Ðthat€he€and€Deputy€Chad€Ô_ÔPartinÔ_Ô,€on€September€25,€1998,€were€looking€for€Alfred€Honea.€€Honea€hadÐ Ü, Ðescaped€from€a€mental€institution.€€Chief€Richardson€stated€that€he€had€received€information€thatÐ Â ÐHonea€was€seen€in€the€defendantððs€vehicle.€€Chief€Richardson€testified€that€he€saw€the€defendantÐ ¨ø Ðdriving€his€car€on€J.D.€Neal€Road,€near€the€pumping€station.€€Chief€Richardson€stopped€theÐ ŽÞ Ðdefendantððs€car,€at€which€time€Honea€got€out€of€the€vehicle€and€ran€down€the€road,€pursued€byÐ tÄ ÐDeputy€Partin.€€Chief€Richardson€secured€the€defendant.€€He€noticed€that€the€defendant€smelled€ofÐ Zª Ðan€alcoholic€beverage€(beer),€had€slurred€speech,€red€eyes,€and€was€unsteady€on€his€feet.€€ChiefÐ @ ÐRichardson€charged€the€defendant€with€DUI,€third€offense,€violation€of€registration,€driving€on€aÐ &v Ðrevoked€license,€and€aiding€a€fugitive.€€Chief€Richardson€found€in€the€Ô_Ôcar,Ô_Ô€two€large€dogs€and€threeÐ  \ Ðor€four€cold€beers.€€One€beer€had€spilledÔ#†Xg¼XXXg¼Œ#ÔÔ‡Xg¼XXXg¼Ô€on€the€passengerððs€side€and€Ô_Ôwas€stillÔ_Ô€about€half€Ô_ÔfullÔ#†Xg¼XXXg¼¶#ÔÔ‡Xg¼XXXg¼Ô,Ô_Ô€andÐ òB Ðthere€was€an€empty€bottle€in€the€driverððs€vicinity.€€Also,€in€the€rear€seat€were€four€or€five€empty€beerÐ Ø( Ðcans.€€Chief€Richardson€testified€that€in€his€seventeen€Ô_Ô(17)€yearsÔ_Ô€of€experience,€he€has€Ô_Ôdealt€withÔ_ÔÐ ¾ Ðmany€persons€who€were€intoxicated.€€Based€upon€his€experience,€training,€and€knowledge,€ChiefÐ ¤ô ÐRichardson€was€of€the€opinion€that€the€defendant€was€moderately€intoxicated,€was€Ô_ÔnotÔ_Ô€falling€downÐ Š Ú Ðdrunk,€and€that€the€defendant€had€too€much€to€drink€and€drive.€Ð p!À  Ðà  àÌÒe°Òà  àÔ_ÔDuringÔ_Ô€cross„examination,€Chief€Richardson€agreed€that€he€and€the€other€deputies€were€at€theÐ <#Œ" Ðscene€for€many€hours,€mainly€looking€for€Honea.€€He€spent€about€five€Ô_Ô(5)€toÔ_Ô€ten€(10)€minutes€withÐ "$r# Ðthe€defendant.€€As€to€the€two€open€beer€bottles€in€the€car,€Chief€Richardson€could€not€say€who€drankÐ %X $ Ðwhich€or€any€of€them.€€Chief€Richardson€could€not€say€what,€if€any€of€the€defendantððs€driving€wasÐ î%>!% Ðerratic,€in€that€he€stopped€him€quickly.€€Chief€Richardson€admitted€that€he€did€not€put€in€his€reportÐ Ô&$"& Ðabout€the€empty€beer€cans€on€the€rear€seat,€or€that€the€defendantððs€speech€was€slurred.€€ChiefÐ º' #' ÐRichardson€could€not€say€how€long€the€empty€beer€cans€had€been€in€the€car.€€Chief€RichardsonÐ Ðoffer€the€defendant€any€field€sobriety€tests.€€Ordinarily,€Chief€Richardson€gives€at€least€three€fieldÐ l*¼%* Ðâ –æ Ðâ âÌà  àChad€Partin,€Ô_Ôa€CoffeeÔ_Ô€County€Ô_ÔSheriff'sÔ_Ô€Deputy,€testified€that€he€and€Chief€Richardson€wereÐ b² Ðlooking€for€a€man,€Alfred€Honea,€on€September€25,€1998.€€Deputy€Partin€stated€that€he€saw€HoneaÐ H˜ Ðin€a€vehicle€driven€by€the€defendant€on€J.D.€Neal€Road.€€Deputy€Partin€testified€that€when€the€carÐ . ~ Ðstopped,€he€chased€Honea€and€did€not€have€anything€to€do€with€the€defendant.€Ð  d ÐÌà  àWilliam€Marcom,€an€investigator€for€the€Coffee€County€Sheriff's€Department,€testified€thatÐ à 0 Ðhe€responded€to€an€assist€call€to€apprehend€Honea.€€He€stated€Ô_Ôthat€asÔ_Ô€he€got€to€the€scene,€a€subjectÐ Æ   Ðfrom€the€back€seat€of€a€patrol€car€hollered€at€him.€€Marcom€did€not€know€the€defendant€and€whenÐ ¬ ü  ÐMarcom€opened€the€Ô_Ôdriver'sÔ_Ô€door€of€the€patrol€car,€the€subject€asked€him€about€some€dogs€that€wereÐ ’â  Ðin€the€car.€Ô_ÔÔ_Ô€Marcom€testified€that€he€could€smell€a€strong€odor€of€an€alcoholic€beverage€coming€fromÐ xÈ  Ðthe€patrol€car.