FourthFloorNashville,TN37203  h      p TIMOTHYF.BEHAN (#   `     h      p AssistantAttorneyGeneral ($  `     h      p 2ndFloor,CordellHullBuilding `     h      p 425FifthAvenueNorth `     h      p Nashville,TN37243 `     h      p VICTORS.JOHNSON,III )    `     h      p DistrictAttorneyGeneral * !  `     h      p NICHOLASA.BAILEY +"#   `     h      p AssistantDistrictAttorneyGeneral ,#$ 0 `     h      p WashingtonSquare ` %` %  `     h      p 222SecondAvenueNorth,Suite500̀ `     h      p Nashville,TN372011649 /x&' OPINIONFILED________________________AFFIRMEDTHOMAST.WOODALL,JUDGE  9(01     OPINION  `     ` ThePetitioner,ArthurR.Turner,appealsasofrightthetrialcourtsdismissalofhispetitionofpostconvictionrelief.Petitionerraisesthefollowingtwoissuesinthisappeal:(1)whetherhereceivedtheeffectiveassistanceofcounseland(2)whetheritwasplainerrorforthetrialcourttorunhisaggravatedrapesentenceconsecutivetohisothersentences.Weaffirmthejudgmentofthetrialcourt. ` Defendantwasindictedonfourcountsofaggravatedrape,onecountofespeciallyaggravatedkidnapping,onecountofaggravatedrobbery,andonecountofattemptedaggravatedrape.Petitionerpledguiltytoespeciallyaggravatedkidnapping,aggravatedrobberyandtwocountsofaggravatedrape.Hereceivedtenyearsfortheespeciallyaggravatedtsofaggravatedrape.kidnapping,tenyearsfortheaggravatedrobberyandtwentyyearsforeachrape.񛀀Thesentencesweretorunconcurrent,exceptfortherapesentenceswhichweretorunconsecutivetoeachotherforaneffectivesentenceoffortyyears. ` Thetrialcourt,followingthepostconvictionhearing,summarizedthefactsasfollows:8 ` 8 ` (#` (#OnMarch15,1995,PetitionerAnthonyTurnerapproached[victim]atafitnesscenterneartheHermitagearea,forcedherintohercaratgunpoint,tookhertoanearbylocationinDavidsonCountyandrapedher.Petitionerthenplaced[victim]inthetrunkofthecar,drovehertoalocationneartheRivergateareainDavidsonCountyandrapedheragain.Hesubsequentlyplaced[victim]backintothetrunkandtookanapinhercar.HeawokesometimethefollowingmorninganddrovetoMcDonaldswherehebought[victim]somethingtoeatandpermittedhertousetherestroom.PetitionerthenputherbackintothetrunkanddrovetohisgirlfriendshouseinSmyrna.Whilehewassleepinginside,[victim]escapedandcontactedthepolice.Shortlythereafter,petitionerwasarrested.    9V01  ` ThetrialcourtfurtherfoundthefollowinginregardtoPetitionerstrialcounsel:8 ` 8 ` (#` (#   8 ` 8 ` (#` (#[He]personallymetwithpetitioneroneightornineoccasionsandspokewithhimonthephoneseveraltimes.Heexplainedthattheoriginalofferof(50)yearswasnegotiateddowntoforty(40).[Trialcounsel]mentionedthepossibilityofasentencinghearingtopetitioner,butfeltthatsuchahearingwouldnothavebeenhelpful.[Trialcounsel]addedthatpetitionerdidnotwantatrial,thatthecasewasparticularlybadinthattheactivitiescontinuedoverthecourseofatwelve(12)hourperiod,andthattherewasreallynogoodsolutionforpetitioner.[Counsel]didnotrememberdiscussingStatev.Anthony,817   S.W.2d299(Tenn.1991),withpetitioner.    `     h   @#DI.AssistanceofCounselr `  PetitionerarguesthathereceivedineffectiveassistanceofcounselbecausehewasallowedtopleadguiltytoaggravatedrobberyandespeciallyaggravatedkidnappinginviolationofStatev.Anthony,817S.W.2d299(Tenn.  @ 1991).Healsoarguesthathistrialcounselallowedhimtopleadoutsidehissentencingrange. ` Inpostconvictionproceedings,thepetitionerbearstheburdenofprovingtheallegationsinhispetitionbyapreponderanceoftheevidence.SeeMcBeev.State, P* " 655S.W.2d191,195(Tenn.Crim.App.1983).ThisCourtmustgivethefindingsofthetrialcourttheweightofajuryverdict,andthejudgmentofthetrialcourtwillnotbereversedunlesstheevidencecontainedintherecordpreponderatesagainstthefindingsoffactmadebythetrialcourt.Statev.Buford,666S.W.2d473,475(Tenn. 2(* Crim.App.1983).Oursupremecourthasheld:8 ` 8 ` (#` (#Ifthetranscriptshowsthatthepetitionerwasawareofhisconstitutionalrights,heisnotentitledtoreliefonthegroundsthatthemandatedadvicewasnotgiven.Also,ifalltheproofpresentedatthepostconvictionhearing,includingthetranscriptoftheguiltypleahearing,shows 9p02 thatthepetitionerwasawareofhisconstitutionalrights,heisnotentitledtorelief.    