àThe€defendant,€Gary€Eugene€Teeple,€appeals€as€of€right€from€hisÏconvictions€for€two€counts€of€assault,€Class€A€and€B€misdemeanors,€respectively,€in€aÏjury€trial.€€The€trial€court€sentenced€the€defendant€to€concurrent€sentences€in€the€countyÏjail€for€a€term€of€eleven€months€and€twenty„nine€days€for€the€Class€A€misdemeanorÏassault€and€a€term€of€six€months€for€the€Class€B€misdemeanor€assault.€€Although€theÏcourt€provided€that€the€defendant€would€be€immediately€eligible€for€existing€programs,€itÏordered€that€he€serve€thirty€percent€of€his€sentences€before€full€release.€€On€appeal,€theÏdefendant€challenges€the€sufficiency€of€the€evidence€and€the€denial€of€full€probation.€ÏWe€affirm€the€trial€courtððs€judgments€of€conviction.ÌÌà ¸ àLarry€Kauker,€a€former€police€officer€with€the€Alcoa€Police€Department,Ïtestified€that€he€and€Officer€Hubert€Holden€responded€to€a€911€call€reporting€a€domesticÏviolence€complaint.€€He€said€that€they€drove€to€Lakeview€Terrace€Mobile€Home€ParkÏand€a€woman€directed€them€to€a€trailer.€€He€said€that€Lieutenant€Ronnie€Sellers€andÏseveral€other€officers€arrived.€€Officer€Kauker€testified€that€he€and€Officer€HoldenÏentered€the€trailer€and€saw€Cynthia€Jenkins,€one€of€the€assault€victims.€€Officer€KaukerÏtestified€that€Ms.€Jenkins€was€distraught,€upset€and€crying.€€He€testified€that€he€did€notÏknow€whether€the€victim€was€intoxicated,€but€he€did€not€see€any€signs€that€she€hadÏbeen€drinking€or€was€intoxicated.€€He€said€that€Ms.€Jenkins€had€blood€on€her€face€andÏthat€her€face€appeared€to€be€injured.€€He€stated€that€another€woman€in€the€trailer€toldÏhim€what€happened.€€ÌÌà ÐLieutenant€Sellers€talked€to€the€defendant,€and€that€Lieutenant€Sellers€then€instructedÏOfficer€Kauker€to€arrest€the€defendant€for€domestic€violence.€€Officer€Kauker€testifiedÏthat€the€defendant€did€not€appear€to€be€injured.€€He€stated€that€he€could€not€rememberÏwhether€the€defendant€was€drunk.€€He€said€that€he€did€not€have€any€problemsÏhandcuffing€the€defendant€and€placing€him€in€the€back€of€the€cruiser.€€ÌÌà ¸ àOfficer€Kauker€testified€that€they€then€learned€that€the€Blount€CountyÏSheriffððs€Department€had€jurisdiction€over€the€crime.€€He€said€that€the€defendant€wasÏremoved€from€his€cruiser,€and€he€and€Officer€Holden€stood€behind€the€defendant€andÏremoved€his€handcuffs.€€Officer€Kauker€testified€Lieutenant€Sellers€was€standingÏapproximately€an€armððs€length€in€front€of€the€defendant.€€He€said€that€the€defendantÏthen€shouted€at€Lieutenant€Sellers€that€he€knew€were€he€lived€and€that€he€was€going€toÏget€him€and€his€family.€€He€stated€that€as€they€were€switching€the€handcuffs,€theÏdefendant€began€struggling€and€then€spat€in€Lieutenant€Sellersðð€face.€€He€said€that€theÏdefendant€was€then€sprayed€with€a€chemical€restraint€device.€€Officer€Kauker€testifiedÏthat€he€had€been€sprayed€with€the€device€before€and€that€a€person€can€detect€if€theÏdefendant€had€been€sprayed€by€its€odor.€€He€said€that€he€did€not€smell€the€spray€on€theÏdefendant€before€handcuffing€the€defendant€and€before€the€defendant€spat€onÏLieutenant€Sellers.