OnSeptember12,1997,thepetitionerfiledhissecondpetitionforpostconvictionrelief.Findingthatthepetitiondid notstateanygroundorclaimuponwhichreliefmayorshouldbegranted,thetrialcourtdismissedthepetitionwithoutappointmentofcounseloranevidentiaryhearing.  T.C.A.4030202(c)providesthatnomorethanonepetitionforpostconvictionreliefmaybefiledattackingasinglejudgment,andmandatesthatthetrialcourtshallsummarilydismissanysecondorsubsequentpetitionifapriorpetitionwasfiledandresolvedonthemeritsbyacourtofcompetentjurisdiction.SincethepetitionerpreviouslyfiledapetitionthatwasresolvedonthemeritsbythetrialcourtandbythisCourtonappeal,thepetitioner'spresentpetitionwasproperlydismissed.Additionally,afterreviewingtheentirerecordonappeal,wefindthatthepetitionersclaimdoesnotfallwithinoneofthelimitedcircumstancesunderwhichapriorpetitionmaybereopened.SeeT.C.A.4030217.