Johnsonv.State,834S.W.2d922,926(Tenn.1992). H   `     h      ` Indeterminingwhethercounselprovidedeffectiveassistanceattrial,thecourtmustdecidewhethercounselsperformancewaswithintherangeofcompetencedemandedofattorneysincriminalcases.Baxterv.Rose,523S.W.2d930,936   (Tenn.1975).Tosucceedonaclaimthathiscounselwasineffectiveattrial,apetitionerbearstheburdenofshowingthathiscounselmadeerrorssoseriousthathewasnotfunctioningascounselasguaranteedundertheSixthAmendmentandthatthedeficientrepresentationprejudicedthepetitionerresultinginafailuretoproduceareliableresult.Stricklandv.Washington,466U.S.668,693,104S.Ct. X 2052,80L.Ed.2d674,rehgdenied,467U.S.1267(1984);Cooperv.State,849 H S.W.2d744,747(Tenn.1993);Butlerv.State,789S.W.2d898,899(Tenn.1990). !8 Tosatisfythesecondprongthepetitionermustshowareasonableprobabilitythat,butforcounselsunreasonableerror,thefactfinderwouldhavehadreasonabledoubtregardingpetitionersguilt.Strickland,466U.S.at695.Thisreasonable h' probabilitymustbe sufficienttoundermineconfidenceintheoutcome.Harrisv. X)! State,875S.W.2d662,665(Tenn.1994)(citationomitted).Inregardtoguiltypleas, H+!# thepetitionermustestablishareasonableprobabilitythat,butfortheerrorsofcounsel,hewouldnothaveenteredintotheplea.Adkinsv.State,911S.W.2d334, (/%' 349(Tenn.Crim.App.1994). `  ` Whenreviewingtrialcounselsactions,thisCourtshouldnotusethebenefitofhindsighttosecondguesstrialstrategyandcriticizecounselstactics.Hellardv. 6-/ State,629S.W.2d4,9(Tenn.1982).Counselsallegederrorsshouldbejudgedat 8x/1 thetimetheyweremadeinlightofallfactsandcircumstances.Strickland,466U.S. `  at690;seeCooper,849S.W.2dat746. P   ` Petitionerclaimsthattherobberyinthiscasewasincidentaltothekidnapping.InStatev.Anthony,oursupremecourtexplainedtheproperanalysisforthisissue   as whethertheconfinement,movement,ordetentionisessentiallyincidentaltotheaccompanyingfelonyandisnot,therefore,sufficienttosupportaseparateconvictionforkidnapping,orwhetheritissignificantenough,inandofitself,towarrantindependentprosecutionandis,therefore,sufficienttosupportsuchaconviction.817S.W.2dat306.TheCourtwentontosaythat onemethodofresolvingthisquestionistoaskwhetherthedefendantsconductsubstantiallyincreased[the]riskofharmoverandabovethatnecessarilypresentinthecrimeofrobberyitself.Id. P (citationomitted). ` Defendantalsoarguesthatthekidnappingandrobberychargesshouldbemergedintotherape.TheTennesseeSupremeCourtrecentlyheldthat Anthony p& anditsprogeny...arenotmeanttoprovidetherapistafreekidnappingmerelybecausehealsocommittedrape[footnoteomitted].TheAnthonydecisionshould P* " onlypreventtheinjusticewhichwouldoccurifadefendantcouldbeconvictedofkidnappingwheretheonlyrestraintutilizedwasthatnecessarytocompletetheactofrapeorrobbery.Accordingly,anyrestraintinadditiontothatwhichisnecessarytoconsummaterapeorrobberymaysupportaseparateconvictionforkidnapping.Statev.Dixon,957S.W.2d53435(Tenn.1997). 4*,  ` Inthecasesubjudice,Petitionertookthevictimscarbygunpoint.Hethen 7.0 forcedherintothetrunkofherowncar,droveheraround,andrapedherrepeatedly 9p02 overatwelvehourperiod.TheriskofharmtothevictimbeyondtherobberyitselfwascertainlyincreasedasDefendantchosetolockthevictiminthecartrunkforhoursatatime,andtherestraintappliedtothevictimwentwellbeyondthatwhichwasnecessarytocompletetherapeorrobbery.Clearly,theseareallseparateanddistinctcrimesandtheyarenotincidentaltooneanotherinthiscase.񀀀Therefore,weagreewiththetrialcourtsfindingthatPetitionerstrialcounselwasnotineffectiveforfailingtomakeanAnthonychallenge.    ` Petitioneralsoarguesthathistrialcounselwasineffectiveforallowinghimtopleadoutsidehissentencingrange.Ourreviewoftherecordindicatesthathepledwithintherangebutabovetyhepresumptivesentence.Petitionerdoesnotchallengethevoluntarinessofhisplea.Therefore,sincehispleawasenteredknowinglyandvoluntarily,thesentenceisvalid.Hicksv.State,945S.W.2d706(Tenn.1997).  @ Furthermore,thetrialjudgenotedinhisorderthathadPetitionergonetotrialandbeenconvictedhecouldhavefacedasentenceoffiftyyearsonjustpartiallyenhancedandconsecutivelyrunsentences.Thetrialjudgewentontosaythatthetrialcourtcouldhaveevenenhancedallthesentencesandrunthemallconsecutivelyforatotalofseventyfiveyearsinconfinement.WithoutPetitionerstrialcounselhavingnegotiatedwiththeState,Petitionerwouldnotlikelyhavereceivedthefortyyearsentencethathedid.WefindthatPetitionerhasfailedtopresentanyevidencethatshowsthathisattorneyrepresentedhiminanyothermannerthancompetently. ` @AA"DII.ConsecutiveSentencing    7.0  ` Petitionerarguesthatconsecutivesentencingwasillegalbecausethecrime spreewasonecontinuingcriminalepisode.Weagreewiththetrialcourtsfinding 9p02 thattheseweremultiplecrimes.Infact,eachrapewasaseparatecrime.SeeState `  v.Phillips,924S.W.2d662(Tenn.1996).Thus,thereisnoplainerror.
