(   כOnJuly16,1987,theappellantwasfoundguiltybyaJeffersonCountyjuryoffirstdegreeburglary.Baseduponthis triggeringoffenseandrequisitequalifyingfelonyconvictions,theappellantreceivedanenhancedsentenceoflifeimprisonmentafterajuryfoundhimtobeanhabitualoffender. )   ׀SeeTenn.CodeAnn.391801(repealed1989).OnNovember10,1987,theappellantpledguiltyintheJeffersonCountyCriminalCourttoonecountofrape,onecountofsexualbattery,andtwocountsoffirstdegreeburglary.Thecourtimposedaneffectivesentenceoftwentyfiveyearsfortheseconvictionsandorderedthatthissentencerunconcurrentlytohislifesentence.TheappellantiscurrentlyincarceratedattheNortheastCorrectionalCenterinJohnsonCounty. OnAugust12,1996,theappellantfiledanapplicationforawritofhabeascorpusallegingthatthejudgmentsenteredagainsthimonthechargesofrape,sexualbattery,andhabitualcriminalityarevoidbecausetheindictmentfailedtoallegethemensreaoftheoffensescharged.Theappellantspetitionalsocontendsthathis convictionasanhabitualcriminalisvoidbecausehisIllinoisguiltypleaconvictionsestablishingthisclassificationwerenotknowinglyenteredpursuanttoTennesseelaw. +   ׀Findingthattheappellantsclaimswerenotappropriateforhabeascorpusrelief,theJohnsonCountyCriminalCourtsummarilydismissedtheappellantsapplication.Theappellantnowappealsthisdecisionalleging,interalia,thatthetrialcourterredinsummarilydismissinghispetitionand,inthealternative,thatthetrialcourtshouldhavetreatedhispetitionasoneforpostconvictionrelief. Afterareviewoftherecord,weaffirmthedecisionofthetrialcourt.@ I.SummaryDismissalofApplicationforWritofHabeasCorpus  Theappellantfirstassertsthat,regardlessofthemeritsofhisclaims,thetrialcourtssummarydismissalofhisapplicationforwritofhabeascorpuswithoutanevidentiaryhearing,withouttheappointmentofcounsel,withoutareasonableopportunitytoamendhispetition,andwithoutrequiringtheStatetofileananswertothepetitionviolatedtheappellantsdueprocessandequalprotectionrights.Wedisagree. Theappellantmisreadstheproceduralrequirementsinvolvedintheissuanceofwritsofhabeascorpus.Briefly,toobtainsuchreliefinTennessee,a prisonermustsubmitanapplication,intheformofapetition,fortheissuanceofawrittothecourtmostconvenientinlocationtothe prisoner. ,   ׀SeeTenn.CodeAnn.2921101,105,107(1980).If,fromthefaceofthepetition,thereviewingcourtfindsnothingtoindicatethattheappellantschallengedconvictionsmightbevoid,thecourtshalldismissthepetititonandrefusetheissuanceofthewrit. .   ׀SeeTenn.CodeAnn.2921101,109.Therefore,itfollowsthatifthewritisrefused,ahearingonthepetitionisprecluded,therebyobviatinganyresponsefromtheState.SeeHarris,No.01C019309CR00304. Theproceduralprovisionspertainingtohabeascorpusreliefaremandatoryandmustbescrupulouslyfollowed.Harris,No,01C019309CR00304(citingBatemanv.Smith,183Tenn.541,543,194S.W.2d336,337(1946)).Again,thetrialcourtfoundthattheappellantsapplicationfailedtostateaclaimwhichcouldformthebasisforhabeasrelief.Weagree.Allegationsconcerningthesufficiencyoftheindictmentarenotthepropersubjectofhabeascorpusrelief.SeeHaggardv.State,475S.W.2d186,187(Tenn.Crim.App.1971);Brownv.State,445S.W.2d669,674(Tenn.Crim.App.1969);Barberv.State,No.01C019408CR00281(Tenn.Crim.App.atNashville,Feb.23,1995).Moreover,itiswellestablishedthattheappellantmaynotcollaterallyattackhisIllinoisconvictionsinthisState.SeeU.S.Const.art.IV,1.SeealsoRhodenv.State,816S.W.2d56,66(Tenn.Crim.App.1991).WeconcludethatthetrialcourtproperlyfollowedtheprovisionsofTenn.CodeAnn.2921101etseq.insummarilydismissingthepetition.Thiscontentionoftheappellantiswithoutmerit.