€€He€noticed€Ô_Ôthat€theÔ_Ô€Ô_Ôdefendant's€speechÔ_Ô€was€slurred.€€It€was€fairly€warm€that€evening,Ð ^®  Ðsweaty,€and€the€subject€appeared€to€be€Ô_ÔdrunkÔ_ÔÔ_Ô.Ô_Ô€€It€appeared€to€Marcom€that€the€defendant€was€heavilyÐ D” ÐÔ_ÔÐ  <#Œ" ÐÔ_ÔÔ_ÔÔ_ÔÓ  Óò òSENTENCING€HEARINGÐ ° ÐÌó óÓ  Óà  àIn€this€issue,€the€defendant€complains€that€the€trial€courtððs€sentence€of€nine€(9)€months€for€aÐ |Ì Ðthird€offense€of€driving€under€the€influence€conviction€was€excessive.€€Further,€the€defendant€wouldÐ b² Ðassert€that€the€trial€courtððs€acquittal€of€him€on€aiding€Ô_ÔaÔ_Ô€fugitive€influenced€the€trial€court's€decisionÐ H˜ Ðto€double€and€then€some€the€minimum€sentence€for€a€third€offense€of€driving€under€the€influenceÐ . ~ Ðconviction.€€The€State€asserts€that€the€defendant€had€two€prior€convictions€for€driving€under€theÐ  d Ðinfluence€of€an€intoxicant€and€failed€to€be€interviewed€by€the€pre„sentence€officer,€thus€the€recordÐ ú J Ðfully€supports€the€trial€courtððs€judgment.€Ð à 0 ÐÌà  àMs.€Laura€Prosser,€Pre„Sentence€Officer€for€the€Department€of€Correction,€testified€that€sheÐ ¬ ü  Ðprepared€an€abbreviated€pre„sentence€report€on€the€defendant.€€The€pre„sentence€report€was€markedÐ ’â  Ðas€an€exhibit€to€her€testimony.€€Ms.€Prosser€stated€that€the€defendant€was€convicted€of€driving€underÐ xÈ  Ðthe€influence€on€December€12,€1991,€sentenced€to€eleven€(11)€months€and€twenty„nine€(29)€daysÐ ^®  Ðsuspended€after€the€service€of€forty„eight€(48)€hours,€two€hundred€and€fifty€dollars€($250)Ô#†Xg¼XXXg¼¿'#ÔÔ‡Xg¼XXXg¼Ô€fine,€andÐ D”  Ðcosts.€€The€defendantððs€license€was€revoked€for€one€year.€€The€defendant€was€convicted€on€July€3,Ð *z  Ð1991,€for€public€intoxication€when€he€forfeited€a€cash€bond.€€On€September€2,€1982,€the€defendantÐ ` Ðwas€convicted€of€DUI,€sentenced€to€six€(6)€months€suspended€after€service€of€forty„eight€(48)€hoursÐ öF Ðand€a€fifty€Ô_ÔdollarsÔ_Ô€($50)€fine€and€costs.€€Ms.€Prosser€testified€that€she€attempted€to€interview€theÐ Ü, Ðdefendant€but€he€failed€to€appear€after€notification€was€sent€to€him€and€his€attorney.€€The€defendantÐ Â Ðdid€not€testify€at€this€sentencing€hearing.€Ð ¨ø ÐÌà  àThe€record€reflects€the€trial€court€was€Ô_ÔcognizantÔ_Ô€that€when€a€defendant€is€convicted€of€a€non„Ð tÄ Ðviolent€crime,€he€is€if€at€all€possible€to€be€sentenced€to€punishment€other€than€incarceration.€€The€trialÐ Zª Ðcourt€found€no€mitigating€factors,€but€found€some€enhancing€factors.€€In€light€of€the€defendantððs€priorÐ @ Ðconvictions€for€DUI,€the€trial€court€affirmatively€found€that€confinement€Ô_ÔÔ_ÔÔ_ÔÔ_ÔÔ_ÔisÔ_Ô€absolutely€necessary€toÐ &v Ðavoid€depreciating€the€seriousness€of€the€offense€and€confinement€is€particularly€suited€to€provide€anÐ  \ Ðeffective€deterrent€to€others€prone€to€commit€this€type€of€offense.€€The€trial€court€commented,€ð ðI€feelÐ òB Ðit€is€my€duty€as€a€trial€judge€when€people€have€multiple€offense€DUIððs,€if€I€canððt€do€anything€else,€IÐ Ø( Ðcan€keep€them€off€the€road€where€they€donððt€run€over€someone€else€in€that€condition.ðð€€The€trial€courtÐ ¾ Ðimposed€a€Ô_Ôone€thousand€fiveÔ_Ô€hundred€Ô_ÔdollarsÔ_Ô€Ô_Ô($1,500)Ô_Ô€fine,€an€eleven€(11)€Ô_ÔmonthÔ_Ô€and€twenty„nineÐ ¤ô Ð(29)€Ô_ÔdayÔ_Ô€sentence,€and€required€the€defendant€to€serve€nine€(9)€months.€€The€defendant€would€serveÐ Š Ú Ðthe€balance€of€his€sentence€on€probation.€€The€judgment€order€reflects€that€the€defendant€shall€serveÐ p!À  Ðthis€sentence€at€75€percent€minimum€service€prior€to€program€or€work€release,€which€this€CourtÐ V"¦!