€€He€stated€that€the€defendant€calmed€down€after€being€sprayed€andÏthat€he€was€then€placed€in€the€county€cruiser.€€On€cross„examination,€Officer€KaukerÏconceded€that€he€did€not€know€when€the€damage€to€the€trailer€door€occurred.€€HeÏadmitted€that€he€did€not€investigate€whether€the€defendant€and€the€victim€had€beenÏdrinking.€€ÌÌà ¸ àOfficer€Hubert€Holden,€a€reserve€police€officer€for€the€City€of€Alcoa,Ïtestified€that€Ms.€Jenkins€had€been€crying€and€had€quite€a€bit€of€blood€on€her€arms€andÏon€her€face.€€He€said€that€her€mouth€and€nose€œwere›€bleeding€and€that€a€third€of€herÏface€was€covered€in€blood.€€He€testified€that€there€was€also€quite€a€bit€of€blood€on€herÐ Ñclothing.€€Officer€Holden€testified€that€when€Lieutenant€Sellers€questioned€Ms.€Jenkins,Ïshe€told€him€that€the€defendant€was€the€one€who€had€caused€her€injuries.€€He€said€thatÏMs.€Jenkins€told€Lieutenant€Sellers€that€she€and€the€defendant€had€argued€but€that€theÏargument€worsened€and€the€defendant€hit€her.€€He€stated€that€Ms.€Jenkins€appeared€toÏhave€been€drinking€but€that€she€appeared€to€be€more€injured€than€she€was€intoxicated.€€ÌÌà ¸ àOfficer€Holden€testified€that€the€steps€to€the€defendantððs€trailer€had€beenÏtorn€away.€€He€said€that€the€inside€of€the€trailer€was€in€disarray,€and€he€believed€that€aÏstruggle€had€taken€place.€€Officer€Holden€testified€that€the€furniture€and€the€lamps€wereÏknocked€over.€€He€stated€that€there€was€a€hole€in€the€door€that€looked€like€someoneÏhad€stuck€a€fist€through€it.€€Officer€Holden€testified€that€the€officers€found€the€defendantÏinside€the€trailer€sitting€on€the€couch.€€He€stated€that€the€defendant€was€agitated€whenÏthey€went€inside€the€trailer.€€He€said€that€the€defendant€was€in€a€very€intoxicated€state,Ïand€he€described€the€defendant€as€being€ð ðout€of€itðð€and€being€ð ðway€beyond€controllingÏhimself.ðð€€He€said€that€the€defendant€could€not€walk€without€assistance.€€He€stated€thatÏthe€defendant€did€not€appear€to€be€injured.€€ÌÌà ¸ àOfficer€Holden€testified€that€the€defendant€told€him€that€there€had€been€anÏargument€but€that€it€was€not€a€big€deal€to€him.€€He€stated€that€the€defendant€resistedÏsomewhat€when€they€tried€to€place€him€in€the€cruiser€after€being€handcuffed.€€OfficerÏHolden€stated€that€when€they€removed€the€defendant€from€the€cruiser€to€transferÏcustody€to€the€sheriffððs€department,€the€defendant€cussed€Lieutenant€Sellers,Ïthreatened€him,€and€spat€on€him.€€He€said€that€Lieutenant€Sellers€then€sprayed€theÏdefendant.€€He€stated€that€the€defendant€did€not€calm€down€and€that€it€took€five€or€sixÏofficers€to€subdue€the€defendant€in€order€for€the€officers€to€completely€change€theÏhandcuffs.€€Officer€Holden€testified€that€Lieutenant€Sellers€did€nothing€to€upset€theÏâ âdefendant€but€rather€he€tried€to€calm€the€defendant€down.€€Officer€Holden€concededÐ À5¸.4 Ðthat€he€did€not€know€when€the€damage€to€the€trailer€took€place.€€He€stated€that€theÏdefendant€admitted€striking€at€Ms.€Jenkins€and€knocking€a€hole€in€the€door.