ItappearsthatthepetitionerfiledamotionforappointmentofcounselwiththeClerkofthisCourt,however,themotionwasfiledunderadifferentcasenumberandwasdeniedbecausenorecordhadyetbeenfiledinthisCourt.Duetotheconfusionconcerningcasenumbers,thepetitionerfiledaprosebrief.Afterthestatewasgrantedadditionaltime,itfileditsbrief,andthepetitionerfiledareplybrief.  UnderT.C.A.4030217(c),whenamotiontoreopenapostconvictionpetitionisdenied,thepetitionerhas10daystofileanapplicationtothisCourtseekingpermissiontoappeal.Theapplicationistobeaccompaniedbyallofthedocumentsfiledbybothpartiesinthetrialcourtandtheorderdenyingthemotion.Thestatethenhas10daystorespondtotheapplication.Uponreviewingthepleadings,thisCourtthendetermineswhetherthetrialcourtabuseditsdiscretionindenyingthemotiontoreopen.Thereisnoprovisionforthefilingofarecord.  Inthiscase,thetrialcourtdismissedthepetitionersmotiontoreopenonMay6,1996.RatherthanfollowingtheproceduressetforthinT.C.A.4030217(c),thepetitionerfiledtwomotionstoreconsiderandanoticeofappeal,andarecordwasthenforwardedtothisCourt.Underthestatute,thepetitionerstimeforfilinganapplicationhaslongsinceexpired,andnoapplicationforpermissiontoappealthedenialofthepetitiontoreopenisproperlybeforethisCourt.  Moreover,reliefunderT.C.A.4030217(a)mayonlybegrantedwhere(1)theclaiminthemotionisbaseduponafinalrulingofanappellatecourtestablishingaconstitutionalrightthatwasnotrecognizedasexistingatthetimeoftrial,ifretrospectiveapplicationofthatrightisrequiredandthemotionisfiledwithinoneyearoftheruling;or(2)theclaiminthemotionisbaseduponnewscientificevidenceestablishingthatthepetitionerisactuallyinnocentoftheoffenseoroffensesforwhichthepetitionerwasconvicted;or(3)theclaimassertedinthemotionseeksrelieffromasentencethatwasenhancedbecauseofapreviousconvictionandsuchconvictioninthecaseinwhichtheclaimisassertedwasnotaguiltypleawithanagreedsentenceandthemotionisfiledwithinoneyearofthefinalityoftherulingholdingthepreviousconvictiontobeinvalid;and(4)itappearsthatthefactsunderlyingtheclaim,iftrue,wouldestablishbyclearandconvincingevidencethatthepetitionerisentitledtohavetheconvictionsetasideorthesentencereduced.ThepetitionersclaimsraisedinhismotiontoreopendonotfallwithinthecriteriasetforthinT.C.A.4030217(a).  Accordingly,althoughweregretthedelaysintheabovestyledmatter,wearecompelledtodismissedthepetitionersappeal.  ITIS,THEREFORE,ORDEREDthatpetitionersmotionforappointmentofcounselisrespectfullydeniedandthisappealisdismissed.Thepetitionerbeingindigent,costsaretaxedtothestate.
