SENTENCINGHEARING     Theevidenceofferedatthesentencinghearingrevealedthatthedefendantwastwentysixyearsoldandthefatheroffourchildren.ThedefendantwasemployedbyCrownDistributionatthetimeofthesentencinghearing(August13,1997)andhadbeensoemployedsinceJanuary1,1997.Thedefendantresidedwithhiswife(thevictimintheassaultcase)andthreeofhisfourchildren.  Whileemployedbyapreviousemployer,DeltaBeveragePepsiCola,񛀜(Delta),defendantengagedinaschemewherebyhechangedcustomerinvoicesresultinginhisstealingapproximately$2,100.00fromDeltaduringathreeorfourmonthperiodin1996.AnemployeeofDeltatestifiedthattheinvestigationresultinginthearrestofthedefendantalsoresultedinelevenemployeesbeingterminatedandseveralhundredthousanddollarsinsimilartheftbeingdiscovered.  Thedefendanttestifiedthathehadnotbeen dishonestbefore,andthatatthetimeofthetheftsheneededmoneytopaygamblingdebts.Thedefendantfeltthathehadlearnedhislessonandwouldnotstealagain.Healsoexpressedawillingnesstopayrestitutiontohisformeremployer.  Concerningtheassault,thedefendantcontradictedtheallegationsofthevictim.Respondingtoquestionsbythetrialcourt,thedefendantdeniedstrikingorshovinghiswife.Thiscontradictedstatementsthathiswifehadmadetothepolice.  Thedefendantsmothertestifiedforthedefendantatthesentencinghearingandbasicallyexpressedheropiniontothetrialjudgethatthedefendantwas repentantandhad learnedhislessonfromthis. z;6= @# LEGALANALYSIS  p   Inthiscase,thedefendantpledguiltytotheftover$1,000.00andassault,andispresumedtobeafavorablecandidateforalternativesentencing.Tenn.CodeAnn.4035102(6).However,therecordinthiscaseclearlyreflectstherebuttalofthispresumption.  Whenthedefendantchallengesthemannerofservingasentence,itisthedutyofthisCourttoconductadenovoreviewoftherecordwithapresumptionthatthetrialcourts  determinationsarecorrect.Tenn.CodeAnn.4035401(d).The presumptionofcorrectnesswhichaccompaniesthetrialcourtsactionisconditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991). 0   Initsreview,thisCourtmustconsiderthefollowing:theevidence,ifany,receivedattrialandsentencinghearing,informationcontainedinthepresentencereport,thestatutoryprinciplesofsentencing,counselsargumentsastosentencingalternatives,thenatureandcharacteristicsofthecriminalconduct,mitigatingandstatutoryenhancementfactors,anystatementthatthedefendantmadeonhisownbehalf,andthepotentialforrehabilitationortreatment.Ashby,823S.W.2d166,16869(Tenn.1991). p&!$   IfanaccusedisconvictedofaClassC,DorEfelonyandissentencedasastandardoffender,thereisarebuttablepresumptionthattheaccusedisafavorablecandidateforalternativesentencingunlessdisqualifiedbysomeprovisionoftheTennesseeCriminalSentencingReformActof1989.Tenn.CodeAnn.4035102(6).Thepresumptionmaybesuccessfullyrebuttedbyfactscontainedinthepresentencereport,evidencepresentedbytheState,thetestimonyoftheaccusedoradefensewitness,oranyothersourceprovideditismadeapartoftherecord.Statev.Bonestel, 3.2 871S.W.2d163,167(Tenn.Crim.App.1993).  Inacasewherethedefendantseeksprobation,theCourtmustconsidertheaccusedscriminalrecord,socialhistory,presentphysicalandmentalcondition,thecircumstancesoftheoffense,thedeterrenteffectuponcriminalactivityoftheaccusedas ;`6: wellasothers,andtheaccusedspotentialforrehabilitationandtreatment.Statev.  Parker,932S.W.2d945,959(Tenn.Crim.App.1996).ThisCourthaspreviously  determinedthatanegativefindingofanyoneofthesefactorsissufficienttosupportadenialofprobation.Statev.Bell,No.02C019608CR00275(Tenn.Crim.App.July18, P  1997).  Asentenceofconfinementisconsideredappropriate ...toavoiddepreciatingtheseriousnessoftheoffense...toprovideaneffectivedeterrencetootherslikelytocommitsimilaroffenses...Tenn.CodeAnn.4035103(1)(B)(C).Compliancewithjustoneoftheabovementionedfactorsissufficienttoorderasentenceofconfinement.  Inthiscase,therecordreflectsthatthedefendantexhibitedasustainedintenttoviolatethelaw.Thedefendantviolatedapositionofprivatetrustbystealingfromhisemployer.ProofwasofferedastothetheftproblematDeltaandtheneedfordeterringotheremployeesfromactingasthedefendanthad.  Theassaultbythedefendantwascommitteduponhiswifewhilethedefendantwasonbondonthetheftcharge.Despitethedefendantsassertionstothecontrary,hisownmotherstatedthatthedefendanttoldherthathepushedhiswifeandshefelloveratableinthelivingroom.