€€Ìâ âÌà ¸ àDeputy€Sheriff€Lynn€Steadman€testified€that€he€arrived€at€the€LakeviewÏTerrace€Mobile€Home€Park€and€saw€the€defendant€sitting€in€the€back€of€a€police€cruiser.€ÏHe€stated€that€the€officers€decided€to€transfer€the€defendant€to€his€cruiser€because€theÏoffense€occurred€in€Blount€County.€€He€said€that€as€he€was€removing€items€from€theÏbackseat€of€his€cruiser,€he€heard€Lieutenant€Sellers€state€that€the€defendant€spat€onÏhim.€€Deputy€Steadman€testified€that€he€turned€around€and€saw€Lieutenant€SteadmanÏwiping€spit€off€his€face.€€ÌÌà ¸ àCynthia€Jenkins€testified€that€she€was€the€defendantððs€girlfriend€and€thatÏthey€had€lived€together€for€four€years.€€She€said€that€she€and€the€defendant€had€twoÏchildren€together.€€She€stated€that€she€sustained€physical€injuries,€including€bruising€allÏover€her€body€and€face,€on€the€night€of€September€9,€1994,€but€that€she€did€not€knowÏhow€the€injuries€occurred.€€Ms.€Jenkins€testified€that€she€was€very€intoxicated.€€She€saidÏthat€she€stayed€at€her€grandparentððs€house€after€the€offenses€occurred.€€She€testifiedÏthat€she€went€back€to€the€trailer€park€the€next€day€and€that€her€neighbors€told€her€whatÏhappened.€€Ms.€Jenkins€stated€that€she€did€not€remember€going€to€the€hospital.€€SheÏacknowledged€that€her€signature€appeared€on€a€sworn€affidavit€detailing€that€theÏdefendant€hit€her€with€his€fists,€causing€cuts,€bruises€and€abrasions€on€her€face.€€SheÏasserted€that€she€did€not€remember€giving€the€statement€or€going€to€the€courthouse€toÏsign€the€warrant.€€Ms.€Jenkins€testified€that€she€remembered€going€to€the€defendantððsÏparentððs€house€to€pick€up€her€youngest€daughter€and€taking€her€to€her€grandparentððsÏhouse.€€She€stated€that€she€began€living€with€the€defendant€again€approximately€threeÏmonths€later.€€She€said€that€she€tried€to€reconcile€within€the€three„month€period€but€thatÏthe€defendant€would€not€speak€to€her.€€ÌÐ Œ7„06 Ðà ¸ àOn€cross„examination,€Ms.€Jenkins€testified€that€several€people€were€atÏher€and€the€defendantððs€trailer.€€She€said€that€she€remembered€that€she€and€theÏdefendant€drank€over€half€of€a€fifth€bottle€of€tequila€on€the€night€of€the€offense€but€thatÏshe€could€not€remember€if€they€finished€the€bottle.€€She€stated€that€they€drank€the€liquorÏwhen€she€returned€from€work€at€approximately€6:00€p.m.,€and€she€said€that€she€drankÏthe€liquor€quickly.€€Ms.€Jenkins€testified€that€she€remembered€drinking€with€a€womanÏthat€lived€nearby€and€asking€her€if€she€wanted€to€be€with€the€defendant.€€Ms.€JenkinsÏtestified€that€she€became€very€angry€because€the€woman€said€that€the€woman€wasÏgoing€to€have€sex€with€the€defendant.€€She€stated€that€she€did€not€remember€muchÏafter€this€point.€€She€said€that€she€did€not€remember€getting€in€the€shower,€gettingÏdressed€in€the€bedroom,€or€fighting€with€the€defendant€at€a€neighborððs€house.€€Ms.ÏJenkins€testified€that€she€also€did€not€remember€the€police€coming€to€the€trailer.€€ÌÌà ¸ àMs.