@ II.FailuretoTreatApplicationasPetitionforPostConvictionRelief  Next,theappellantarguesthat,regardlessofthiscourtsrulingonthetrialcourtssummarydismissal,thetrialcourtshouldhaveconsideredhisapplicationforwritofhabeascorpusasapetitionforpostconvictionrelief.SeeTenn.Code.Ann.4030205(c)(1996Supp.).Theappellantpursuedadirectappealofhisburglaryconvictionandhabitualcriminalstatus.Thesejudgmentswereaffirmed.SeeStatev.Villaneuva,C.C.A.No.77(Tenn.Crim.App.atKnoxville,July5,1988),perm.toapp.deniedtoapp.deniedtoappealdenied,(Tenn.Oct.3,1988).TheappellantdidnotpursueadirectappealofhisNovember10,1987,guiltypleaconvictions.Accordingly,apetitionforpostconvictionreliefwasbarredbythethreeyearstatuteoflimitations.SeeTenn.CodeAnn.4030102(repealed1995).Notwithstandingbeingtimebarredonitsface,thepetitionraisesnoviableexceptionfortollingthestatute.Furthermore,apetitionforpostconvictionreliefmustbefiledinthecountyorjudicialdistrictinwhichtheconvictionoccurred.SeeTenn.CodeAnn.4030204(a)(1996Supp.).Accordingly,weconcludethatthetrialcourtdidnoterrbyfailingtotreattheapplicationasapetitionforpostconvictionrelief.Thisissueiswithoutmerit.@ III.SufficiencyoftheIndictments  Notwithstandingourpreviousholdingsinthismatter,wefindthesubstanceoftheappellantsclaimtobewithoutmerit.Theappellant,inhisapplicationforwritofhabeascorpus,allegesthatthejudgmentsenteredagainsthimfortheoffensesof habitualcriminal,rape,andsexualbatteryarevoidbecausetheindictmentfailstoallegethemensreaoftheoffensescharged. /    Initially,wenotethattheappellantsclaimattackinghis convictionasanhabitualcriminalisillfounded.ThisStateshabitualcriminalstatute,nowrepealed,didnotcreateanindependentcrimebutdefinedastatusprescribingcircumstancesunderwhichtherewasanenhancedpenaltyforthe triggeringoffense.SeePearsonv.State,521S.W.2d225(Tenn.1975).SeealsoTenn.Code.Ann.391801.Inordertoestablishtheappellantsstatusasanhabitualcriminal,theStateneedonlyprovethattheappellanthas,inadditiontothetriggeringoffense,threepriorfelonyconvictions,twoofwhichmustbeincludedinthestatutorylistofenumeratedfelonies.SeeTenn.CodeAnn.391801.Accordingly,nomentalelementonbehalfoftheappellantisnecessaryforclassificationasanhabitualcriminal. Moreover,consideringallconvictionshereinchallengedbytheappellant,weconcludethathisrelianceonStatev.Hill,No.01C019508CC00267(Tenn.Crim.App.atNashville,June20,1996)andStatev.White,No.03C019408CR00277(Tenn.Crim.App.atKnoxville,June7,1995)ismisplaced.ThedecisionsinHillandWhiteinvolvepost1989indictmentsandspecificallyaddressTenn.CodeAnn.3911301(c)(1989)(requirementofculpablementalstate).Theappealnowbeforethiscourtinvolvesanindictmentreturnedin1987.Priorto1989,theCodedidnotcontainaprovisioncomparabletoTenn.CodeAnn.3911301(c).Accordingly,thedecisionsinHillandWhitedonotcontrolreviewoftheissuebeforeus.
