àThe€Petitioner,€Stephan€A.€Thorpe,€appeals€from€the€order€denying€hisÏpetition€€for€post„conviction€relief.€€Petitioner€was€indicted€on€four€(4)€counts€ofÏaggravated€sexual€battery.€€Pursuant€to€an€agreement€with€the€State,€PetitionerÏpled€guilty€to€attempt€to€commit€aggravated€sexual€battery€in€violation€ofÏTennessee€Code€Annotated€sections€39„12„101€and€39„13„504€in€the€CriminalÏCourt€of€Shelby€County.€€Petitioner€also€pled€guilty€to€three€(3)€counts€of€indecentÏexposure,€although€these€pleas€are€not€the€subject€of€his€petition€for€post„convictionÏrelief.€€According€to€the€agreement,€he€was€sentenced€as€a€Range€II€Offender€toÏserve€eight€(8)€years€for€the€attempted€aggravated€sexual€battery€œconviction.€€In€hisÏpetition€for€post„conviction€relief,€Petitioner€claimed€that€his€Fifth€Amendment€rightÏagainst€self„incrimination€was€violated€and€his€Sixth€Amendment€right€to€theÏeffective€assistance€of€counsel€was€denied.€€Following€an€evidentiary€hearing,€theÏtrial€court€denied€relief.€€Petitioner€appealed€to€this€court€strictly€on€the€issue€ofÏineffective€assistance€of€counsel€based€upon€his€involuntary€guilty€plea.€€We€affirmÏthe€judgment€of€the€trial€court.ÌÌà ðare€conclusive€on€appeal€unless€the€evidenceÏpreponderates€against€the€judgment.ðð€€òòState€v.€Bufordóó,€666€S.W.2d€473,€475€(Tenn.ÏCrim.€App.€1983).€€In€reviewing€the€Petitionerððs€Sixth€Amendment€claim€of€ineffectiveÏassistance€of€counsel,€this€court€must€determine€whether€the€advice€given€or€theÏservices€rendered€by€the€attorney€are€within€the€range€of€competence€demanded€ofÏattorneys€in€criminal€cases.€€òòBaxter€v.€Roseóó,€523€S.W.2d€930,€936€(Tenn.€1975).€ÏTo€prevail€on€a€claim€of€ineffective€counsel,€a€petitioner€ð àPetitioner€argues€that€his€guilty€plea€was€uninformed€and€involuntary€basedÏupon€trial€counselððs€failure€to€inform€him€of€the€effect€of€his€status€as€a€Range€IIÏOffender€on€his€parole€eligibility€as€a€sex€offender.€€At€the€evidentiary€hearing,ÏPetitioner€testified€that€during€his€meetings€with€trial€counsel€they€discussed€the€eightÏ(8)€years€as€being€the€minimum€sentence€for€the€attempted€aggravated€sexualÏbattery€charge.€€Petitioner€claimed€that€counsel€advised€him€that€his€status€as€aÏRange€I€or€Range€II€Offender€did€not€matter€either€way€as€far€as€the€length€ofÍsentence€was€concerned.€€Petitioner€did€not€know€that€a€Range€II€OffenderÏordinarily€has€two€(2)€to€four€(4)€felony€convictions.€€This€was€Petitionerððs€first€felonyÏconviction.€€While€Petitioner€did€not€understand,€he€did€not€ask€his€attorney€anyÏquestions.€€He€admitted€that€he€pled€guilty€freely€and€voluntarily,€although€he€feltÏthat€he€did€not€have€the€proper€information€to€make€the€decision€to€plead€guilty.€€ÌÌà àOn€cross„examination,€Petitioner€admitted€that€he€responded€affirmativelyÏwhen€questioned€by€the€trial€court€at€the€guilty€plea€hearing€as€to€whether€his€pleaÏwas€made€voluntarily.ÌÌà àTrial€counsel€testified€that€from€the€day€he€met€the€Petitioner,€Petitioner€saidÏthat€he€had€a€problem,€he€was€guilty,€and€he€did€not€want€to€go€through€a€trial€andÏbring€these€children€into€court.€€Petitioner€asked€counsel€to€get€the€best€offer€heÏcould€get€as€Petitioner€did€not€have€any€felony€convictions.