€Jenkins€stated€that€during€her€relationship€with€the€defendant,€he€hadÏnever€struck€her,€although€she€had€hit€him€a€few€times€when€she€was€angry€and€hadÏbeen€drinking.€€She€admitted€that€she€had€a€very€bad€temper.€€She€said€that€her€temperÏwas€bad€enough€for€her€to€lie€to€the€police€because€she€was€angry€at€the€defendant.€ÏMs.€Jenkins€testified€that€she€had€lied€to€other€people€about€the€defendantððs€conductÏbecause€she€was€angry€at€the€defendant.€€On€redirect€examination,€Ms.€JenkinsÏtestified€œthat€the›€defendant€had€never€gone€to€the€hospital€as€a€result€of€her€attacks.€ÏShe€stated€that€it€was€possible€that€she€could€knock€a€hole€in€a€door.€€On€recross„¼examination,€Ms.€Jenkins€testified€that€the€trailer€she€and€the€defendant€lived€in€hadÏholes€in€the€doors€when€they€moved€there.ÌÌà àDeputy€John€James€of€the€Blount€County€Sheriffððs€Department€testifiedÏthat€he€arrived€when€the€defendant€was€siting€in€the€œback›€of€a€City€of€Alcoa€policeÏcruiser.€€He€stated€that€he€spoke€to€Ms.€Jenkins€very€briefly€as€she€was€receivingÏmedical€treatment.€€He€stated€that€she€told€him€that€she€and€the€defendant€had€beenÐ àDeputy€James€testified€that€he€followed€the€ambulance€to€the€hospitalÏwhere€he€spoke€to€Ms.€Jenkins.€€He€said€that€Ms.€Jenkins€was€still€excited€but€that€sheÏwas€not€drunk€and€was€able€to€talk€to€him.€€He€stated€that€he€did€not€detect€an€odor€ofÏalcohol€and€did€not€notice€any€slurred€speech.€€Deputy€James€testified€that€Ms.€JenkinsÏtold€him€that€she€and€the€defendant€argued€and€eventually€began€fighting€inside€theÏtrailer.€€He€said€that€Ms.€Jenkins€stated€that€she€ran€to€a€couple€of€œneighbors›€and€askedÏthem€to€call€911.€€Deputy€James€testified€that€he€told€Ms.€Jenkins€that€she€could€speakÏto€a€judge€or€a€judicial€commissioner€at€the€œsheriffððs›€œdepartment›€about€obtaining€aÏwarrant€against€the€defendant.€€On€cross„examination,€Deputy€James€testified€that€Ms.ÏJenkins€essentially€told€him€at€the€hospital€that€the€defendant€had€assaulted€her,Ïalthough€he€could€not€remember€the€exact€words€used€by€Ms.€Jenkins.€€He€concededÏthat€he€did€not€test€the€victim€for€alcohol€consumption.€€ÌÌà ¸ àJohn€Tindell€testified€that€he€was€a€judicial€commissioner€for€BlountÏCounty€when€the€offenses€occurred.€€He€stated€that€he€met€with€Cynthia€Jenkins€andÏthat€he€received€a€sworn€affidavit€from€her.€€He€said€that€he€issued€a€warrant€onÏSeptember€10,€1994,€between€the€hours€of€midnight€and€6:00€a.m.€€Mr.€Tindell€statedÏthat€he€could€not€remember€Ms.€Jenkinsðð€face€but€that€he€would€not€have€issued€aÏwarrant€had€the€victim€been€drinking€because€it€was€against€policy€procedures.€€He€saidÏthat€if€Ms.€Jenkins€was€intoxicated,€she€would€have€been€incarcerated€at€the€jail.€€HeÏtestified€that€policy€procedures€required€that€they€tell€a€person€who€was€not€intoxicatedÏbut€had€been€drinking€to€come€back€later€when€they€had€not€been€drinking.€€Mr.€TindellÏstated€that€he€had€never€issued€a€warrant€to€someone€who€had€been€drinking,€and€heÏsaid€that€Ms.€Jenkins€had€not€been€drinking.€€The€affidavit€signed€by€Ms.€Jenkins€andÏMr.