X    Turnertestifiedthatshedidnotmakeanyeffortstoconcealacrimeandthatshewasunaware 0"  thatacrimehadbeencommitted.Sheacknowledgedthatshegavearollofducttapetothe #l! Appellanttodiscardinordertoprotectherbrother. $X"   ThetrialcourtproceededinconductingitsexaminationofTurner.Duringthisexamination, %0!$ Turnerdeniedthatshe everfixedahole.ThetrialcourtthenattemptedtoimpeachTurnerby &"% readingtohertheAppellantsstatementtotheTBI, IhelpedMichellefixsomeoftheholes,theone '#& behindthebedroomdoor,atthebedroomdoor,andthebackdoor.Turneragainadvisedthetrial (#' court, Ididnthelpfixtheholes,sir.ThetrialcourtabruptlydiscontinuedexaminationofTurner )$(  andreturnedtotheAppellantwiththequestion, Well,Ms.Trent,wereyoulying?Acolloquy |*%) followedwiththeAppellantagaindenyingthatshe fix[ed]anyholes.Atthispoint,thetrialcourt  advisedthattheproceedingswerebeingsuspended,sothatthecourtcouldhearfromAgentMcCall. Theessenceofthis  basicconstitutionalprincipleistherequirementthattheStatewhichproposestoconvictandpunish l anindividualproducetheevidenceagainsthimbytheindependentlaborofitsofficers,notbythe X  simple,cruelexpedientofforcingitfromhisownlips.Estelle,451U.S.at462,101S.Ct.at1872 D! (quotingCulombev.Connecticut,367U.S.568,58182,81S.Ct.1860,1867(1961)).Oursisan 0"  accusatorialandnotaninquisitorialsystem.Mitchell,526U.S.at325,119S.Ct.at1313(quoting  Rogersv.Richmond,365U.S.534,541,81S.Ct.735,739(1961)).Importantly,however,Mitchell  observedthatawitness:  8  maynottestifyvoluntarilyaboutasubjectandtheninvoketheprivilegeagainstself ` incriminationwhenquestionedaboutthedetails.Theprivilegeiswaivedforthe L  matterstowhichthewitnesstestifies,andthescopeofthewaiverisdeterminedby 8  thescopeofrelevantcrossexamination.Thewitnesshimself,certainlyifheisa $ t party,determinestheareaofdisclosureandthereforeofinquiry. `   Id.at321,131112(internalcitationsomitted).  8    TheSupremeCourtinMitchellappliedtothesentencingphasetheruleincriminalcasesthat   nonegativeinferencefromthedefendantsfailuretotestifyispermitted.Id.at32728,131415.   Nonetheless,theSupremeCourthasheldthattheFifthAmendmentprivilegeagainstself   incriminationisnotselfexecuting;anindividualmustclaimtheprivilegeagainstselfincrimination   inresponsetospecificquestionsifhedesirestheprotectionoftheprivilege.Robertsv.United p States,445U.S.552,559,100S.Ct.1358,1364(1980).Thatrule,however,issubjecttoexception \ whensomecoercivefactorpreventsanindividualfromclaimingtheprivilegeorimpairshischoice H toremainsilent.Id.at560n.6,1364n.6. 4   Indeterminingwhethersentencingwasimproperlyinfluencedbyadefendantsfailureto  \ admitguilt,courtshavefocuseduponthreefactors:(1)thedefendantsmaintenanceofinnocence H afterconviction,(2)thejudgesattempttogetthedefendanttoadmitguilt,and(3)theappearance 4 thathadthedefendantaffirmativelyadmittedguilt,hissentencewouldnothavebeensosevere. '#&    ` THECOURT:Right.Imnotaskingyoutoagreewithit. )$(      ` DEFENDANTTRENT:No. h+&* lOa l l       ` THECOURT:Butthatswhattheywouldbesaying?     ` DEFENDANTTRENT:Right. t Thus,itisclearfromtherecordthattheAppellantneverintendedtoadmitanyguiltinthecrime,but L  waspleadingguiltyasshehad intelligentlyconcludedthat[her]bestinterestsrequire[d]aguilty 8  plea.Dortchv.State,705S.W.2d687,688(Tenn.Crim.App.1985).Abestinterestpleadoesnot $ t requireadefendantadmithisguilt.SeegenerallyNorthCarolinav.Alford,400U.S.25,91S.Ct.  ` 160(1970).n #  5      ׀Moreover,wewouldnotethatthiscourtinStatev.Gautney,607S.W.2d907,910  L  (Tenn.Crim.App.1980),observed, WeknowofnoruleinthisStaterequiringadefendanttoadmit  8  hisguiltinordertoseekprobation. $    Next,theAppellantchosenottotestifyatthesentencinghearing.Nonetheless,thetrialcourt   wantedmore detailsofthecrime.Uponthetrialcourtsrequest,twowitnesseswerecalledto   relatethedetailssurroundingtheevents.Moreover,thetrialcourtquestionedtheAppellant,Turner,   andthewitnessesatlengthaboutthefactsofthecrime.Accordingly,weconcludethetrialcourt p ferventlyattemptedtopersuadetheAppellanttoadmitherguilt. \   Finally,therecordisclearthat,iftheAppellantaffirmativelyadmittedguilt,hersentence 4 