Weaffirmthejudgmentofthetrialcourt. Attheoutset,wenotethattheappellantmisconstruestheproceduralrequirementsinvolvedintheissuanceofwritsofhabeascorpus.Briefly,toobtainsuchreliefinTennessee,a prisonermustsubmitanapplication,intheformofapetition,fortheissuanceofawrittothecourtmostconvenientinlocationtothe prisoner.SeeTenn.CodeAnn.2921101,105,107(1980).If,fromthefaceofthepetition,thereviewingcourtfindsnothingtoindicatethattheappellantschallengedconvictionsmightbevoid,thecourtshalldismissthepetitionandrefusetheissuanceofthewrit. #   ׀SeeTenn.CodeAnn.2921101,109.Therefore,itfollowsthatifthewritisrefused,ahearingonthepetitionisprecluded,therebyeliminatingthenecessityofanyresponsefromtheState.SeeStatev.Harris,No.01C019309CR00304(Tenn.Crim.App.atNashville,Nov.10,1994);Archerv.State,851S.W.2d157,164(Tenn.1993);Russellv.Stateexrel.Willis,437S.W.2d529,531(Tenn.1969).Thetrialcourtwasactingwithinitsdiscretionwhenitdismissedtheappellantspetition.Thisissueiswithoutmerit. Althoughwefindtheappellantsissueasitisframedonappealwithoutmerit,weelecttoaddressthecontentionsraisedinhispetitionforwritofhabeascorpus.Specifically,theappellantassertsthatthejudgmentsenteredagainsthimarevoidbecausetheindictmentsfailedtoallegethemensreaoftheoffenseschargedineachoftheabovenotedconvictions.Moreover,theappellantassertsthathisindictmentsarevoidbecausethedistrictattorneygeneralfailedtosigneachcountoftheindictment.ThetrialcourtproperlydismissedthepetitiononthebasisthatthelawineffectbeforeNovember1,1989didnotrequirethestatetoproveaculpablementalstate.Thecourtalsostatedthattheappellantsclaimwasnotonewhichisappropriateforhabeascorpusrelief. Initially,asthetrialcourtstated,wenotethatallegationsconcerningthesufficiencyoftheindictmentarenotthepropersubjectofhabeascorpusrelief.SeeHaggardv.State,475S.W.2d186,187(Tenn.Crim.App.1971);Brownv.State,445S.W.2d669,674(Tenn.Crim.App.1969);Barberv.State,No.01C019408CR00281(Tenn.Crim.App.atNashville,Feb.23,1995).Inthealternative,theappellantasksustoconsiderhispetitionasonethatisappropriateforpostconvictionrelief.However,theappellantscaseisalsoinappropriateforpostconvictionrelief.Hisclaimisbarredbythestatuteoflimitationsduetothefactthatthelastjudgmententeredagainsthimoccurredmorethanthreeyearsago.SeePassarellav.State,891S.W.2d619(Tenn.Crim.App.1994).Eveniftheappellantsclaimhadnotbeentimebarred,thetrialcourtwaswithoutjurisdictiontoconsidertheappellantspostconvictionclaim.Apostconvictionclaimmustbefiledwithinthecountyinwhichthejudgmentwasentered.Tenn.CodeAnn.4030204(a). Moreover,wefindthesubstanceoftheappellantsclaimtobewithoutmerit.TheappellantsrelianceonStatev.RogerDaleHill,No.01C019508CC00267(Tenn.Crim.App.June20,1996)andStatev.NathanielWhite,03C019408CR00277(Tenn.Crim.App.atKnoxville,June7,1995)ismisplaced.ThedecisionsinHillandWhiteinvolvepost1989indictmentsandspecificallyaddressTenn.CodeAnn.3911301(c)(1989)(requirementofaculpablementalstate).Theappealnowbeforethiscourtinvolvesapre1989Codeindictment.Priorto1989,theCodedidnotcontainaprovisioncomparabletoTenn.CodeAnn.3911301(c).Accordingly,thedecisionsinHillandWhitedonotcontrolreviewoftheissuebeforeus.  Onthedatesoftheoffensesinthiscase,aggravatedrape,aggravatedkidnaping,andarmedrobberywerecrimesthatrequiredadefendanttohavean unlawfulor feloniousintent.Tenn.CodeAnn.392603(a)(2)(1982);Tenn.CodeAnn.392301(1982);Tenn.CodeAnn.392501(1982).Inthepresentcase,thecountscontainedwithintherespectiveindictmentschargedthattheappellantdid unlawfullyand feloniouslycommiteachseparatecrime.Thislanguagewassufficientunderthelawasitexistedatthetime.SeeCampbellv.State,491S.W.2d359,361(Tenn.1973)(anindictmentusingthewords feloniouslyor unlawfullyissufficient).Thisissueiswithoutmerit.  Theappellantalsocontendsthathisindictmentisinsufficienttosupporthisconvictionsbecausethedistrictattorneygeneralfailedtosigneachcountoftheindictment.Theappellantsargumentismisplaced.Contrarytotheappellantsassertion,therecordcontainsoneindictmentfromDavidsonCounty,number83W185,listingeightseparatecounts.Therecorddoesnotcontaineightseparateindictments. $   ׀Thedistrictattorneygeneralssignatureonthelastpageoftheindictmentissufficient.Inanycase,theappellantsassertionisbarredfromourconsiderationbystatute.PursuanttoTenn.R.Crim.App.12(b)(2),anyobjectionbasedonadefectintheindictmentmustbemadepriortotrial.Theappellantmadenosuchassertion.SeeApplewhitev.State,597S.W.2d328,330(Tenn.Crim.App.1979).Thisissueisalsowithoutmerit.
