In1983,thepetitionerwasconvictedofaggravatedkidnappingandrobberyandreceivedasentenceoffortyyearsandfivetotenyears,respectively.Thiscourtaffirmedhisconviction.Statev.EarlAllenBaileyandRobertTurner,[nonumberinoriginal],HamiltonCounty(Tenn.Crim.App.Jan.6,1984).OnJanuary10,1996,thepetitionerfiledthepresentpetition,allegingthatthereasonabledoubtinstructiongivenathistrialisunconstitutionalunderCagev.Louisiana,498U.S.39,111S.Ct.328(1990).Thetrialcourtdismissedthepetitionbecauseitconcludedthatthejurywasproperlyinstructedonthestatesburdenofproofatthepetitionerstrial.Weagree. Thefollowinginstructionwasgivenatthepetitionerstrial:  8  Reasonabledoubtisthatdoubtengenderedbyaninvestigationofalltheproofinthecaseandaninability,aftersuchinvestigation,toletthemindresteasilyastothecertaintyofguilt.Reasonabledoubtdoesnotmeanadoubtthatmayarisefrompossibility,oranimaginaryorcaptiousdoubt.Absolutecertaintyofguiltisnotdemandedbythelawtoconvictofanycriminalcharge,butmoralcertaintyisrequiredastoeverypropositionofproofrequisitetoconstitutetheoffense.ThisisacorrectstatementoftheburdenofproofforcriminaltrialsinTennessee.SeeNicholsv.State,877S.W.2d722,734(Tenn.1994);Statev.Sexton,917S.W.2d263,266(Tenn.Crim.App.1995);Pettyjohnv.State,885S.W.2d364,366(Tenn.Crim.App.1994).
