àThe€appellants,€Kedrick€D.€Taliaferro€and€Fabian€J.€Taliaferro,€appealÏtheir€sentences€of€six€years€for€the€1993€killing€of€Veto€Young.€€€They,€along€withÏKedrickððs€brother,€Ervin€J.€Johnson,€were€indicted€for€first€degree€murder.€€ÌOn€April€28,€1997,€each€appellant€pled€guilty€to€aggravated€assault€pursuant€toÏa€negotiated€plea€agreement,€and€each€received€a€six„year€sentence€as€aÏRange€I,€standard€offender.€€€The€court€sentenced€each€appellant€to€serve€sixÏyears€in€the€local€workhouse.€€€A€hearing€was€held€on€July€17,€1997€toÏdetermine€whether€to€place€the€appellants€on€probation.€€The€trial€court€deniedÏthe€appellantsðð€request€for€probation.€ÌÌà àThe€appellants€present€two€issues€for€our€review€on€appeal:€(1)€whetherÏthe€trial€court€properly€denied€their€petition€for€suspension€of€their€sentences,Ïand€(2)€whether€the€trial€court€erred€by€allowing€the€state€to€ask€FabianÏTaliaferro€who€was€responsible€for€killing€Veto€Young.€€We€affirm€the€judgmentÏof€the€trial€court.ÌÌà àBoth€the€state€and€the€appellant€stipulated€to€the€following€facts.€€On€AprilÏ27,€1993,€a€Memphis€police€officer€was€conducting€a€radar€traffic€unit€near€theÏintersection€of€Winchester€and€Interstate€55,€which€is€an€area€west€ofÏWinchester€and€Millbranch,€in€Shelby€County.€€The€officer€saw€several€personsÏget€out€of€a€car€and€go€into€a€field€on€the€northwest€corner€of€Winchester€andÏMillbranch.€€€The€officer€saw€those€individuals€chase€another€individual€andÏthen€heard€shots.€€He€notified€someone€by€radio€of€the€disturbance,€and€anotherÏofficer€responded€to€the€scene.€€By€the€time€the€other€officer€arrived€on€theÏscene,€Kedrick€Taliaferro€and€Fabian€Taliaferro,€together€with€their€codefendant,ÏErvin€Johnson,€and€Wesley€Springfield,€were€coming€up€from€an€area€to€whereÏtheir€car€was€Ñ€ÑÑ  Ñlocated€on€Winchester.€€Those€thrÔ  ÔÔ  Ôee€men€were€taken€into€custody,Ïand€disarmed.× ƒ' ××  ×€ÌÌà àOfficers€found€Veto€Young€near€a€fence€below€the€street€level.€€He€hadÏbeen€shot€one€time.€€The€three€men€were€advised€of€their€òòMirandaóó€rights.€€AllÏfour€men€gave€statements€to€the€police.€€They€stated€that€on€the€night€before,€aÏrobbery€occurred€at€the€residence€of€one€of€the€four€men,€and€the€man€theyÏwere€chasing€was€the€person€that€they€believed€to€be€responsible.€€When€theÏcrime€scene€unit€arrived,€they€found€a€stocking€mask€near€the€victim,€which€theÏdefense€would€have€posited€was€used€by€the€victim€during€the€perpetration€ofÏthe€robbery€the€night€before.€€Both€appellants€admitted€they€were€armed.€ÍKedrick€Taliaferro€stated€that€he€shot€at€the€victim,€and€Fabian€Taliaferro€statedÏthat€he€had€shot€into€the€ground.ÌÌà àThe€appellant€Kedrick€Taliaferro€argues€that€the€trial€court€erred€inÏdenying€him€probation.€€He€contends€that€there€is€no€evidence€in€the€record€ofÏthe€need€for€deterrence,€so€the€trial€court€erred€by€basing€its€decision€in€part€onÏthis€ground.