€Tindell€was€introduced€as€an€exhibit.€€It€states€that€Ms.€Jenkins€reported€that€theÐ Œ7„06 Ðdefendant€hit€her€with€his€fists,€causing€multiple€cuts,€bruises€and€abrasions€on€herÏface.€€On€cross„examination,€Mr.€Tindell€conceded€that€he€did€not€give€breathalyzer€orÏfield€sobriety€tests€to€determine€whether€an€affiant€is€under€the€influence€of€anÏintoxicant.€€He€stated€on€redirect€examination€that€he€believed€he€could€have€detected€ifÏMs.€Jenkins€had€œdrunk›€a€fifth€of€tequila.€€ÌÌà àLieutenant€Sellers€testified€that€he€went€to€a€nearby€trailer€and€found€theÏdefendant€inside€sitting€on€the€couch€with€a€man.€€He€stated€that€he€asked€theÏdefendant€what€had€happened,€and€the€defendant€replied€that€they€had€a€fight.€ÏLieutenant€Sellers€testified€that€he€did€not€remember€seeing€a€hole€in€the€door,€but€heÏstated€that€he€was€concentrating€on€the€defendant.€€He€said€that€he€had€earlier€dealingsÏwith€the€defendant,€although€he€did€not€realize€it€at€the€time.€€He€stated€that€he€arrestedÏthe€defendant€and€placed€him€in€the€œback›€of€a€City€of€Alcoa€police€car.€€He€said€that€theÏdefendant€had€been€drinking€but€that€he€cooperated€with€the€police€initially.€€ÌÌà ¸ àLieutenant€Sellers€testified€that€when€the€defendant€was€taken€out€of€theÏAlcoa€police€car€to€be€transferred€to€a€Blount€County€police€car,€the€defendant€beganÏthreatening€Lieutenant€Sellers€and€his€family,€telling€him€that€he€knew€where€they€lived.€Ð Œ7„06 ÐHe€said€that€he€tried€to€assist€the€officers€in€taking€the€handcuffs€off€the€defendant,€butÏhe€had€trouble€because€the€defendant€kept€struggling.€€He€stated€that€when€he€leanedÏup€to€tell€the€defendant€that€he€could€not€get€the€handcuffs€off€with€him€struggling€andÏto€tell€him€to€calm€down,€the€defendant€turned€and€spit€in€his€face.€€He€said€that€he€wasÏstanding€a€couple€of€feet€from€the€defendant€when€the€defendant€spat€in€his€face.€ÏLieutenant€Sellers€testified€that€he€then€wiped€the€spit€out€of€his€face,€and€theÏdefendant€continued€to€struggle.€€He€said€that€he€then€sprayed€the€defendantððs€faceÏwith€pepper€spray€because€the€defendant€was€out€of€control,€and€the€defendantÏstopped€struggling.€€Lieutenant€Sellers€testified€that€he€did€not€say€anything€to€make€theÏdefendant€threaten€him.€€He€said€that€after€the€fourth€or€fifth€threat,€he€told€theÏdefendant€to€stop€by€if€he€wanted.€€Lieutenant€Sellers€stated€that€he€went€to€theÏemergency€room€to€have€his€eyes€flushed€and€his€face€scrubbed.€€He€said€that€it€scaredÏhim€when€the€defendant€spat€in€his€face.€€ÌÌà ¸ àThe€defendant€testified€that€he€and€Cynthia€Jenkins€had€been€datingÏapproximately€four€years,€had€two€children€together,€and€planned€to€get€married€soon.€ÏHe€said€that€they€were€living€together€at€the€time€of€the€offenses.€€He€stated€that€he€hadÏbeen€employed€as€a€painter€for€a€long€time.€€The€defendant€testified€that€several€peopleÏcame€to€his€trailer€on€the€evening€of€September€4,€1994,€and€began€drinking.€€He€statedÏthat€he€was€drinking€beer€and€that€Ms.€Jenkins€was€drinking€tequila€with€a€femaleÏneighbor.