àThe€appellant,€Jeffery€Martin€Wallace,€appeals€as€of€right€from€his€conviction€ofÏaggravated€sexual€battery€by€a€Henry€County€jury.€€Appellant€was€sentenced€to€serveÏeight€years€in€prison€as€a€Range€I€offender€for€the€Class€B€felony.€€On€appeal,Ïappellant€challenges€the€sufficiency€of€the€evidence€and€the€trial€courtððs€exclusion€ofÏevidence€relative€to€the€victimððs€prior€sexual€knowledge.€€We€are€of€the€opinion€that€noÏreversible€error€appears€in€the€record€and€affirm€the€judgment€of€the€trial€court.Ìà Ø àOn€April€20,€1996,€D.W.,€the€eleven„year„old€victim,׃×Ý ƒ #ÃÝòòÚ  Ú1Ú  ÚóóÝ  Ý×  ×€her€mother,€and€herÐ ˆ€  Ðbrother€were€moving€into€a€trailer€they€had€just€rented€in€Paris.€€That€afternoon,€D.W.ððsÏmother€went€to€Gleason€and€left€D.W.€in€the€care€of€a€neighbor.€€While€at€theÏneighborððs€home,€D.W.€noticed€that€appellant,€who€was€her€father,€had€arrived€at€herÏauntððs€house€just€down€the€street.€€She€went€to€the€house€and€talked€to€the€appellant.€ÏD.W.€testified€that€her€father€was€crying€and€upset€and€talking€about€his€desire€toÏreconcile€with€her€mother,€from€whom€he€had€been€divorced€since€1992.€€In€hopes€ofÏimproving€his€disposition,€D.W.€offered€to€show€appellant€their€new€residence.€€Ìà Ø àThey€went€to€the€trailer,€where€the€landlord€was€repairing€a€broken€window,€andÏD.W.€introduced€him€to€appellant.€€Appellant€began€asking€D.W.€if€she€wanted€to€killÏthe€landlord€and€she€said,€ð ðNo.ðð€€D.W.€testified€that€appellant€had€been€drinking€thatÏday.€€They€began€looking€around€the€trailer€and€appellant€went€into€the€bedroom€andÏsat€in€a€chair,€the€only€piece€of€furniture€in€the€room.€€D.W.€sat€down€in€the€floor€andÏappellant€said,€ð ðYou€are€my€blood,€you€are€my€blood,€and€are€you€willing€to€doÏanything€for€me?ðð€€D.W.€replied,€ð ðYes.ðð€€Appellant€kept€repeating€the€question€andÏasking€if€she€was€sure.€€Then€he€exposed€himself€to€her€and€said,€ð ðCome€here.ðð€€SheÏrefused.€€Appellant€zipped€his€pants€and€asked€D.W.€to€give€him€a€hug.€€Thinking€itÏwas€safe,€D.W.€testified€that€she€hugged€appellant.€€When€she€did,€he€grabbed€herÐ 3 ,1 Ðbuttocks€and€pulled€her€down€on€his€left€leg.€€Appellant€put€his€left€arm€around€her€andÏtouched€her€breast.€€He€rubbed€her€thigh€up€to€her€private€area€with€his€right€hand.€ÏThen€appellant€put€his€hand€on€the€button€to€her€shorts€and€tried€to€unfasten€them.€ÏD.W.€resisted€by€pushing€his€hand€away.€€He€kept€trying€and€she€ran€out€of€the€trailer.€€Ìà Ø àD.W.€ran€first€to€her€auntððs€house,€but€she€was€not€at€home.€€She€kept€runningÏand€wound€up€on€Market€Street.€€As€she€crossed€the€road,€she€noticed€her€motherððsÏcar€coming€down€the€street.€€D.W.€got€in€the€car€with€her€mother€and€told€her€what€hadÏhappened.€€They€reported€the€incident€to€the€authorities€and€appellant€was€arrestedÏlater€that€evening.Ìà Ø àGary€Vandiver,€an€investigator€with€the€Henry€County€Sheriffððs€Department,Ïtestified€that€appellant€was€apprehended€about€7:30€p.m.€on€the€evening€of€theÏincident.€€Vandiver€stated€that€appellant€was€very€intoxicated€and€became€belligerentÏwhen€informed€of€the€charge€against€him.