OnJuly11,1996,theDefendantwasconvicteduponhispleasofguiltytoonecountofsellinglessthanonehalfgramofcocaineandonecountoffelonyescape. .   כHewassentencedtoconsecutivetermsoffiveyearsandoneyeartobeservedonprobationwiththeCommunityAlternativetoPrisonϜProgram(CAPP),acommunitybasedalternativetoincarceration. /   ׀OnAugust22,1996,awarrantwasfiledallegingthattheDefendanthadviolatedthetermsofhisprobationinseveralrespects.Followinganevidentiaryhearing,thetrialcourtdeterminedthattheDefendantwasinviolationoftheconditionsofhisϜCAPPsentence,andorderedthattheremainderofhiseffectivesixyearsentencebeservedintheDepartmentofCorrection.ItisfromthisorderofthetrialcourtthattheDefendantappeals. Boththegrantinganddenialofprobationrestinthesounddiscretionofthetrialjudge.Statev.Mitchell,810S.W.2d733,735(Tenn.Crim.App.1991).Moreover,thetrialjudgehasthediscretionaryauthoritytorevokeprobationifapreponderanceoftheevidenceestablishesthatadefendantviolatedtheconditionsofhisprobation.Thetrialjudgemust,however,adducesufficientevidenceduringtheprobationrevocationhearingtoallowhimtomakeanintelligentdecision.Id.Thedeterminationmadebythetrialcourt,ifmadewithconscientiousjudgment,isgiventheweightofajuryverdictandentitledtoaffirmance.Stampsv.State,614S.W.2d71,73(Tenn.Crim.App.1980).̀ Whenaprobationrevocationischallenged,theappellatecourtshavealimitedscopeofreview.Foranappellatecourttobewarrantedinfindingatrialjudgeerredindeterminingthataviolationhasoccurred,itmustbeestablishedthattherecordcontainsnosubstantialevidencetosupporttheconclusionofthetrialjudge.Statev.Harkins,811S.W.2d79,82(Tenn.1991).Iftheviolationissosupportedbytherecord,thejudgmentofthetrialcourtrevokingprobationwillnotbedisturbedonappealunlessitappearsthatthetrialcourtactedarbitrarilyorotherwiseabuseditsdiscretion.Statev.Williamson,619S.W.2d145,146(Tenn.Crim.App.1981).  TestimonyestablishedthatoneoftheconditionsoftheDefendantsreleaseintothecommunitywasthatheresideatahalfwayhouseknownastheHomeHalfwayHouseinKnoxCounty.TheDefendantmovedintothehalfwayhouseasdirected,butafterapproximatelytwoweeks,hemovedoutandthereaftermadenoefforttocomplywithanyofthetermsofhiscommunitybasedsentence.Effortstocontacthimwereunsuccessful. TheDefendanttestifiedatthehearing.Heapologizedtothecourt fornotkeepingmyendofthedealwhileonprobation.TheDefendantapparentlyhasAIDS.Hetestifiedthathehadbeendespondentanddepressedbecauseofhisillnessandhisfamilysreactiontohisillness.Hestatedthatitwasthestressfromhisconditionthatcausedhimtofailtocomplywiththeconditionsofhissentence.Hepromisedthatifheweregivenanotherchancehewouldcomplywiththeconditionsofhisrelease.Oncrossexamination,heϜacknowledgedthathehadpreviouslybeenonbothprobationandparoleandhadviolatedthetermsofhisreleaseonthoseoccasionsalso.Heacknowledgedthathehadleftthehalfwayhouseafteronlyabouttwoweeks,andthathefailedtocontactanyonewiththeprogramfurtherbecausehewas depressedandfrustrated. Attheconclusionofthehearing,thetrialjudgestatedasfollows:8  Itsounds,Mr.Taylor,asthoughtherehavebeensomecertainlyunpleasanttimesinyourlife,andIIhaveacertainamountofcompassionforyoursituation.However,Mr.Taylor,theretherecomesatimewhen,youknow,thisCourtisleftwithnochoice.8  Now,themostrecenthistoryinthiscaseisthatthatyouwereonprobation.Werevokedthatprobation,hadCAPPtakealookatyou,andsentencedyoutoservethissentenceontheCAPPprogramwiththeconditionthatyouresideinandremainingoodstandingattheHomeHalfwayHouseuponConnecticutAvenue.ThatwasonJuly11thofthispastthissixmonthsago.AndIveItoldyouthen,andIwroteitdown,thatifyougetkickedoutofthehouseoryoufailedtoreporttoCAPPthatImnotgoingtohaveanychoicebuttorevokeyou.Andasweveheardherenowtoday,itwasnttheendofthemonthbeforeyouhadviolatedbothofthosedirectorders.And,youknow,basedonthat,basedonwhatItoldyouthen,andbasedonyourrecord,Idonthaveanychoice. WeconcludethatthisrecordcontainssubstantialevidencetosupportthefindingofthetrialjudgethattheDefendantviolatedtheconditionsofhisϜcommunitybasedalternativesentence.WecannotconcludethatthetrialjudgeabusedhisdiscretionwhenherevokedtheDefendantsCAPPsentenceandorderedhissentenceservedintheDepartmentofCorrection.Webelievetherecorddemonstratesthatthetrialjudgemadeaconscientiousandintelligentdecision.
