Afterareviewoftherecord,weremandtothetrialcourtforanewsentencinghearing. AsaRangeIstandardoffenderconvictedofaClassCfelony,Appellantwaseligibleforasentenceofthreetosixyears.SeeTenn.CodeAnn.4035112(a)(3)(1990).Intheabsenceofenhancementandmitigatingfactors,thepresumptivelengthofsentenceforaClassB,C,D,andEfelonyistheminimumsentenceinthestatutoryrange.Id.4035210(c)(Supp.1995).Initially,Appellantwassentencedtothreeyears,thestatutoryminimum.Followingtherevocationofcommunitycorrectionsforcocaineuseandafailuretoattendcommunityservice,Appellantwasresentencedtosixyears,thestatutorymaximum. Atrialcourtmayrevokeacommunitycorrectionssentenceduetotheconductofthedefendant.Id.4036106(e)(4).Uponrevocation,thetrialcourtmayalsoresentencethedefendanttoincarcerationforanyperiodoftimeuptothemaximumsentenceprovidedfortheoffense.Id.Thenewsentencemayexceedthelengthoftheoriginalsentence.Statev.Griffith,787S.W.2d340,34142(Tenn.1990).However,whenthetrialcourtresentencesthedefendanttoasentencethatexceedsthelengthoftheoriginalsentence,thetrialcourtmustconductasentencinghearingpursuanttotheTennesseeCriminalSentencingReformActof1989.SeeTenn.CodeAnn.4035209(a);seealsoStatev.Ray,No.01C019501CR00022,1995WL464743,at*4(Tenn.Crim.App.Aug.4,1995);Statev.Batts,No.01C019210CR00326,1993WL39749,at*2*3(Tenn.Crim.App.Feb.18,1993).ThesentenceimposedmustconformtotheprovisionsoftheAct.SeeTenn.CodeAnn.4035210(a)(e);seealsoRay,1995WL464743,at*4;Batts,1993WL39749,at*3.Furthermore,thetrialcourtmuststateontherecorditsreasonsforimposinganewsentenceandmustmakespecificfindingsoffactuponwhichapplicationofthesentencingprincipleswasbased.SeeTenn.CodeAnn.4035209(c),4035210(f)(g);seealsoStatev.Patterson,No.02C019208CC00196,1993WL141639,at*2(Tenn.Crim.App.May5,1993). Whenanappealchallengesthelength,range,ormannerofserviceofasentence,thisCourtconductsadenovoreviewwithapresumptionthatthedeterminationofthetrialcourtwascorrect.Tenn.CodeAnn.4035401(d)(1990).However,thepresumptionofcorrectnessonlyapplieswhentherecorddemonstratesthatthetrialcourtproperlyconsideredtherelevantsentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991).Otherwisethereviewofthesentenceispurelydenovo.Id.Inconductingareviewofthesentence,thisCourtmustconsidertheevidence,thepresentencereport,thesentencingprinciples,theargumentsofcounsel,thenatureandcharacteroftheoffense,mitigatingandenhancementfactors,anystatementsmadebythedefendant,andthepotentialforrehabilitationortreatment.Statev.Holland,860S.W.2d53,60(Tenn.Crim.App.1993).Thedefendantbearstheburdenofshowingtheimproprietyofthesentenceimposed.Statev.Gregory,862S.W.2d574,578(Tenn.Crim.App.1993). AttheconclusionofAppellantssentencinghearing,thetrialcourtremarkedasfollows:0 Fortherecord,Ifind[Appellant]sattitudetobesorry.ThereisnoquestionbutwhatheviolatedeverytermoftheagreementthathehadwithCorrectionsManagement.ImgoingtoresentencehimtoservesixyearsintheStatePenitentiary.IlldesignatehimtobeaRangeIstandardoffender.Illgivehimcreditforanytimehehasservedintheprogramupuntilthetimehemissedhisfirstcommunityservice.Nocreditafterthat.ReportbacktotheSheriff. Theforegoingistheentiretyoftherecordontheissueofresentencing.Thetrialcourtdidnotmakethespecificfindingsoffactnecessaryunderthesentencingactforthepresumptionofcorrectnesstoapplytothesentenceimposed.However,duetotheinadequacyoftherecord,thisCourtisunabletoconductitsstatutorilymandateddenovoreviewofthenewsentence.SeeTenn.CodeAnn.4035401(d);seealsoStatev.Lipscomb,No.O1C019506CR00185,1996WL63947,at*3(Tenn.Crim.App.Feb.13,1996);Batts,1996WL63947,at*4.