€€Because€of€his€level€of€intoxication,ÏVandiver€waited€until€the€next€day€to€interview€the€appellant.Ìà Ø àOn€April€21,€appellant€gave€a€statement€in€which€he€said€he€hugged€the€victimÏand€squeezed€her€leg,€as€he€always€did,€but€that€he€did€not€remember€anything€else.€ÏAppellant€also€stated€that€he€has€never€known€the€victim€to€lie€and€if€she€said€thatÏsomething€happened,€it€probably€did.€€Appellant€did€not€deny€assaulting€the€victim.Ìà Ø àAppellant€testified€similarly€at€the€trial€and€stated€that€he€did€not€remember€whatÏhappened€at€the€trailer.€€On€the€day€of€the€incident,€he€had€been€drinking€since€theÏmorning€and€started€out€with€a€case€of€beer.€€As€in€his€statement,€he€testified€that€heÏremembered€asking€the€victim€for€a€hug.€€He€stated€that€she€sat€down€on€his€leg;€heÏput€his€arm€around€her€and€hugged€her.€€Then€the€victim€left.€€He€testified€that€ifÏanything€else€happened,€he€did€not€remember€it.Ìà Ø àThe€jury€found€appellant€guilty€of€aggravated€sexual€battery€and€the€trial€courtÏlater€sentenced€him€to€serve€the€minimum€sentence€of€eight€years€in€the€DepartmentÏâ âof€Correction.€€Ð À5¸.4 Ðà Ø àAppellant€first€contends€that€the€evidence€is€insufficient€to€support€hisÏâ âconviction.€€Specifically,€he€argues€that€his€level€of€intoxication€interfered€with€hisÏability€to€form€the€requisite€Ô‡X¥¥XXXÔmens€reaÔ#†Xï—XXX¥¥ê#Ô.€€We€disagree.Ð   ˜ Ðà Ø àAs€applicable€in€appellantððs€case,€aggravated€sexual€battery€is€defined€asÏunlawful€sexual€contact€with€a€victim€by€the€defendant€when€the€victim€is€less€thanÏthirteen€years€of€age.€€Tenn.€Code€Ann.€ðð39„13„504(a)(4)€(Supp.€1996).€€SexualÏcontact€is€further€defined€as€ÌÓÓà8 Ø àthe€intentional€touching€of€the€victimððs,€the€defendantððs,€or€any€otherÏpersonððs€intimate€parts,€or€the€intentional€touching€of€the€clothingÏcovering€the€immediate€area€of€the€victimððs,€the€defendantððs,€or€any€otherÏpersonððs€intimate€parts,€if€that€intentional€touching€can€be€reasonablyÏconstrued€as€being€for€the€purpose€of€sexual€arousal€or€gratification.€Ð Ø (#Ø (# ÐÌÓw!ÓTenn.€Code€Ann.€ðð39„13„501(6)€(1991).€€Because€of€his€extreme€level€of€intoxication,Ïappellant€claims€that€the€alleged€touching€could€not€have€been€intentional.€Ìà Ø àWhile€voluntary€intoxication€is€not€a€defense€to€the€commission€of€an€offense,€itÏis€admissible€when€relevant€to€negate€a€culpable€mental€state.€€Tenn.€Code€Ann.€ðð39„¼11„503(a)€(1991).€€Whether€the€defendantððs€level€of€intoxication€is€of€such€a€degree€toÏnegate€the€required€mental€state,€however,€is€a€question€for€the€jury€to€decide.€€òòStateÐ àThe€record€before€us€is€replete€with€testimony€that€the€appellant€wasÏintoxicated€on€the€day€of€the€incident.€€The€victim,€her€mother,€and€Officer€Vandiver€allÏtestified€that€appellant€was€drunk€that€day.€€The€appellant€also€testified€that€he€drank€aÏcase€of€beer€the€morning€of€the€incident€and€was€intoxicated.€€Nevertheless,€it€was€theÏjuryððs€duty€to€consider€all€of€the€evidence€and€determine€whether€appellantððsÏintoxication€interfered€with€his€mental€state€to€such€a€degree€that€he€was€unable€toÏform€the€intent€necessary€to€commit€the€offense.