` 2)whetherthetrialcourterredinrefusingtoinformthejurythattheappropriaterangeofpunishmentforAppellantwasasacareeroffender; ` 3)whetherthetrialcourterredinorderingAppellantssentencestorunconsecutivetohispriorsentences.R ` Afterareviewoftherecord,weaffirmthejudgmentofthetrialcourt. @II,FACTS  +T"#  ` OnJanuary12,1995,CarlaSueRichardsreturnedtoherMarshallCountyhometofindthatsomeonehadbrokenintoherhome.Thebackdoorwasajarandtwisted,withafootprintonthedoor.Shewentintothehouseandcalledaneighbor,herhusband,andlawenforcement.Itwasdiscoveredthatatelevision,tworifles,ashotgun,andjewelryweremissingfromthehouse.LawenforcementpersonnelputtheserialnumberfromthestolentelevisionintheNationalCrime T9/1 InformationCentercomputer.Twoweekslater,MetroDavidsoncountypoliceadvisedaMarshallCountydetectivethattheRichardstelevisionhadbeenpawnedinNashvillebyTammyTaylor,Appellantswife.Ms.Taylorwasarrested,triedandacquittedfortheburglaryandtheftoftheRichardsproperty.DuringthecourseofinvestigatingMs.Taylor,lawenforcementofficialstookaninculpatorystatementfromAppellantinwhichAppellantstatedthatheenteredtheRichardshouseandstolethetelevision,guns,andjewelry. @I.SUFFICIENCYOFTHEEVIDENCE    ` Appellantchallengesthejurysverdictallegingthattheevidenceintroducedattrialwasinsufficientforarationaltrieroffacttodeterminebeyondareasonabledoubtthathecommittedthetheftandburglary.Appellantcontendsthattherewasnophysicalevidencetolinkhimtothecrime,andthatindeedtheonlyevidenceagainsthimwerethemultiplestatementshemadetothepolice,whichhenowcontendswereuntrustworthy.Whenanappellantchallengesthesufficiencyoftheevidence,thisCourtisobligedtoreviewthatchallengeaccordingtocertainwellsettledprinciples.Averdictofguiltybythejury,approvedbythetrialjudge,accreditsthetestimonyoftheStateswitnessesandresolvesallconflictsinthetestimonyinfavoroftheState.Statev.Cazes,875S.W.2d253,259(Tenn. @.$& 1994);Statev.Harris,839S.W.2d54,75(Tenn.1992).Althoughanaccusedis 00&( originallycloakedwithapresumptionofinnocence,ajuryverdictremovesthispresumptionandreplacesitwithoneofguilt.Statev.Tuggle,639S.W.2d913, 4*, 914(Tenn.1982).Hence,onappeal,theburdenofproofrestswithAppellanttodemonstratetheinsufficiencyoftheconvictingevidence.Id.Onappeal, the 7.0 [S]tateisentitledtothestrongestlegitimateviewoftheevidenceaswellasall 902 reasonableandlegitimateinferencesthatmaybedrawntherefrom.Id.(citing `  Statev.Cabbage,571S.W.2d832,835(Tenn.1978)).Wherethesufficiencyof P  theevidenceiscontestedonappeal,therelevantquestionforthereviewingcourtiswhetheranyrationaltrieroffactcouldhavefoundtheaccusedguiltyofeveryelementoftheoffensebeyondareasonabledoubt.Harris,839S.W.2d54,75;   Jacksonv.Virginia,443U.S.307,319,99S.Ct.2781,2789,61L.Ed.2d560   (1979).Inconductingourevaluationoftheconvictingevidence,thisCourtisprecludedfromreweighingorreconsideringtheevidence.Statev.Morgan,929   S.W.2d380,383(Tenn.Crim.App.1996);Statev.Mathews,805S.W.2d776,  779(Tenn.Crim.App.1990).Moreover,thisCourtmaynotsubstituteitsowninferences forthosedrawnbythetrieroffactfromcircumstantialevidence.Id. ` at779.Finally,theTennesseeRulesofAppellateProcedure,Rule13(e)provides, findingsofguiltincriminalactionswhetherbythetrialcourtorjuryshallbesetasideiftheevidenceisinsufficienttosupportthefindingsbythetrieroffactbeyondareasonabledoubt.SeealsoStatev.Mathews,805S.W.2dat $  780. ` Inthemattersubjudice,statementsbyAppellantconfessingtothe P* " commissionofthesecrimeswereintroducedattrial.ThecorpusdelictiofthecrimewasmorethanamplyestablishedindependentlyofAppellantsconfession.See,Statev.Ervin,731S.W.2d70,72(Tenn.Crim.App.1987).Theweightand  0&( credibilityoftheevidencepresentedaremattersentrustedsolelytothejuryasthetriersoffact.Statev.Sheffield,676S.W.2d542(Tenn.1984);Byrgev.State, 4*, 575S.W.2d292(Tenn.Crim.App.1978).ThisCourtmaynotreweighevidence.BecausesufficientevidencewaspresentedattrialuponwhicharationaljurycoulddeterminethatAppellantcommittedthecrimes,thisissueiswithoutmerit. 