àIn€1998,€Glenda€Eva€Ô_ÔTilleyÔ_Ô,€the€defendant,€and€her€husband€befriended€VernaÏRobinson,€an€elderly€neighbor€who€lived€alone€on€Valley€Drive€in€Bristol,€Tennessee.€€Ms.ÏRobinson€was€78€years€old€and€suffered€from€Alzheimerððs€disease.€€During€a€ten„month€period€theÏÔ_ÔTilleysÔ_Ô€systematically€pilfered€over€$20,000€of€Ms.€Robinsonððs€life€savings.€€Their€larcenousÏscheme€involved€changing€the€victimððs€safe€deposit€box€and€bank€accounts€to€add€the€defendantððsÏname,€withdrawing€certificates€of€deposit€owned€by€the€victim,€and€changing€the€victimððs€will€toÏname€the€defendant€as€the€primary€beneficiary.€€The€defendant€was€unemployed€throughout€thisÏtime,€nor€did€her€husband€work;€he€drew€slightly€more€than€$1,000€per€month€in€workersððÏcompensation€and€Social€Security€benefits.ÌÌà àà àWhen€the€theft€was€eventually€discovered,€the€Ô_ÔTilleysÔ_Ô€admitted€appropriating€theÏvictimððs€assets€but€maintained€that€they€had€assisted€the€victim.€€According€to€the€defendant€whenÑ€;ÑÇâ  ââ  âÔ_Ôshe€was€questioned€by€law€enforcement€officials,€her€husband€had€ð ðconvincedðð€her€that€sheÏdeserved€the€money.€€The€criminal€proceedings€against€the€husband€were€discontinued€after€hisÏdeath€in€late€1999.€€Approximately€$7,500€of€the€money€taken€by€the€Tilleys€was€recovered€andÏreturned€to€the€victim.ÌÌà àà àThe€defendant€entered€a€plea€of€guilty€to€the€charge€of€theft€of€property€valued€overÏ$10,000.€€Tenn.€Code€Ann.€ðððð€39„14„103,€„105€(1977).€€Evidently,€the€parties€agreed€to€a€minimumÏsentence€of€three€years€as€a€Range€I€standard€offender,€but€the€manner€of€service€was€reserved€forÏdetermination€by€the€trial€court.€€At€the€sentencing€hearing,€the€trial€court€imposed€a€split„confinement€sentence;€it€suspended€the€three„year€sentence€and€placed€the€defendant€on€intensiveÏsupervised€probation,€with€special€conditions,× ƒ< ××  ×€for€eight€years€to€be€preceded€by€300€daysÏincarceration€in€the€Sullivan€County€Jail.€€In€this€appeal,€the€defendant€complains€that€she€shouldÏhave€received€alternative€sentencing€and,€moreover,€that€she€carried€her€burden€of€showingÏentitlement€to€full€probation.€€€For€the€reasons€that€follow,€we€affirm€the€sentence€imposed€by€theÏtrial€court.ÌÌà àA€defendant€who€"is€an€especially€mitigated€or€standard€offender€convicted€of€aÏClass€C,€D,€or€E€felony€is€presumed€to€be€a€favorable€candidate€for€alternative€sentencing€options€inÏthe€absence€of€evidence€to€the€contrary."€€Tenn.€Code€Ann.€ðð€40„35„102(6)€(1997).€€Our€sentencingÏlaw€also€provides€that€"convicted€felons€committing€the€most€severe€offenses,€possessing€criminalÏhistories€evincing€a€clear€disregard€for€the€laws€and€morals€of€society,€and€evincing€failure€of€pastÏefforts€at€rehabilitation,€shall€be€given€first€priority€regarding€sentences€involving€incarceration."€€ÏòòId.óó€ðð€40„35„102(5).€€Thus,€a€defendant€who€meets€the€criteria€of€€section€40„35„102(6)€is€presumedÏeligible€for€alternative€sentencing€unless€sufficient€evidence€rebuts€the€presumption.€€However,€theÏact€does€not€provide€that€all€offenders€who€meet€the€criteria€are€entitled€to€such€relief;€rather,€itÏrequires€that€sentencing€issues€be€determined€by€the€facts€and€circumstances€presented€in€each€case.