€€By€its€verdict,€the€jury€obviouslyÐ àThe€guilty€verdict,€implicitly€finding€that€appellant€acted€intentionally,€isÏsupported€by€the€evidence.€€The€victim€provided€uncontradicted€testimony€that€theÏappellant€first€exposed€himself€and€then€touched€her€in€inappropriate€places.€ÏAppellant€never€denied€the€incident,€but€rather€said€that€he€did€not€remember€sexuallyÏassaulting€the€victim.€€The€mere€inability€to€remember,€after€being€accused,€is€no€proofÏof€the€mental€condition€of€the€appellant€when€the€offense€was€actually€committed.€ÏòòSeeóó€òòHarrellóó,€593€S.W.2d€at€672.€€Without€some€proof€of€how€the€appellantððsÐ h` Ðintoxication€affected€his€mental€capacity€to€form€the€requisite€Ô‡X¥¥XXXï—Ômens€reaÔ#†Xï—XXX¥¥F-#Ô,€the€jury€wasÐ 4, Ðentitled€to€reject€appellantððs€claims.€Ìà Ø àAppellantððs€remaining€issue€is€a€challenge€to€the€trial€courtððs€ruling€excludingÏevidence€of€a€prior€sexual€encounter€the€victim€experienced€with€an€older€cousin.€ÏFollowing€a€brief€œjuryññ„ññññ›€ññout›€hearing,€the€trial€court€held€that€the€disputed€evidence€shouldÏbe€excluded€pursuant€to€Rule€412€of€the€Tennessee€Rules€of€Evidence.€€We€agreeÏwith€the€trial€court.Ìà Ø àFrom€a€statement€the€victim€gave€to€the€Department€of€Childrenððs€Services,Ïappellant€learned€that€the€victimððs€cousin,€who€is€five€or€six€years€older€than€she,€hadÏtried€to€fondle€her€on€several€occasions.€€According€to€her€statement,€the€victimÏrecognized€the€impropriety€and€told€her€mother€of€the€attempts.€€The€victim€stated€thatÏthe€relative€had€been€punished€for€his€conduct.€€Appellantððs€counsel€sought€toÏquestion€the€victim€about€her€statement€saying,€ð ðItððs€similar€to€what€is€testifying€as€toÏwhat€my€client€is€alleged€to€have€done.ððÌà Ø àEvidence€of€a€victimððs€sexual€behavior€other€than€the€sexual€act€at€issue€in€theÏcase€on€trial€when€an€accused€is€on€trial€for€aggravated€rape,€rape,€aggravated€sexualÐ ,2$+0 àAt€issue€in€appellantððs€case€is€the€provision€which€œmay€permitñ ñsñ ñ›€the€admission€ofÏsexual€behavior€of€the€victim€with€persons€other€than€the€defendant€ð ðto€prove€orÏexplain€the€source€of€semen,€injury,€disease,€or€knowledge€of€sexual€matters.ðð€€Tenn.ÏR.€Evid.€412(c)(4)(ii).€€ð ðKnowledge€of€sexual€mattersðð€is€often€sought€to€be€introducedÏin€child€sexual€abuse€cases.€€Where€the€Stateððs€proof€suggests€that€the€child€victimððsÏknowledge€of€sexual€matters€resulted€solely€from€the€incident€with€the€defendant,€theÏdefendant€is€permitted€to€show€that€the€victim€acquired€the€familiarity€from€sexualÏactivity€with€third€persons.€€Tenn.€R.€Evid.€412€Advisory€Commission€Comments.€€€Ìà Ø àHowever,€before€evidence€regarding€a€victimððs€ð ðknowledge€of€sexual€mattersðð€isÏadmissible,€the€trial€court€must€first€determine€that€the€probative€value€of€the€evidenceÏoutweighs€its€unfair€prejudice€to€the€victim.€€Tenn.€R.€Evid.€412(d)(4).€€By€commentsÏthe€trial€court€made€in€holding€the€evidence€inadmissible,€it€is€apparent€that€the€courtÏbelow€found€the€œoutññ„ññññ›€ññofññ„ññññ›€ññcourt›€statement€of€the€victim€had€no€probative€value.€€WeÏagree€with€the€trial€courtððs€conclusion€in€that€respect.€Ìà