€€He€said€that€they€drank€a€fifth€of€tequila€in€approximately€forty„five€minutesÏand€that€they€began€drinking€his€beer€at€approximately€7:00€or€7:30€p.m.€€TheÏdefendant€testified€that€they€became€intoxicated€but€that€Ms.€Jenkins€got€veryÏintoxicated€because€she€drank€more€than€the€neighbor.€€He€stated€that€the€neighborÏbegan€making€passes€at€him€and€that€Ms.€Jenkins€became€very€angry€at€him€and€theÏneighbor€when€she€heard€the€neighbor€state€that€she€was€going€to€get€the€defendantÏinto€bed.€€He€said€that€he€tried€to€explain€to€Ms.€Jenkins€that€he€was€not€interested€inÏthe€neighbor.€€The€defendant€said€that€he€asked€the€neighbor€to€leave€but€that€Ms.Ð Œ7„06 ÐJenkins€was€still€real€mad.€€He€stated€that€he€took€their€child€to€his€motherððs€house,€andÏMs.€Jenkins€went€to€a€neighborððs€house.€€The€defendant€testified€that€his€œparentññððññs›€triedÏto€get€him€to€stay€the€night,€but€he€told€them€that€he€needed€to€check€on€Ms.€JenkinsÏbecause€she€was€really€drunk.€€He€said€that€when€he€returned,€Ms.€Jenkins€was€still€atÏthe€neighborððs€house€but€that€he€did€not€go€there€to€speak€to€her.€€He€stated€thatÏseveral€people€told€him€that€the€police€were€coming€after€him.€€He€said€that€he€invitedÏthe€police€into€his€trailer€when€they€arrived€and€that€he€was€then€arrested.€€ÌÌà ¸ àThe€defendant€believed€that€Ms.€Jenkins€suffered€her€injuries€when€sheÏfell€out€of€the€bathtub€at€approximately€9:00€p.m.€€He€stated€that€Ms.€Jenkins€slippedÏwhen€she€reached€down€to€turn€off€the€faucet.€€He€said€that€she€also€hit€her€head€onÏthe€toilet€next€to€the€bathtub.€€The€defendant€stated€that€Ms.€Jenkins€cut€her€mouth€orÏher€nose€in€the€bathroom€and€that€it€bled€heavily.€€He€said€that€he€tried€to€clean€theÏblood€off€her€but€she€would€not€let€him€because€she€was€angry€at€him.€€The€defendantÏtestified€that€Ms.€Jenkins€then€went€into€the€bedroom€and€fell€down.€€He€stated€that€Ms.ÏJenkins€walked€naked€in€front€of€their€guests€and€that€she€fell€several€times€in€theÏhouse€and€fell€once€off€the€front€porch.€€He€stated€that€Ms.€Jenkins€dressed€herself€atÏsome€point€after€falling€in€the€bathtub€and€walking€naked€in€front€of€their€guests.€€ÌÌà ¸ àThe€defendant€testified€that€he€and€Lieutenant€Sellers€did€not€really€talkÏbut€rather€Lieutenant€Sellers€taunted€him€as€they€came€off€the€front€porch€by€sayingÏthat€the€police€had€him€now€and€that€he€was€going€down€and€would€never€get€out€of€jail.€ÏHe€said€that€this€made€him€very€angry.€€He€conceded€that€he€did€not€like€LieutenantÏSellers.€€The€defendant€stated€that€Lieutenant€Sellers€continued€to€taunt€him€as€he€wasÏbehind€the€defendant€trying€to€remove€the€handcuffs.€€He€said€that€he€was€notÏstruggling,€although€he€was€upset€for€being€arrested€because€he€believed€that€he€hadÏdone€nothing€wrong.€€He€admitted€that€he€was€extremely€mad€at€Lieutenant€Sellers€andÏthat€he€threatened€to€harm€Lieutenant€Sellers.€€He€said€that€he€also€told€LieutenantÐ Œ7„06 ÐSellers€that€he€did€not€have€to€take€off€his€handcuffs€because€he€would€fight€himÏwearing€handcuffs.