IsthejudgmentagainsttheAppellantvoidforfailureoftheindictment b   toallegeanoffenseunderT.C.A.3913102(c)?2. WasthesentenceimposedincompliancewiththeprovisionsofT.C.A. x  4035101etseq?`   ` Thejudgmentisaffirmed. ` Theevidenceintroducedbythestateshowsthatthedefendantandhiswifewereestranged.OnNovember22,1994,thedefendantswifeobtainedarestrainingorderagainstthedefendantundertheprovisionsofT.C.A.363606.TheestrangedwifetestifiedthatthedefendantcametowhereshewaslivingonSeptember14,1995andaskedtobeallowedintothehouse.Aftersomediscussion,thedefendantenteredthehouseand,accordingtothewoman,begantospeakofreconciliation.Shetoldhimtheycouldnotreconcileandhetoldherhewouldkillher.Shesaidthedefendantattackedher,pullingherhairandstrikingheronthehead.Hepulledoffsomeofherclothingandforcedhertoperformoralsexuponhim.Thedefendanttoldherhewasgoingtohavesexwithherandthenkillher.Sheescapedandrantoahousedownthestreetandcalledhersistertocomeforher. ` Thesisterandawomanwhowaswiththesistertestifiedthatthevictimwas scaredand terrifiedwhentheygottoher.Thesewitnessestestifiedshehadscratchesonherkneesandredorpurplemarksonherface.Theman,wholivedin<(;TR[A' Legal[A' LegalA' LegalA' LegalT`   ;TR[A' Legal[A' LegalA' LegalA' LegalT`   ;TR[A' Legal[A' LegalA' LegalA' LegalT`   <(thehousewherethevictimwent,testifiedshewascryingandupset.Thiswitness 906 ;TR[A' Legal[A' LegalA' LegalA' LegalT`   <(;TR[A' Legal[A' LegalA' LegalA' LegalT`   <(testifiedhethoughtthevictimhadsomescratchesonherlegs.Hedidnotobserve  anymarksonherface. ` Thedefendanttestifiedhewenttothehomewherehisestrangedwifewasstayinguponherinvitationtodoso.Hetestifiedthatheandhiswifekissedandundressedandthathiswifegotupostensiblytolockthedoorbutthatshestolesomemoneyfromhimandleft.Hedeniedstrikingherorthreateningher. SENTENCE  /,+0    ` ThedefendantcontendsthesentenceoffiveyearsisimproperbecausethetrialcourtdidnotfollowthesentencingguidelinesofT.C.A.4035102(2).Forthemostpart,thedefendantsargumentonthisisarehashoftheeventswhichledto hisconvictionandacontentionthatthedefendantssubstantialpastcriminal $7h28 OY  :(OY  :(8(OY  8(7(OY  7(conductshowedhimguiltyofonlyclassCmisdemeanorswhichwererelatedtothe:(OY  :(8(OY  8(7(OY  7(defendantsaddictiontoalcohol.  ` Thedefendantspastcriminalactivityshowsseventyarrests,fortyofwhichwereretiredordismissed.Thirtyconvictionswereshown,thesebeingoneforvandalism,elevenforpublicintoxication,oneforevadingarrest,oneforresistingarrest,threeformisdemeanortheftofproperty,fourfordrivingwhileintoxicated,twofordrivingonrevokedlicense,fourforvarioustrafficoffenses,andthreeformisdemeanordrugoffenses. ` Inarrivingatthesentence,thetrialjudgefoundtwoenhancingfactors:thedefendanthasahistoryofcriminalbehaviorinadditiontothosenecessarytoestablishtherangeandthedefendanthasaprevioushistoryofbeingunwillingtocomplywiththeconditionsofsentencesinvolvingreleaseinthecommunity.Thetrialjudgefoundtwomitigatingfactors:thedefendantsalcoholismandhislearningdisability. ` Thetrialjudgedeterminedthattheenhancingfactorsoutweighedthemitigatingfactors.Further,thetrialjudgeconsideredthefactsinthiscaseandtheoverallactionsofthedefendantanddeterminedthattherewaspotentialdangertoothersfromthedefendantandthatsuchwas movinginanescalatingscale.Baseduponthis,thedefendantwassentencedasaRange1,standardoffendertofiveyearsinthepenitentiary. ` Wereviewthesentencedenovoupontherecordwithapresumptionof (#( correctness.T.C.A.4035401(d).Theburdenisuponthedefendanttoshowthesentenceiswrong.Statev.Kear,809S.W.2d197(Tenn.Crim.App.1991). <,',  ` Therecordinthiscaseshowsthetrialcourtfollowedthesentencingguidelinesandtherecordsupportsthejudgmentofthetrialcourt.
