Inthisappealasofright,thepetitionercontendsthatthetrialcourterredindismissinghispetitionwithoutanevidentiaryhearing.Afterconsiderationoftherecordinthiscause,wefindthepetitionerscomplainttobewithoutmeritand,therefore,affirmthetrialcourtsaction.  ThelengthyhistoryofthiscasewasfullysummarizedinapreviousappealtothisCourt.SeeStatev.JamesHowardTurner,No.01C019404CR00122,DavidsonCounty(Tenn.Crim.App.filedSeptember20,1995,atNashville).SufficeittosaythatthepetitionerhashadatleasttwopriorappealsinthisCourtalongwithahabeascorpusproceedinginthefederalsystemthatwenttotheUnitedStatesSupremeCourt.  Inthiscase,thepetitionerallegesthathisrestraintisillegalandvoidbecausethetrialcourtlackedjurisdiction,becausehewasconvictedofchargesbasedonanindictmentthatwasdismissed,andothergroundsrelyingonevidentiaryissues.Thedismissalofthepetitionbythetrialjudge,withoutahearing,foundthatallmattersraisedbythepetitionerhadbeenpreviouslylitigatedandhadbeen correctedorresolved.Thetrialjudgesorderconcludedthatthepetitionerhadmadenoshowingthatheisbeingillegallyrestrained.  InPassarellav.State,891S.W.2d619(Tenn.Crim.App.1994),thisCourtoutlinedthecircumstancesunderwhichhabeascorpusreliefisavailable:        Itisawellestablishedprincipleoflawthattheremedyofhabeascorpusislimitedinscopeaswellasrelief.Incriminalcases,theremedyislimitedtocaseswherethejudgmentisvoidorthetermofimprisonmenthasexpired...ifthecourtrenderingajudgmenthasjurisdictionoftheperson,thesubjectmatter,andhastheauthoritytomakethechallengedjudgment,thejudgmentisvoidable,notvoid;andthejudgmentmaynotbecollaterallyattackedinasuitforhabeascorpusrelief. Thecomplaintsmadebythepetitionerarenotonesthatwouldrenderthetrialcourtjudgmentvoidbut,rather,voidable.Tennesseecourtshaveconsistentlyconstruedthescopeofreviewbyhabeascorpusverystrictly.Luttrellv.State,644S.W.2d408,409(Tenn.Crim.App.1982).Pursuanttothisnarrowscope,thisCourt,inWillieEdwardThorntonv.FredRaney,Warden,No.02C019302CC00025,LauderdaleCounty(Tenn.Crim.App.filedJanuary26,1994,atJackson),heldthaterroneousjuryinstructionsmeetnoneoftherequirementsforhabeascorpusrelief.TheCourtfurtherstatedthat theonlymethodofcollaterallyattackingthejudgmentbecauseofconstitutionaldeprivationsoccasionedbyerroneousinstructionsisbypetitionforpostconvictionrelief.  Thepetitionerhasallegednofactsthatwouldcausehisconvictionstobevoidortoshowthatthetermofhisimprisonmenthasexpired.HemerelyseekstohavethisCourtreconsidertheevidenceand/orweighthecredibilityofwitnesses.Themereconclusoryallegationthathisconvictionsarevoid,withoutvalidsupportorbasis,isinsufficientforhabeascorpusrelief.