€€The€defendant€testified€that€he€did€not€remember€threateningÏLieutenant€Sellersðð€family,€and€he€said€that€he€did€not€know€where€they€lived.€€TheÏdefendant€stated€that€it€was€clear€that€Lieutenant€Sellers€did€not€like€him€either.€€HeÏsaid€that€a€man€behind€Lieutenant€Sellers€sprayed€him€with€pepper€spray.€€He€statedÏthat€when€the€spray€hit€his€face,€he€spat€because€it€got€in€his€mouth,€eyes€and€nose.€ÏThe€defendant€asserted€that€he€did€not€know€which€direction€he€was€spitting.€€HeÏtestified€that€he€did€not€intentionally€spit€on€anyone,€although€he€conceded€that€he€wasÏmad€enough€to€spit€on€Lieutenant€Sellers.€€ÌÌà àThe€defendant€did€not€believe€that€the€pepper€spray€was€necessaryÏbecause€the€only€person€he€had€any€trouble€with€was€Lieutenant€Sellers€and€that€wasÏonly€because€he€was€taunting€the€defendant.€€He€denied€that€he€was€drunk€on€the€nightÏof€the€offense,€although€he€admitted€that€he€had€a€few€drinks.€€He€also€admitted€that€heÏprobably€threatened€Lieutenant€Sellersðð€family,€although€he€claimed€that€it€was€notÏintentional€and€that€he€would€not€actually€hurt€his€family.€€He€said€that€he€did€not€speakÏto€Ms.€Jenkins€after€the€arrest€for€several€months.€€He€stated€that€they€no€longer€drinkÏin€the€house.€€The€defendant€testified€that€he€had€never€struck€Ms.€Jenkins,€althoughÏshe€had€struck€him€on€earlier€occasions.€€He€stated€that€she€had€a€œvery›€bad€temper.€ÏHe€said€that€he€tried€to€leave€when€Ms.€Jenkins€became€violent.€€On€cross„examination,Ïthe€defendant€conceded€that€he€and€Ms.€Jenkins€drank€heavily€at€the€time€of€theÏoffenses,€and€he€acknowledged€that€it€caused€a€lot€of€problems€for€them.€€The€juryÏfound€the€defendant€guilty€of€assaulting€Ms.€Jenkins€and€Lieutenant€Sellers.€ÌÌà àIn€the€light€most€favorable€to€the€state,€the€evidence€shows€that€theÏdefendant€and€Ms.€Jenkins€argued€after€they€consumed€alcohol€at€their€trailer.€€TheÏevidence€reflects€that€after€the€defendant€struck€Ms.€Jenkins,€injuring€her,€Ms.€JenkinsÏran€to€a€neighborððs€house€and€called€the€police.€€When€the€police€arrived,€Ms.€JenkinsÏhad€blood€on€her€face,€hands€and€clothes,€and€she€was€crying€and€was€upset.€€Ms.ÏJenkins€told€the€officers€that€the€defendant€had€beaten€her€up€and€had€caused€herÏinjuries.€€Later,€Ms.€Jenkins€also€signed€an€affidavit€asserting€that€the€defendant€hit€herÏwith€his€fists,€causing€cuts,€bruises€and€abrasions€on€her€face.€€Also,€the€trailer€was€inÏdisarray,€a€hole€had€been€punched€in€the€door,€and€the€steps€to€the€trailer€had€beenÏtorn€away.€€The€defendant€admitted€striking€at€Ms.€Jenkins€and€knocking€a€hole€in€theÏdoor.€€Although€the€defendant€claimed€that€the€victim€was€highly€intoxicated€andÏreceived€her€injuries€when€she€fell€in€the€bathtub,€off€the€front€porch,€and€in€theÏbedroom€and€throughout€the€house,€the€jury€was€entitled€to€reject€this€testimony.€€TheÏofficers€at€the€scene€and€the€judicial€commission€who€issued€the€warrant€testified€thatÏMs.€Jenkins€was€not€intoxicated.