Ðreconsider,€the€trial€judge€again€found€no€òòBradyóó€violation,€but€in€his€ruling€from€the€benchÐ pÀ Ðspecifically€addressed€the€four€òòBradyóó€prerequisites,€citing€to€òòState€v.€Edginóó.€€The€trial€judge€held€that:Ð \¬ Ð(1)€the€Defendant€had€adequately€requested€the€information;€(2)€the€court€was€unsure€whether€or€not€Ð H˜ Ðthe€State€ð ðsuppressedðð€the€information,€as€it€ð ðvery€easily€could€have€been€an€oversightðð;€and€(3)€theÐ 4„ Ðinformation€was€favorable€to€the€Defendant.€€However,€the€court€based€its€ruling€on€the€fourthÐ  p àWe€affirm€the€trial€courtððs€ruling€that€the€Defendant€failed€to€prove€a€due€process€violationÐ ”ä Ðunder€òòBradyóó,€but€we€note€that€the€trial€court€applied€the€incorrect€standard€for€determiningÐ Ñreliability€of€a€given€witness€may€be€determinative€of€guilt€or€innocence,€non„disclosure€of€evidenceÐ ° Ðeffecting€credibility€falls€within€[the€òòBradyóó]€ruleðð).€€€Third,€we€find€that€the€Defendant€has€provedÐ œì Ðby€a€preponderance€of€the€evidence€that€the€State€suppressed€the€impeachment€evidence.€€While€theÐ ˆØ Ðtrial€judgeððs€speculation€that€the€Stateððs€failure€to€disclose€the€impeachment€evidence€may€have€beenÐ tÄ Ðnothing€more€than€an€ð Ðeither€to€guilt€or€to€punishment.€.€.€.ðð€òòBradyóó,€737€U.S.€at€87€(emphasis€added).€€However,€the€òòBradyóóÐ Ô$  ÐCourt€did€not€define€ð ðmateriality.ðð€€In€òòEdginóó,€the€Tennessee€Supreme€Court,€relying€on€the€UnitedÐ À  ÐStates€Supreme€Court€case€of€òòUnited€States€v.€Agursóó,€427€U.S.€97,€103„07€(1976),€noted€that€thereÐ ¬ü Ðtestimony€by€the€prosecution;€(2)€undisclosed€information€following€a€specific€request€by€theÐ pÀ Ðdefense;€and€(3)€undisclosed€information€following€a€general€request€or€no€request€by€the€defense.€Ð \¬ ÐòòSeeóó€òòidóó.€€€The€court€declared€that,€pursuant€to€òòAgursóó,€when€only€a€general€request€was€made€for€òòBradyóóÐ H˜ Ðinformation,€the€ð ðundisclosed€information€is€ððmaterialðð€if€it€ððcreates€a€reasonable€doubt€that€did€notÐ 4„
