DistrictAttorneyGeneral303RutherfordCo.JudicialBldg.Murfreesboro,TN37130 OPINIONFILED:򀀀AFFIRMEDJOEG.RILEY,JUDGE  OPINION    Thepetitioner,KimberlySuttonStreet,appealsthedenialofherpetitionforpostconvictionreliefbytheCircuitCourtofRutherfordCounty.Thepetitionercontendsthatthetrialcourtdidnothavejurisdictiontoaltertheconditionsofherappealbond;therefore,thealterationresultedin punishment.Shecontendsthatservingtheoriginalsentenceimposedbythetrialcourtwouldviolateherconstitutionalrightagainstdoublejeopardy.ThejudgmentofthetrialcourtisAFFIRMED.  I.    ThepetitionerwasconvictedbyajuryinRutherfordCountyofpossessionofmarijuana,possessionofvalium,possessionofdrugparaphernalia,anddrivingundertheinfluence,secondoffense.Shewassentencedtoconcurrenttermsofeleven(11)monthsandtwentynine(29)days.Thesentencesweretobeservedonsupervisedprobationafterninety(90)daysservedinconfinement. Thepetitionerfiledamotionfornewtrial,whichwasdenied.ThepetitionerremainedonbondwhilesheappealedtothisCourt.Whiletheappealofpetitionersconvictionswaspending,shewasindictedinSumnerCountyforvariousdrugoffenses.TheDistrictAttorneyGeneralofRutherfordCountyonMay2,1996,filedamotiontorevokethepetitionersbond.AhearingwasheldonMay21,1996,andthetrialcourtissuedanorderamendingtheconditionsofthepetitionersrelease.Thepetitionersbondwasraised$4,000.Shewasalso placedonsupervisedprobation,requiredtoremainfreeofillicitdrugs,orderedtosubmittodrugscreenings,andhadtocomplywitha7:00p.m.curfew.Thepetitioneralsoallegesthe Draconianmeasureofplacinganelectronicmonitoringdevicearoundheranklewasfoisteduponher. ThisCourtsubsequentlyaffirmedthepetitionersconvictions.Statev.KimberlySuttonStreet,C.C.A.No.01C019508CC00257,RutherfordCounty(Tenn.Crim.App.filedSeptember19,1996,atNashville).TheTennesseeSupremeCourtdeniedpermissiontoappealinanorderfiledMarch3,1997. Thepetitionersubsequentlyfiledapetitionforpostconvictionreliefalleging,interalia,thattheincreasedconditionsofherbondconstitutedpunishmentfordoublejeopardypurposes;therefore,shehadalreadyservedhersentence.Thetrialcourtdismissedthepetitionwithoutahearing,andthepetitionerappealed.  II.    Thedefendantallegesthatthetrialcourtsmodificationofherbondwasmadewithoutjurisdictionandconstitutedpunishment,causingherto morethanservetheoriginalsentenceimposedbythetrialcourt.Werespectfullydisagree.  A.   Adefendantmaybeadmittedtobailpendingappealbythetrialcourtwherethejudgmentwasrendered,bythisCourt,orbytheTennesseeSupremeCourt.Tenn.CodeAnn.4011113(a)(1).Anyoftheabovecourts,judgesorjusticesthereof,mayincreaseorreducetheamountofbailrequiredpendingappellatereview.Tenn.CodeAnn.4011113(a)(3).Ifacourtfindsitnecessary,adefendantasaconditionofreleaseonbailmayberequiredtosubmittosupervisedprobationandhavereasonablerestrictionsplacedupoǹheractivities,movements,associationsandresidences.Tenn.CodeAnn.4011116(b)(2),(3). (    Thus,thepetitionerscontentionthatatrialcourtdoesnothavejurisdictiontoalterormodifybailafternoticeofappealiswithoutmerit.Indeed,anapplicationforalterationofbailisoneofthefewinstanceswhereboththetrialandappellatecourtsretainconcurrentjurisdiction.Raybin,TennesseeCriminalPracticeandProcedure,33.104(1985);seealsoTenn.R.App.P.8(a)!."  B.    Wealsorejectthepetitionersargumentthatthealterationofbailconstitutedpunishmentfordoublejeopardypurposes.Tobeputinjeopardy,adefendantmustbe subjecttocriminalprosecutionandputtotrial.UnitedStatesv.Grisanti,4F.3d173,175(2ndCir.1993).Abailrevocationhearingservesaregulatoryfunctionratherthanacriminalfunction.Statev.Pennington,952S.W.2d420,422(Tenn.1997)(citingUnitedStatesv.Grisanti,supra).Regulatoryorremedialpurposesdonotimplicatedoublejeopardy.Id.at42223.  C.    TheactionsofthetrialcourtalteringconditionsofthedefendantsreleasewereappealabletothisCourtinaccordancewithTenn.R.App.P.8(a).SeeTenn.CodeAnn.4011144.Theappropriatenessofthemodificationcouldhavebeenreviewedatthattime.Thepetitionerfailedtoavailherselfofthisopportunity.