€€Also,€he€asserts€that€the€trial€court€incorrectly€based€its€decision€toÏdeny€probation€largely€on€the€fact€that€a€death€occurred€in€this€case,€arguingÏthat€this€ð ðwas€the€single€greatest€factor€influencing€[the€courtððs]€decision.ðð€ÏHowever,€he€concedes€that€the€need€to€avoid€depreciating€the€seriousness€ofÏthe€offense€and€measures€less€restrictive€than€confinement€had€recently€beenÏused€were€applicable.ÌÌ€€à àThe€state€insists€that€the€trial€court€properly€denied€probation€for€KedrickÏTaliaferro€ð ðbecause€of€the€facts€of€the€case,€the€defendantððs€prior€criminalÏrecord,€the€fact€that€measures€less€restrictive€than€confinement€have€previouslyÏbeen€unsuccessful€and€probation€would€not€benefit€Kedrick€or€society.ðð€€InÏsupport€of€its€position,€the€state€notes€the€trial€courtððs€concern€about€theÏappellantððs€Ñ€Ñvigilante€justice,€his€prior€drug€conviction,€and€the€fact€that€he€wasÏon€probation€at€the€time€of€the€shooting.Ìà àÌà àAppellant€Fabian€Taliaferro€argues€that€the€trial€court€erred€in€denyingÏhim€probation.€€He€contends€that€he€has€no€prior€criminal€history€and€assertsÏthat€ð ðonly€the€principle€dealing€with€avoiding€the€depreciation€of€the€seriousnessÏof€the€offense€would€have€any€application.ðð€€Furthermore,€with€regard€to€the€trialÍcourtððs€finding€that€Fabian€Taliaferro€was€not€remorseful€for€his€actions,€theÏappellant€insists€that€he€stated€that€he€regretted€that€the€whole€incidentÏoccurred.€€He€contends€that€when€he€answered€the€prosecutorððs€question€aboutÏwho€was€responsible€for€the€killing€of€the€victim,€he€ð ðspoke€figuratively€of€theÏdeceased€as€having€put€in€motion€a€chain€of€events€which€led€to€his€demise.ðð€€ÏThis€appellant€also€notes€four€mitigators€relevant€to€his€sentencing€and€notesÏthat€he€has€served€434€days€in€pretrial€confinement,€which€ð ðamounts€to€moreÏthan€a€sufficient€time€of€confinement€to€avoid€any€notion€of€depreciating€theÏseriousness€of€the€offense.ððÌÌà àThis€appellant€argues€in€the€third€issue€presented€for€our€review€that€theÏtrial€court€erred€by€allowing€the€state€to€ask€him€who€was€responsible€for€killingÏVeto€Young.€€€He€contends€that€the€form€of€the€question€required€a€legalÏconclusion,€not€a€factual€conclusion,€and€therefore,€was€improper.€€He€furtherÏargues€that€all€he€really€stated€ð ðwas€that€it€could€be€looked€at€as€if€Veto€YoungÏbrought€on€his€own€death€by€his€misconduct€in€the€first€place.ððÌÌà àWhen€an€appellant€challenges€the€length,€range,€or€manner€of€service€ofÏa€sentence,€this€Court€conducts€a€òòde€novoóó€review€with€a€presumption€that€theÏdeterminations€made€by€the€trial€court€are€correct.€€Tenn.€Code€Ann.€ðð€40„35„401(d)€(1997).€€However,€this€presumption€is€conditioned€on€an€affirmativeÏindication€in€the€record€that€the€trial€court€considered€the€sentencing€principlesÏand€all€relevant€facts€and€circumstances.€€òòState€v.€Ashbyóó,€823€S.W.2d€166,€169Ï(Tenn.€1991).€€ÌÑ àThe€appellant€bears€the€burden€of€showing€that€the€sentence€wasÏimproper.€€òòId.