wouldnothavebeensosevere.Thetrialcourtacknowledgedthat,beforetheAppellantsresponses  p atthehearing, probationwasreallykindofonthefrontburner.Attheconclusionofthehearing,  \ thecourtnoted,however, Idonotfindthatyouinanywayarenowpresumedtobeentitledtoany H probationbecauseoftherecordthathasbeenmadeheretoday.TheAppellantwasplacedina 4  catch22;inordertoobtainleniencyfromthecourtfollowingherbestinterestplea,shewas   requiredtoadmittofactswhichshehadsteadfastlycontestedandwhichwerewellbeyondthescope   ofthestipulatedfacts.Thetrialcourts coerciveactionsweresufficienttodenytheindividualfree  choicetoadmit,todeny,ortorefusetoanswer.Swank,800N.E.2dat871(quotingGarnerv.  UnitedStates,424U.S.648,657,96S.Ct.1178,1183(1976)).  Ѐ  Accordingly,weconcludethatthetrialcourtsfindingof almostzerocredibilitybythe X  Appellantwasimproperlyconsideredinthesentencingdetermination.h( #  6      ׀Becausewefindthatthetrial D! courtmisappliedtheprinciplesofsentencing,thepresumptionofcorrectnessisnotafforded.Tenn. 0"  CodeAnn.4035401(d)(2003).Accordingly,ourreviewofthechallengedsentenceisdenovo  ontherecord.     XIXXXITheAppellantwasconvictedofaclassEfelonyandisthereforeentitledtothepresumption t thatsheisafavorablecandidateforalternativesentencing.Tenn.CodeAnn.4035102(6)(2003). ` However,althoughadefendantmaybepresumedtobeafavorablecandidateforalternative L  sentencing,thedefendanthastheburdenofestablishingsuitabilityfortotalprobation.Tenn.Code 8  Ann.4035303(b)(2003);Statev.Boggs,932S.W.2d467,477(Tenn.Crim.App.1996).Even $ t thoughprobationmustbeautomaticallyconsidered, thedefendantisnotautomaticallyentitledto  ` probationasamatteroflaw.Tenn.CodeAnn.4035303(b),SentencingCommission  L  Comments;Statev.Hartley,818S.W.2d370,373(Tenn.Crim.App.1991).Indeterminingwhether  8  tograntordenyprobation,atrialcourtshouldconsiderthecircumstancesoftheoffense,the $  defendantscriminalrecord,thedefendantssocialhistoryandpresentcondition,theneedfor   deterrence,andthebestinterestofthedefendantandthepublic.Statev.Grear,568S.W.2d285,   286(Tenn.1978);Statev.Boyd,925S.W.2d237,244(Tenn.Crim.App.1995).#XIXX XIl#󀀀     Oursentencingactdirectsthat,beforeasentenceoftotalconfinementisimposed,thetrial p courtisrequiredtofindoneofthefollowingconsiderations: \ 8   XIXXXI ` (A)Confinementisnecessarytoprotectsocietybyrestrainingadefendant 4 whohasalonghistoryofcriminalconduct; p   8   ` (B)Confinementisnecessarytoavoiddepreciatingtheseriousnessofthe H offenseorconfinementisparticularlysuitedtoprovideaneffectivedeterrenceto 4 otherslikelytocommitsimilaroffenses;or    8   ` (C)Measureslessmeasureslessrestrictivethanconfinementhavefrequently  orrecentlybeenappliedunsuccessfullytothedefendant.#XIXX XIr#   Tenn.CodeAnn.4035103(1)(2003).Therecorddemonstratesthatnoneoftheabovefactors l wereconsidered;rather,thetrialcourtorderedtotalconfinementbasedupontheAppellantslack X  ofcredibility.Thiscourthasobservedthat,whilecandorisrelevantindeterminingthepotentialfor D! rehabilitation,absentotherfactors,untruthfulnesstothecourtwillnotpersewarrantadenialofall 0"  alternativesentencing.Statev.KevinS.Phillips,No.03C019801CR0024(Tenn.Crim.App.at #l! Knoxville,Mar.12,1999),perm.toappealdenied,(Tenn.1999).Itisclearfromtheplainlanguage $X" ofTennesseeCodeAnnotatedsection4035103thatthe untruthfulnessofthedefendantisrelevant $D # indeterminingthesentencealternativeandnotasauthoritytodenyallformsofalternativesto %0!$ incarceration.Id.(emphasisadded). &"%    XIXXXIThepresentencereportreflectsthat,onMarch30,1995,theAppellantwasconvictedoftwo (#' felonies,foodstampfraudandAFDCfraud.Followingtheseconvictions,theAppellantsuccessfully )$(  completedprobationandplacementintheCommunityCorrectionsProgram.In2001,shereceived |*%) amisdemeanorconvictionforunlawfulpossessionofexoticanimals.Forthiscrime,theAppellant  wasassessedafine,whichshepaidinfull.     TheAppellantisafortytwoyearoldsingleperson.Shestatesthatshesuffersfrom t depressionandiscurrentlytakingmediationforthiscondition.Thepresentencereportrevealsthat ` shedroppedoutofhighschoolintheeleventhgrade;however,shereturnedandreceivedherG.E.D.
