Thepetitionerwasconvictedoffelonymurderandsentencedtolifeimprisonment.ThisCourtaffirmedthejudgmentinRobertLeeWade,Jr.v.State,No.83285III(Tenn.Crim.App.,atNashville,June26,1984),andpermissiontoappealwasdeniedbyourSupremeCourtonOctober29,1984.Thereafter,thedismissalofthepetitionersfirstpetitionforpostconvictionreliefwasupheldbythisCourt.RobertLeeWadev.State,No.88212111(Tenn.Crim.App.,atNashville,Dec.29,1988).ThepetitionerfiledasecondpostconvictionpetitiononMarch2,1998.Subsequently,onMarch12,1998,thetrialcourtdismissedthepetitionasoutsidethestatuteoflimitation.Weaffirm.  PursuanttoT.C.A.4030206(a),apetitionermustpetitionforpostconvictionreliefwithinoneyearofthedateofthefinalactionofthehigheststateappellatecourttowhichanappealwastaken.TheCompilersNotestoT.C.A.4030201statesthatthe1995PostConvictionActgovernsallpetitionsforpostconvictionrelieffiledafterMay10,1995.Ӏ  UnderT.C.A.4030202(b),acourtdoesnothavejurisdictiontoϜconsiderapetitionforpostconvictionreliefifitwasfiledoutsidetheoneyearstatuteoflimitationunless(1)theclaiminthepetitionisbaseduponafinalrulingofanappellatecourtestablishingaconstitutionalrightthatwasnotrecognizedasexistingatthetimeoftrial,ifretrospectiveapplicationofthatrightisrequired;(2)theclaiminthepetitionisbaseduponnewscientificevidenceestablishingthatsuchpetitionerisactuallyinnocentoftheoffenseoroffensesforwhichthepetitionerwasconvicted;or(3)theclaiminthepetitionseeksrelieffromasentencethatwasenhancedbecauseofapreviousconvictionandsuchconvictioninthecaseinwhichtheclaimisassertedwasnotaguiltypleawithanagreedsentence,andthepreviousconvictionhassubsequentlybeenheldtobeinvalid.  Inthepresentcase,thepetitionerfiledhispetitionforpostconvictionreliefonMarch2,1998,andtherefore,thepetitionisgovernedbythe1995PostConvictionAct.ThepetitionwasfiledoutsidethestatuteoflimitationsetforthinT.C.A.4030202(a),andthepetitionerhasfailedtoshowthatanyofhisclaimsfallwithinoneoftheexceptionssetforthinT.C.A.4030202(b).