9p02 Ї   II.JURYCHARGE  `  % ` TheStatefiledanoticethatitwouldatsentencingseektohaveAppellantdeclaredacareeroffender.Appellantagreedthathewasacareeroffender.AppellantarguesthatthetrialcourterredinrefusingtoinstructthejurythatAppellantwouldhavetoserveasacareeroffenderifconvictedofthechargesagainsthim.AppellantrequestedtheinstructionunderTennesseeCodeAnnotated4035201,butuponthetrialcourtsrulingthat,ifthecourtinstructedthejuryastopunishment,thecourtwouldusetheentirespectrumofpunishmentfrommitigatedoffenderstocareeroffenders,Appellantwithdrewthemotionrequestingthejuryinstruction. ` InStatev.Cook,theStatefailedtonotifythedefendantofintenttoseek  P enhancedpunishment.Thedefendantfiledamotiontostrikethenotice,whichwasgranted.TheStatethenappealedtheapplicationofRangeIpunishmenttothedefendant.TheCourtofCriminalAppealsreversedthetrialcourtssentenceandorderedresentencingunderRangeII.Bystatutethedefendantifconvictedoftheaggravatedrapeandaggravatedsexualbatterychargesagainsthim,wasadjudgedconsideredanautomaticRangeIIoffender.Thedefendantthenappealed,arguingthathehadastatutoryrighttoajuryinstructionregardingtheactualrangeofpunishmenttowhichhewassubject.TheStatearguedthatthedefendanthadwaivedthatrightbyfilingthemotiontostrike.InupholdingthedefendantsrighttotherequestedRangeIIjuryinstruction,theSupremeCourtofTennesseeheldthat whateverrightsorbenefitstheLegislaturehadinmindforthedefendantwhenitpassedT[ennessee]C[ode]A[nnotated]4035201(b)wouldbelostifthedefendantweretobesentencedtopunishmentsgreaterthan 902 whatthejuryfindingguiltwasinstructedwouldbeimposed.Statev.Cook,816 `  S.W.2d322(Tenn.1991).TheCourtwentontoholdthat whereadefendantwantshistrialjurytoknowtherangeofpossiblepunishmentsresultingfromconvictionsthatheisentitledtohavethatinformationconveyedtothejury.Todeny...thatstatutoryrightconstitutesprejudicetothejudicialprocess,renderingtheerrorreversibleunderRule36(b)T[ennessee]R[ules]A[ppellate]P[rocedure].Statev.Cook,816S.W.2dat327.Thesituationintheinstantcase   issomewhatanalogous,howeverimportantdistinctionsinthiscaseandCook   warrantadifferentresultinthecasesubjudice.UnlikeCooktheAppellantin  theinstantcasewasnotsubjecttotheincreasedpunishmentasamatteroflaw.Rather,afindingwouldhavetobemadeatthesentencinghearingthathewas,infact,acareeroffender.AlthoughtheAppellantofferedtostipulatehewasacareeroffender,nosuchstipulationwaseveractuallyentered,andAppellantneveragreedtoforeverforegoanycontentionthathewasnotacareeroffender.Finally,Appellantactuallywithdrewhisrequestthatthejurybeinstructedthathewasacareeroffender. #  1      Underthesecircumstanceswecannotsayitwaserror p& forthetrialcourttorefusetoinstructthejuryonlyastopunishmentforcareeroffendersconvictedofaggravatedburglaryandtheftofpropertyvaluedover$1,000.   @ 3@**! However,thepresumptionofcorrectnesswhichaccompaniesthetrialcourt'sactionisconditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991).Inconductingourreview,we   mustconsideralltheevidence,thepresentencereport,thesentencingprinciples,theenhancingandmitigatingfactors,argumentsofcounsel,theappellantsstatements,thenatureandcharacteroftheoffense,andtheappellantspotentialforrehabilitation.Tenn.CodeAnn.40-35-103(5),-210(b)(1997&Supp.1998);Ashby,823S.W.2dat169.
