.SeeStatev.Wilkerson,905S.W.2d933,939(Tenn.1995). Insummary,wefindnoabuseofdiscretioninthetrialcourtsrefusaltoreducedefendantssentences.
