Appellantarguesthatthetrialcourtimproperlydismissedhispetitionforpostconvictionreliefasbeingoutsidethestatuteoflimitationsperiod.Appellantwasconvictedin1991;hedidnotfileforpostconvictionreliefuntil1996.Atthetimepetitionerpledguilty,hehadthreeyearsinwhichtofileapetitionforpostconvictionrelief.Hefailedtodoso.In1995,thelegislaturerepealedtheformerPostConvictionProcedureAct;thenewact,whichgovernsthispetition,replacedthethreeyearstatuteoflimitationswithaoneyearstatute.Tenn.Code.Ann.4930201CompilersNotes;Tenn.CodeAnn.4030202.Thus,PetitionerhaduntilMay10,1996tofilehispetitionforrelief.HispetitionfiledJuly1,1996,wasnottimelyfiled.UnderTennesseeCodeAnnotated4030202(a),Courtshavejurisdictiontoconsiderlatepetitionsonlyiftheclaimisbasedonapreviouslyunrecognizedconstitutionalright,newscientificevidenceestablishesthepetitionersinnocence,orthesentencewasenhancedbecauseofaperviousconvictionwhichwassubsequentlyinvalidated.Appellantspetitiondoesnotfallintoanyofthesecategories.Thusthepetitionforpostconvictionreliefwasproperlydismissed.