óó€€€In€determining€whether€the€appellant€has€met€this€burden,€thisÏCourt€must€consider€(a)€the€evidence€adduced€at€trial€and€the€sentencingÏhearing;€(b)€the€presentence€report;€(c)€the€principles€of€sentencing;€(d)€theÏarguments€of€counsel;€(e)€the€nature€and€characteristics€of€the€offense;€and€(f)Ïthe€appellantððs€potential€or€lack€of€potential€for€rehabilitation€or€treatment.€€Tenn.ÏCode€Ann.€ðððð€40„35„103(5),€„210(b)€(1997).ÌÌà à€For€a€defendant€to€be€entitled€to€the€statutory€presumption€that€he€is€aÏfavorable€candidate€for€alternative€sentencing,€three€criteria€must€be€met€underÏTennessee€Code€Annotated€ðððð€40„35„102(5)€and€„102(6)€(1997):€the€defendantÏmust€be€an€especially€mitigated€or€standard€offender;€he€or€she€must€beÏconvicted€of€a€Class€C,€D,€or€E€felony;€and€he€or€she€must€not€fall€within€theÏparameters€of€Tennessee€Code€Annotated€ðð€40„35„102(5),€which€states€that€aÏdefendant€cannot€have€a€criminal€history€that€shows€a€ð ðclear€disregard€for€theÏlaws€and€morals€of€societyðð€or€ð ðfailure€of€past€efforts€at€rehabilitation.ðð€€The€trialÏcourt€found€each€appellant€to€be€a€standard€offender€of€a€Class€C€felony.€€TheÏtrial€court€found€that€Kedrick€Taliaferro€did€not€have€a€significant€prior€criminalÏrecord.€× ƒ( ××  ×€€It€found€that€Fabian€Taliaferro€had€no€prior€criminal€record.€€ÌÌà àBy€providing€evidence€to€the€contrary,€the€state€may€rebut€theÏpresumption€that€the€defendant€is€a€favorable€candidate€for€alternativeÏsentencing.€€Tenn.€Code€Ann.€ðð€40„35„102(6)€(1997).€€Insight€regarding€whatÍconstitutes€ð ðevidence€to€the€contraryðð€is€provided€at€Tennesee€Code€AnnotatedÏðð€40„35„103:ÌÓÓà à(1)€Sentences€involving€confinement€should€be€based€on€the€followingÌà àconsiderations:Ìà àà à(A)€Confinement€is€necessary€to€protect€society€by€restrainingÌà àa€defendant€who€has€a€long€history€of€criminal€conduct;Ìà àà à(B)€Confinement€is€necessary€to€avoid€depreciating€theÌà àseriousness€of€the€offense€or€confinement€is€particularly€suited€toÌà àprovide€an€effective€deterrence€to€others€likely€to€commit€similarÌà àoffenses;€orÌà àà à(C)€Measures€less€restrictive€than€confinement€have€frequentlyÌà àor€recently€been€applied€unsuccessfully€to€the€defendant.ÌÌÓÓòòState€v.€Binghamóó,€910€S.W.2d€448,€454€(Tenn.€Crim.€App.€1995)€(citing€òòState€v.óóÏòòAshbyóó,€823€S.W.2d€166,€169€(Tenn.€1991)).€€However,€the€court,€in€its€oral€andÏdetailed€written€findings€of€fact€and€conclusions€of€law,€did€find€that€confinementÏwas€necessary€to€avoid€depreciating€the€seriousness€of€the€offense€and€toÏprovide€an€effective€deterrence€to€others€likely€to€commit€similar€offenses.€€Tenn.ÏCode€Ann.€ðð€40„35„103(1)(B)€(1997).€€ÌÌà àFor€a€trial€court€to€deny€an€alternative€sentence€based€on€theÏseriousness€of€the€offense,€the€circumstances€of€the€offense€ð ðððmust€beÏespecially€violent,€horrifying,€shocking,€reprehensible,€offensive,€or€otherwise€ofÏan€excessive€or€exaggerated€degree,ðð€and€the€nature€of€the€offense€mustÏoutweigh€all€factors€favoring€a€sentence€other€than€confinement.ðð€€òòBinghamóó,€910ÏS.W.2d€at€454€(quoting€òòState€v.€Hartleyóó,€818€S.W.2d€370,€374„75€(Tenn.