OnJanuary9,1998,thepetitionerfiledhissecondpetitionforpostconvictionrelief.Findingthatthepetitionerhadpreviouslyfiledapetitionforpostconvictionwhichwasheardandresolvedonthemeritsbyacourtofcompetentjurisdiction,thetrialcourtdismissedthepetitionwithoutappointmentofcounseloranevidentiaryhearing.  T.C.A.4030202(c)providesthatnomorethanonepetitionforpostconvictionreliefmaybefiledattackingasinglejudgment,andmandatesthatthetrialcourtshallsummarilydismissanysecondorsubsequentpetitionifapriorpetitionwasfiledandresolvedonthemeritsbyacourtofcompetentjurisdiction.SincethepetitionerpreviouslyfiledapetitionthatwasresolvedonthemeritsbythetrialcourtandbythisCourtonappeal,thepetitioner'spresentpetitionwasproperlydismissed.Additionally,afterreviewingtheentirerecordonappeal,wefindthatthepetitionersclaimdoesnotfallwithinoneofthelimitedcircumstancesunderwhichapriorpetitionmaybereopened.SeeT.C.A.4030217.  Accordingly,weconcludethatthetrialcourtdidnoterrinsummarilydismissingthepetitionerspetitionforpostconvictionrelief.Accordingly,itisherebyORDEREDthatthejudgmentofthetrialcourtisaffirmedinaccordancewithRule20,RulesoftheCourtofCriminalAppeals.Itappearingthepetitionerisindigent,costsofthisappealshallbetaxedtothestate.