€ÏòòSee€State€v.€Tayloróó,€744€S.W.2d€919,€922€(Tenn.€Crim.€App.€1987).ÌÌà àThe€trial€court€in€this€case€determined€that€full€probation€was€inappropriate€andÏwould€not€be€in€the€best€interest€of€either€the€public€or€this€defendant.€€The€defendant,€the€trial€courtÏfound,€was€an€untruthful€person€who€did€not€accept€responsibility€for€her€actions,€therebyÏundermining€her€potential€for€rehabilitation.€€The€trial€judge€noted€that€the€defendant€had€failed€toÏdisclose€that€she€had€been€arrested€in€1982€in€North€Carolina,€along€with€her€husband,€for€felonyÏtheft€of€a€riding€lawn€mower.€€The€defendant,€moreover,€had€lied€to€the€presentence€officer€about€theÏsource€of€funds€used€to€purchase€a€1999€Mitsubishi€Mirage.€€The€defendant€represented€to€theÏpresentence€officer€that€the€automobile€had€been€purchased€with€the€proceeds€from€the€sale€of€aÏresidence€when,€in€fact,€the€victimððs€assets€were€used.€€The€trial€judge€was€equally€skeptical€of€theÏdefendantððs€professed€remorse€for€what€had€happened,€in€part€because€she€had€made€no€seriousÏefforts€to€obtain€gainful€employment.€€In€this€regard,€the€trial€judge€observed,ÌÌÒ ` ÒÒ ` ÒBeing€sorry€for€the€offense,€if€you€were€sorry€for€this€offense,€thatÏMitsubishi€Mirage€would€have€been€gone.€€You€would€have€been€outÏhere€working€at€any€job,€washing€dishes,€mopping€floors,€flippingÏhamburgers,€doing€whatever€on€this€Lordððs€earth€you€could€do€toÏpay€back€what€meager€amount€you€could€pay€back.€€No,€you€donððtÏhave€any€genuine€sincere€remorse.ÌÒ ° ÒÒ ° ÒÌà àà àLack€of€candor€and€credibility€are€reliable€indications€of€a€defendant's€potential€forÏrehabilitation.€€òòState€v.€Bunchóó,€646€S€.W.2d€158,€160€(Tenn.€1983);€òòState€v.€Zeoliaóó,€928€S.W.2dÏ457,€463€(Tenn.€Crim.€App.€1996);€òòState€v.€Williamsonóó,€919€S.W.2d€69,€84€(Tenn.€Crim.ÏApp.1995);€òòState€v.€Dowdyóó,€894€S.W.2d€301,€305„06€(Tenn.€Crim.€App.€1994).€The€trial€judge€isÏin€the€best€position€to€assess€a€defendant's€credibility€and€potential€for€rehabilitation,€and€we€willÏdisturb€neither€€that€negative€assessment€in€this€case€nor€the€resulting€decision€to€deny€fullÏprobation.ÌÓ  ÓÌÓ  Óà àà àNext,€we€address€the€defendantððs€complaint€that€she€should€have€received€anotherÏform€of€alternative€sentencing€that€involved€no€confinement.€€We€agree€with€the€trial€court,€however,Ïthat€some€measure€of€confinement€was€necessary€to€provide€deterrence€and€to€avoid€depreciatingÏthe€seriousness€of€the€offense.€€With€regard€to€denial€of€probation€based€upon€deterrence,€ð ðtrialÏcourts€should€be€given€considerable€latitude€in€determining€whether€a€need€for€deterrence€exists€andÏwhether€incarceration€appropriately€addresses€that€need.ðð€€òòHooperóó,€29€S.W.3d€at10.€€Accordingly,Ïthe€decision€to€incarcerate€€based€on€deterrence€is€presumed€correct€ð ðso€long€as€any€reasonableÏperson€looking€at€the€entire€record€could€conclude€that€(1)€a€need€to€deter€similar€crimes€is€presentÏin€the€particular€community,€jurisdiction,€or€in€the€state€as€a€whole,€and€(2)€incarceration€of€theÏdefendant€may€rationally€serve€as€a€deterrent€to€others€similarly€situated€and€likely€to€commitÏsimilar€crimes.ðð€€òòIdóó.ÌÌà
