OnOctober23,1995,theappellantwasconvictedandsentencedasaRangeIIoffenderintheRoaneCountyCriminalCourtfortheftovertenthousand($10,000)dollars.Thetrialcourtsentencedtheappellanttosixyearsimprisonment.Noappealwastakenfromthatconvictionandsentence. OnMarch6,1996,theappellantfiledapostconvictionpetitionallegingthathis1995sentencewasimproperlyenhancedbyhispriorconvictions.Heallegesthathispriorconvictionswereunconstitutionalbecausehisguiltypleasinthosecaseswerenotmadeknowinglyandvoluntarily.Thosepriorconvictionsdatebackto1989andincludethefollowing:(1)OnMarch17,1989,theappellantpledguiltyandwassentencedbytheRoaneCountyCriminalCourtontwocountsofgrandlarcenyandonecountofconcealingstolenpropertyvaluedovertwohundred($200)dollars;(2)OnDecember14,1989,theappellantpledguiltyandwaslatersentencedbytheRoaneCountyCriminalCourtononecountofgrandlarceny,thirddegreeburglary,andfalsepretensesovertwohundred($200)dollars;and(3)In1990,theappellantpledguiltyandwassentencedbytheKnoxCountyCriminalCourtononechargeofseconddegreeburglaryandaseparatechargeofburglary. Theappellanthasneverchallengedanyoftheaboveconvictionsorsentencesuntilhis1996postconvictionpetition.Thetrialcourtdismissedthepetitionasbeingtimebarredbythethreeyearstatuteoflimitations.SeeTenn.CodeAnn.4030102(repealed1995). Theappellantsonlyissueonappealisthatthetrialcourterredindismissinghispostconvictionpetitionwithoutahearing.TheappellantreliesonBurfordv.State,845S.W.2d204(Tenn.1992)toassertthatahearingwasrequiredtodetermineifthethreeyearstatuteoflimitationsproperlyappliedtohispetition.HisrelianceonBurfordismisplaced.TherulefromBurford,asnowcodifiedinTennesseeCodeAnnotatedsection4030202(b)(3),appliesincaseswherepetitionerschallengethevalidityoftheirsentenceasenhancedbypriorconvictionsthathavesubsequentlybeenoverturned.Inthosecases,oursupremecourthasheldthatstrictapplicationofthethreeyearstatuteoflimitationsinTennesseeCodeAnnotatedsection4030102wouldresultinaviolationofthepetitionersrightstodueprocess.SeeBurford,845S.W.2dat208209. Intheappellantscase,however,hispriorconvictionsin1989and1990haveneverbeenreviewedoroverturned.TheappellantisessentiallyrequestingthisCourttoreviewthevalidityofhispriorconvictionsalmosteightyearsafterheenteredguiltypleasinthosecases.Anypostconvictionchallengepertainingtothe1989and1990convictionsisclearlytimebarredbythethreeyearstatuteoflimitations.SeeTenn.CodeAnn.4030102(repealed1995).Absentareviewandfindingthathispriorconvictionsareinvalid,theappellantspresentchallengetohis1995sentenceiswithoutmerit. Theappellantwaiteduntil1996toraiseanychallengeconcerninghisconvictionsin1989and1990.Consequently,anypresentreviewofthosepriorconvictionsistimebarred.UnderthemandatesetforthinTennesseeCodeAnnotatedsection4030206(b),thetrialcourtproperlydismissedtheappellantspetition.
