"3"  3%2j  C  .3  0    Analysis:EnhancementFactors3%&݌^ (#(# Ќ    Thedefendantcontendsthatthetrialcourterredbyconsideringanenhancementfactornot *z  setforthinTenn.CodeAnn.4035114.Specifically,thedefendantcontendsthatthetrialcourt ` improperlyconsideredthevideotapeasanenhancementfactor.Areviewofthesentencingrecord F showsthatthetrialcourtmadeseveralcommentsabouttheoffensivenatureofthevideotape,but , doesnotindicatethatthetrialcourtusedthevideotapeasanactualenhancementfactor.Thetrial  courtsimplymadereferencetothevideotapeasitrevealedthehorrifyingnatureandcircumstances  oftheoffenses.Thisissueiswithoutmerit.  "3"  3)2j  D  .3  0    Analysis:LengthofSentence3)*݌Z(#(# Ќ    Thetrialcourtappliedthefollowingenhancementfactors:1)asimilarpriorsexualoffense &v committedin1987;2)thepresentcrimeswerecommittedtogratifythedefendantsdesirefor  \ pleasureorexcitement;and3)thedefendantabusedapositionofprivatetrust.SeeTenn.Code B Ann.4035114(1),(7)and(15).Thedefendantdoesnottakeissuewiththeirapplication;thus, ( thetrialcourtproperlyappliedthreeenhancementfactors.Thetrialcourtgavenoweighttothe  miscellaneousmitigatingfactors.Theweightgiventomitigatingandenhancingfactorsislefttothe  sounddiscretionofthetrialcourt.Statev.Moss,727S.W.2d229,238(Tenn.1986).Weareunable   toconcludethatthetrialcourtabuseditsdiscretioninassessingthemaximum25yearsentencefor p!  eachoffense. V"!   Thedefendantalsocontendsthatthetrialcourtshouldhavestartedatthebottomofthe "$r# sentencingrangeandnotthemiddlewhenitdeterminedthedefendantssentence.Thedefendant %X $ arguesthathepledguiltytocountswhichallegedthecrimeswerecommitted in1994or1995. %>!% Assuch,thedefendantcontendsthatTenn.CodeAnn.4035210asitexistedbeforebeing &$"& amendedonJuly1,1995,controls.SeeTenn.CodeAnn.4035210(c)(1990).Thatstatute ' #' providedthatthepresumptivesentencewastheminimumsentence.Id.Thetrialcourtdidstate, (#( however,that whatever[thestartingpointforsentencingis]...whetheritstartsatthebottomorat )$) themiddle...[thiscaseisacasethat]...goestothetop.Giventhediscretionofthetrialcourtin l*%* determiningtheweighttobeassignedtothemitigatingandenhancementfactors,andthetrialcourts R+&+ recognitionthatthemaximumsentenceswereappropriateifthepresumptivesentencewere15years, 8,', thiscourtdoesnotfindthatthetrialcourterredinimposingthemaximumsentencesallowed.This  issueiswithoutmerit.     CONSECUTIVESENTENCING  H     Thedefendantcontendsthatthetrialcourterredbyimposingconsecutivesentencesonall  d counts.Thetrialcourt,however,foundthedefendantqualifiedforconsecutivesentencingunder  J Tenn.CodeAnn.4035115(b)(5):  0 8  thedefendantisconvictedoftwo(2)ormorestatutoryoffensesinvolvingsexual    abuseofaminorwithconsiderationoftheaggravatingcircumstancesarisingfrom   therelationshipbetweenthedefendantandvictimorvictims,thetimespanof x  defendant'sundetectedsexualactivity,thenatureandscopeofthesexualactsandthe ^  extentoftheresidual,physicalandmentaldamagetothevictimorvictims.D       First,thedefendantarguesthattherearenoaggravatingcircumstancesarisingfromthe ` relationshipbetweenthedefendantandthevictim.Thedefendantwasentrustedwiththecareofthe F victim,whowashiscousin.Insteadofproperlycaringforthechild,heabusedhispositionoftrust , andsubjectedthechildtohorrificsexualabuse.Thisfactorweighsinfavorofconsecutive  sentencing.    Thedefendantalsoarguesthattherewasnoevidenceofthedurationofthedefendants t crimes.Whiletherewasnodefinitiveevidenceindicatingthatthedefendantscrimestookplace Z overaprolongedperiod,therewasanindicationthatthecrimestookplaceonmorethanone @ occasion.Inalettertothejudge,enteredasexhibit2atthesentencinghearing,thedefendantstates &v  Imadethevideotapeinanefforttostopsubjectingthechildtomyabuse.Thefactsstatedatthe  \ guiltypleahearingrelatedtheeventsoccurredin 1994and1995.Thus,therecordsufficiently B establishesthattheabusewasnotanisolatedevent. (   Astothenatureandscopeofthesexualacts,thedefendantcontendsthathedidnotuse  force,coercion,orthreatsintheperpetrationofthecrime.Inreviewingthevideotape,however,one   couldreasonablyconcludethatthechildwasnotawillingvictim.Thesexualactsdepictedonthe p!  videotapearenothingshortofabhorrent.Thisfactorweighsheavilyinfavorofconsecutive V"! sentencing. <#"   Astoresidual,physicalandmentaldamagetothevictim,aclinicaltherapisttestifiedthatthe %>!% victimhasanidentityproblem,wondersifheishomosexual,hastroublesleeping,clingstohis &$"& motherandisunusuallyconcernedaboutthesafetyofhislovedones.Accordingtotheclinical ' #' therapist,theharmfuleffectsofthesexualabusearelikelytobepermanent.Thisfactorweighsin (#( favorofconsecutivesentencing. )$)   Thedecisionofwhetherprisontermsaretobeconsecutiveorconcurrentislefttothesound R+&+ discretionofthetrialcourt.Statev.Adams,973S.W.2d224,23031(Tenn.Crim.App.1997).The 8,', trialcourtfoundthattheTenn.CodeAnn.4035115(b)(5)criteriaforconsecutivesentenceswere  met.Weseenoabuseofdiscretionhere.     CONCLUSION  H   +C    Weconcludethatthetrialcourtdidnoterrinthelengthofthesentencesitimposed,norin  d requiringthethreesentencestorunconsecutively.Thejudgmentofthetrialcourtisaffirmed.