€Crim.ÏApp.€1991)).€€The€occurrence€of€a€death€cannot€alone€constitute€sufficientÏevidence€to€the€contrary€under€Tennessee€Code€Annotated€ðð€40„35„102(6).€€òòId.óóÏat€455.€€The€trial€courtððs€denial€of€an€alternative€sentence€based€on€theÏseriousness€of€the€offense€under€Tennessee€Code€Annotated€ðð€40„35„103(1)(B)€(1997)€can€only€be€upheld€if€the€òòHartleyóó€conditions€are€in€the€record.€€ÌÌà àThe€circumstances€of€the€offense€in€the€case€òòsub€judiceóó€indicate€that€theÏappellants€had€not€one€but€several€opportunities€to€call€the€police:€after€theÏrobbery€at€the€apartment,€after€the€shooting€of€their€car€later€the€same€night€ofÏthe€robbery,€and€most€significantly,€the€day€of€the€shooting€when€there€was€aÏpolice€officer€in€the€vicinity€of€the€location€that€the€appellants€saw€the€victim.€ÏHowever,€the€appellants,€along€with€their€codefendant€Ervin€Johnson,€decidedÏto€take€the€law€into€their€own€hands€and€exercise€vigilante€justice.€€We€agreeÏwith€the€trial€court€that€the€circumstances€of€the€offense€in€this€case€areÏreprehensible€and€shocking,€thus€meeting€the€òòHartleyóó€conditions.€€Ì€Ìà àThe€trial€court€also€denied€alternative€sentencing€based€on€deterrence.€ÏHowever,€the€record€must€contain€some€evidence€that€the€sentence€imposedÏwill€have€a€deterrent€effect€within€the€jurisdiction€before€a€trial€court€can€denyÏalternative€sentencing€based€on€this€ground.€€òòState€v.€Bonestelóó,€871€S.W.2dÏ163,€169€(Tenn.€Crim.€App.€1993).€ÌÌà àThe€trial€court€stated€that€these€appellants€should€be€denied€probation€inÏpart€based€on€the€deterrent€effect€such€a€decision€would€provide.€€The€courtÏnoted€that€individuals€cannot€be€permitted€to€engage€in€lawless€behavior€andÏthen€be€granted€probation.€€Specifically,€the€court€stated€in€its€written€findingsÏthat€ð ðconfinement€is€particularly€suited€to€provide€an€effective€deterrence€toÏothers€likely€to€forgo€reporting,€such€offenses€to€proper€authorities€and€seek€outÏsuspects€and€use€deadly€weapons€to€rectify€their€grievances.ðð€€We€agree.Ìà àÌà àTennessee€Code€Annotated€ðð€40„35„103(5)€(1997)€provides€theÏð ðpotential€or€lack€of€potential€for€the€rehabilitation€or€treatment€of€the€defendantÏshould€be€considered€in€determining€the€sentence€alternative€or€length€of€aÏterm€to€be€imposed.ðð€€€€Furthermore,€a€defendantððs€failure€to€acceptÏresponsibility€for€his€crimes€is€relevant€to€his€rehabilitation€potential.€€òòState€v.ÏZeoliaóó,€928€S.W.2d€457€(Tenn.€Crim.€App.€1996).Ìà àÌà àAppellant€Fabian€Taliaferro€contends€that€the€trial€court€erred€by€allowingÏthe€state€to€ask€him€who€was€responsible€for€the€killing€of€Veto€Young.€€In€hisÏresponse,€this€appellant,€in€essence,€stated€that€the€victim€was€responsible€forÏhis€own€death.€€Although€this€appellant€at€the€probation€hearing€made€a€generalÏstatement€of€remorse€for€what€happened,€his€statement€that€the€victim€wasÏresponsible€for€his€own€death€clearly€illustrates€his€failure€to€take€responsibilityÏfor€his€conduct.€€This€issue€is€without€merit.ÌÌà
