Ðà ` àIn€her€testimony,€Defendant€denied€hitting€the€victim€at€any€time€during€thisÏincident.€€She€estimated€that€if€the€victim€were€hit€in€the€face,€it€was€probably€byÏsomeone€in€the€crowd€during€the€commotion.€€Defendant€had€no€knowledge€of€theÏassault€until€the€victim€told€Defendantððs€supervisors€that€Defendant€had€assaultedÏthe€victim.€€ÌÌà ` àDefendant€explained€that€she€had€waived€her€right€to€a€jury€trial€and€pled€guiltyÏbecause€she€had€a€three€(3)€month€old€infant€who€required€constant€medicalÏattention.€€She€stated€she€had€no€prior€criminal€record€and€had€been€attendingÏcollege,€hoping€to€complete€her€degree€within€one€(1)€year.€€Defendant€believed€sheÏshould€be€granted€judicial€diversion€because€she€had€ð ðnever€been€in€any€troubleÏbefore€in€[her]€life.ðð€€The€trial€court€interrupted€her€testimony€to€inquire€about€her€useÏof€the€illegal€drugs€cocaine€and€ecstasy€for€a€period€of€1.5€years.€€DefendantÏadmitted€this€drug€use,€but€stated€that€it€was€no€longer€a€part€of€her€life€and€did€notÏconsider€that€ð ðbeing€in€trouble.ðð€€When€asked€by€the€trial€court€if€she€had€no€remorseÏat€all,€Defendant€replied€that€she€was€sorry€that€she€walked€up€to€the€victim€andÏasked€her€what€the€problem€was.€€When€questioned€about€her€mental€state,ÏDefendant€admitted€she€was€on€prozac€because€of€depression.€€ÌÌà ` àStacy€Thompson,€a€friend€of€the€Defendant,€testified€that€she€also€was€sellingÏbeer€at€the€U2€concert€on€May€27,€1997.€€Thompson€observed€Defendant€andÏPhipps€being€moved€to€another€location€to€sell€beer.€€Thompson€recalled€that€theÏvictim€approached€Defendant€and€Phipps€and€yelled€obscenities€to€them.€€There€wasÏa€big€commotion,€with€the€victim€throwing€the€Defendantððs€tip€jar€onto€the€ground.€Ð 8¸.. ÐThompson€estimated€that€$300.00€or€$400.00€was€in€the€tip€jar.€€Thompson€neverÏsaw€anyone€hit€the€victim.€€Thompson€did€not€know€the€Defendant€to€be€a€liar.ÌÌà ` àWhen€makings€its€findings,€the€trial€court€stated€as€follows:ÌÓÓà8 ` à[Y]ou€have€a€lot€of€problems.€€In€looking€at€your€report,€from€your€pastÏdrug€use,€from€your€mental€medication€youððre€taking,€you€have€a€lot€ofÏproblems.€€And€unless€you€get€some€help,€youððre€going€to€be€put€inÏprison.€€And€whatððs€going€to€happen€to€your€baby€then?€€Okay.€€YouððreÏnot€working.€€You€havenððt€really€worked€that€much.€€Dropped€out€ofÏschool.€€Used€drugs€for€awhile.€€And€youððre€just€headed€for€disaster.€€IÏwant€you€to€understand€that.€€You€have€an€attitude€that€the€world€owesÏyou€some€kind€of€favor,€that€youððre€special,€that€youððre€better€thanÏeverybody€else.€€And€I€want€you€to€understand,€youððre€not.€€And€I€donððtÏwant€you€to€think€that€you€can€sit€up€here€and€commit€perjury€and€try€toÏlie€your€way€out€of€something€you€did.€€Because€I€tell€you€right€now,€youÏhave€a€horrible€credibility.€€You€have€a€horrible€attitude.€€And€I€donððtÏbelieve€a€word€youððre€telling€me.Ð ` (#` (# ÐÌÓÓThe€trial€court€stated€that€although€Defendant€pled€guilty€under€an€òòAlfordóó€plea,€it€wasÐ ¸X Ðstill€necessary€for€the€trial€court€to€presume€Defendant€was€guilty€as€the€facts€wereÏstipulated€to€by€Defendant.€€The€trial€court€had€two€(2)€main€problems€with€diversion.€ÏFirst,€Defendant€did€not€admit€to€the€act€and€showed€no€remorse.€€Second,€she€usedÏthe€drugs€cocaine€and€ecstasy€for€a€period€a€year„and„a„half,€contributing€to€the€drugÏculture€and€demonstrating€a€ð ðconsistent€intent€to€violate€the€law.ðð€€Under€theseÏcircumstances,€the€trial€court€did€not€feel€that€diversion€was€warranted.€€€Rather,€theÏtrial€court€sentenced€Defendant€to€the€agreed€upon€sentence€of€sixty€(60)€daysÏsuspended€sentence,€followed€by€eleven€(11)€months,€twenty„nine€(29)€days€ofÏprobation.ÌÌà àThose€factors€to€be€considered€by€the€trial€court€include:€(1)€the€circumstancesÏof€the€offense;€(2)€the€criminal€record,€social€history€and€present€condition€of€theÏdefendant,€including€the€defendantððs€mental€and€physical€condition€whereÏappropriate;€(3)€the€deterrent€effect€of€punishment€upon€other€criminal€activity;€(4)Ïdefendantððs€amenability€to€correction;€(5)€the€likelihood€that€diversion€will€serve€theÏends€of€justice€and€the€best€interests€of€both€the€public€and€the€defendant;€and€(6)Ïthe€defendantððs€attitude,€behavior€since€arrest,€prior€record,€home€environment,Ïcurrent€drug€usage,€emotional€stability,€past€employment,€general€reputation,€maritalÏstability,€family€responsibility,€and€the€attitude€of€law€enforcement.€€òòState€v.Ð
