FACTS   Thepetitionerpledguiltypursuanttoapleaagreementtoone(1)countofburglaryinCrockettCounty.Asaconditionoftheplea,hewassentencedtotwo(2)yearsintheTennesseeDepartmentofCorrection.Theguiltypleatranscriptrevealsthat,upontakingtheplea,thetrialjudgewasinformedthattheCrockettCountysentencewastorunconcurrentwiththeHaywoodCountysentenceyettobeimposed.Thetrialjudgeagreedthatthesentenceswouldrunconcurrently.TheCrockettCountyjudgmentspecificallystatedthesentencewastobeservedconcurrentlywithhisconvictioninHaywoodCounty;however,aspreviouslynoted,theHaywoodCountysentencehadnotyetbeenimposedatthetimeoftheCrockettCountyplea.WenotethatbothCrockettCountyandHaywoodCountyareinthesamejudicialdistrict,andthesametrialjudgehandledbothproceedings. ItisallegedthattheHaywoodCountyjudgment,enteredaftertheCrockettCountyjudgment,statesthatitsten(10)yearsentenceruns consecutivetoanyothersentencehemayhave.AlthoughthestateconcedestheHaywoodCountysentencewasorderedtorunconsecutivetotheCrockettCounty7%XXdXXd7sentence,therecordoftheHaywoodCountyproceedingisnotbeforethisCourt.Therecorddoescontainanuncertified,unsignedcopyofanallegedHaywoodCountyjudgmentrunningthesentencesconsecutively. TheopinionofthisCourtintheoriginalappealoftheHaywoodCountyconvictionshowsthattheHaywoodCountysentenceoften(10)yearsresultedfromajurytrial.TheconvictionwasaffirmedbythisCourt.Statev.GregoryTurner,C.C.A.No.02C019508CC00212,HaywoodCounty(Tenn.Crim.App.filedMay24,1996,atJackson).PermissiontoappealwasdeniedbytheTennesseeSupremeCourtonOctober28,1996.Sentencingwasnotanissueonappeal. ItfurtherappearsthatthepetitionerfiledamotionwiththeHaywoodCountytrialcourtrequestingthatcourttocorrectitsjudgmentsothatthesentenceswouldrunconcurrentlyasspecifiedintheCrockettCountyjudgment.TherecorddoesnotreflecttheactionoftheHaywoodCountycourtonthisrequest.Althoughweassumethesentenceprobablyremainedunchanged,weareunabletoverifythisduetotheabsenceoftheHaywoodCountyrecords. WhatisclearfromtherecordisthatthepetitionerinthepresentcasefiledapetitionforpostconvictionreliefrelatingtotheCrockettCountyjudgmentandallegesconcurrentsentencingasspecifiedinthejudgmentisnotbeinghonored.Thetrialcourtdismissedthepetitionwithoutahearing,notingthatthepetitionerstatednoclaimuponwhichrelief mayorshouldbegranted.Thisappealfollowed.  PLEAAGREEMENT   ThedefendantpledguiltyinCrockettCountytoone(1)countofburglary,and,aspartofapleaagreement,thetwo(2)yearsentencewouldrunconcurrentlywithasentencehewastoreceiveinHaywoodCounty.ThetrialcourtinCrockettCounty,asthefirstsentencingcourt,didnothavetheauthorityatthattimetomakeanyfinaldeterminationastoconsecutive/concurrentsentencinginthesubsequentHaywoodCountycase.Becausethedefendant,theprosecutingattorneyandthetrialjudgeagreedthatsentencingwouldbeconcurrent,thisobviouslypresentsaproblemifconsecutivesentencingwassubsequentlyorderedinHaywoodCounty.Ordinarily,theremedywouldbetoallowthepetitionertowithdrawhisguiltypleainCrockettCounty.SeeStatev.Burkhart,566S.W.2d871,873(Tenn.1978). However,thereisnoproblemiftheHaywoodCountysentencewasconcurrentwiththeCrockettCountysentence.AlthoughweassumethepetitionerandthestateareprobablycorrectinstatingtheHaywoodCountysentencerunsconsecutivetotheCrockettCountysentence,therecordbeforeusdoesnotallowustodetermineifthisistrue.Forthisreason,aremandisappropriate.