€€We€hold€that€the€evidence€establishes€beyond€aÏreasonable€doubt€that€the€defendant€assaulted€Ms.€œJenkins.ñ àThe€defendant€admitted€that€he€had€eight€prior€misdemeanor€convictionsÏand€three€prior€felony€convictions,€and€he€claimed€that€they€all€involved€alcohol.€€TheÏdefendant€stated€that€the€breaking€and€entering€and€concealing€stolen€propertyÏconvictions€involved€entering€and€taking€alcohol€from€a€VFW€Club.€€The€defendantÏadmitted€that€he€was€an€alcoholic,€but€he€said€that€he€had€been€sober€since€NovemberÏ19,€1996.€€He€stated€that€he€went€to€a€couple€of€AA€meetings€for€the€first€week.€€TheÏdefendant€testified€that€after€becoming€sober,€he€had€gone€to€church€on€a€regularÏbasis.€€The€defendant€admitted€that€he€had€used€marijuana€after€the€trial,€but€heÏclaimed€that€he€used€it€only€because€he€was€depressed€over€being€wrongly€convicted.€Ð Œ7„06 ÐThe€defendant€also€asserted€that€he€only€inhaled€twice.€€He€admitted€that€when€he€wasÏinterviewed€for€the€presentence€report,€he€lied€to€the€probation€officer€about€his€priorÏuse€of€marijuana€even€though€a€drug€test€showed€that€the€defendant€had€usedÏmarijuana.€€He€acknowledged€that€he€should€have€told€the€truth,€but€he€claimed€that€heÏwas€scared.€€€€€€€€ÌÌà àThe€presentence€report€reflects€that€the€then€thirty„three„year„oldÏdefendant€dropped€out€of€high€school€in€the€tenth€grade€but€that€he€had€obtained€hisÏGED.€€It€shows€that€the€defendant€had€been€employed€as€a€painter€for€approximatelyÏone€year.€€The€defendant€claimed€to€be€in€good€physical€and€mental€health,€althoughÏhe€admitted€that€he€had€been€through€driving€under€the€influence€school€on€threeÏoccasions.€€He€admitted€that€he€had€drunk€alcohol€since€the€age€of€thirteen€and€that€heÏbegan€drinking€at€least€once€a€week€when€he€was€sixteen€years€old.€€The€defendantÏclaimed€that€he€stopped€drinking€alcohol€in€1996€when€his€driverððs€license€wasÏreinstated.€€The€presentence€report€reflects€that€the€defendant€denied€that€he€had€everÏused€drugs,€but€the€report€states€that€an€earlier€presentence€report€showed€that€theÏâ âdefendant€admitted€trying€marijuana€when€he€was€in€high€school.€€It€shows€that€a€drugÐ À5¸.4 Ðscreen€conducted€in€January€1997€tested€positive€for€marijuana€but€that€the€defendantÏcontinued€to€deny€that€he€used€marijuana.€Ìâ âÌà ¸ àThe€report€shows€that€the€defendant€had€several€prior€convictions€forÏoffenses€including€assault,€aggravated€assault,€breaking€and€entering,€concealingÏstolen€property,€two€counts€of€driving€on€a€revoked€license,€three€counts€of€publicÏintoxication,€and€two€counts€of€driving€under€the€influence.€€It€shows€that€the€defendantÏwas€granted€alternative€sentencing€several€times€but€that€he€violated€the€conditions€ofÏrelease.€€The€defendant€denied€that€he€committed€the€present€offenses.€€TheÏpresentence€report€reflects€that€the€victim€blamed€herself€for€the€offenses,€stating€thatÏshe€was€highly€intoxicated€and€had€hit€the€defendant€in€the€past€during€heatedÏarguments.€€The€victim€stated€that€she€told€lies€about€the€defendant€because€she€wasÏangry€at€him.ÌÌà