€€When€the€offer€wasÏmade€for€eight€(8)€years€in€exchange€for€his€guilty€plea,€counsel€met€with€PetitionerÏand€explained€to€him€that€he€was€not€going€to€be€able€to€be€paroled€on€these€sexÏoffenses.€€Also,€counsel€advised€him€that€the€difference€between€eight€(8)€years€asÏa€Range€I€Offender€would€probably€not€be€any€different€than€a€Range€II€OffenderÏbecause€counsel€did€not€think€that€Petitioner€could€get€parole€on€either€one.ÌÌà àIn€its€order€denying€the€Petitionerððs€petition€for€post„conviction€relief,€the€trialÏcourt€found€that€the€Petitioner€was€interested€at€all€times€in€settling€the€case€and€notÏsubmitting€to€a€trial.€€It€specifically€held€that€trial€counsel€fully€explained€the€differenceÏbetween€Range€I€and€Range€II€sentences€and€that€by€pleading€to€criminal€attemptÏas€opposed€to€the€charged€offense€of€aggravated€sexual€battery,€Petitioner€wouldÏhave€the€opportunity€to€petition€the€court€for€probation.€€The€trial€court€found€that€trialÏcounsel€thoroughly€and€professionally€handled€all€aspects€of€the€representationÏfrom€which€Petitioner€complains€and€that€Petitioner€received€outstandingÏrepresentation€as€required€by€òòBaxter€v.€Roseóó,€523€S.W.2d€930€(Tenn.€1975).ÌÌà àIn€light€of€the€record€and€the€briefs,€the€evidence€in€the€case€òòsubóó€òòjudiceóó€doesÏnot€preponderate€against€the€trial€courtððs€findings.€€As€the€trial€court€pointed€out€in€itsÏorder,€the€Petitioner€was€interested€in€getting€a€deal€and€not€going€to€trial.€€EquallyÏclear€is€the€fact€that€Petitioner€was€advised€of€his€rights,€both€prior€to€the€guilty€pleaÏhearing€and€during€the€guilty€plea€hearing.€€The€record€demonstrates€that€the€guiltyÏplea€was€made€voluntarily,€understandingly€and€knowingly,€and€that€the€trial€courtÏcomplied€with€the€conditions€of€òòState€v.€Mackeyóó,€553€S.W.2d€337€(Tenn.€1977).€ÏòòSeeóó€òòBoykin€v.€Alabamaóó,€395€U.S.€238,€242€(1969).€€ÌÌà àIn€effect,€the€relief€Petitioner€truly€seeks€is€a€reduced€sentence.€€During€theÏevidentiary€hearing,€the€Petitioner€responded€as€follows€to€the€trial€courtððsÏquestioning:ÌÓÓà8 àWell,€Judge,€it€really€boils€down€to€„€„€the€simplicity€of€it€is,€Iððve€beenÏdown€for€almost€three€years.€€I€have€a€little€six€year€old€son€that€IððveÏmissed€the€last€three€years€of€his€life.€€I€have€a€family€to€take€care€ofÏthat€„„€well,€my€wife€doesnððt€work.€€She€teaches€my€son€at€home.€ÏAnd€stuff€like€that.€€They€have€financial€problems€and€problems€withÏthe€cars€and€different€things€that€I€could€help€out€with€if€I€was€there.€ÏAnd€I€havenððt€had€any€write„ups.€€No€disciplinary€actions€at€all€sinceÏIððve€been€locked€up.€€And€I€was€just€wondering€if,€you€know,€if€I€couldÏask€the€mercy€of€the€court,€that€I€could€get€some€type€of€time€reductionÏor€something€to€help€me€out€with€being€able€to€go€back,€you€know,€toÏhelp€my€family€out.€€That€was€„„€as€far€as€the€time€goes,€you€know,ÏIððve€been€in€the€army.€€I€can€do,€you€know,€I€can€do€the€time.€€And,Ïyou€know,€Iððm€not€changing€my€„„€Iððm€not€interested€in€changing€myÏplea.€€But€I€would€just€like€to€see€if€there€was€any€possibility€of€beingÏable€to€get€out€to€my€family€any€sooner.ÌÌÌÓÓWhen€asked€on€cross„examination€if€all€he€wanted€was€a€ð
