×›€€He€was€sentenced€to€life€imprisonment.€€HeÏappeals€his€conviction€raising€one€issue:€That€the€evidence€was€legallyÏinsufficient€to€support€the€verdict€of€guilt.€€As€subparts€to€this€issue,€he€assertsÏthat€the€conviction€was€based€on€accomplice€testimony€without€sufficientÏcorroboration€and€that€the€testimony€of€the€accomplice€was€essentially€œð ðboughtðð›Ïby€the€prosecution€and€violative€of€his€due€process€rights.€€We€affirm€theÏjudgment€of€the€trial€court.ÌÌà àOn€the€evening€of€June€17,€1994,€the€victim€in€this€case,€Barry€Watts,Ïwas€at€his€motherððs€house€repairing€a€broken€taillight€on€her€car€around€5:00€orÏ6:00€p.m.€€He€finished€the€job€in€approximately€thirty€minutes€and€then€left€in€hisÏcar,€a€Buick€Regal.€€He€telephoned€his€mother€at€approximately€10:00€p.m.€andÏtalked€with€her.€ÌÌà àThat€same€evening,€Florene€Williams€borrowed€her€boyfriend,€HenryÏClarkððs€car,€a€1976€or€1977€four„door,€blue€and€white€Buick€LeSabre.€€SheÍdrove€the€car€to€visit€her€friend,€Deloris€Wilson,€at€the€Cedar€Court€ApartmentsÏon€Seventh€Street€in€Memphis,€Tennessee.€€She€arrived€there€between€6:30Ïand€7:00€p.m.€€Ms.€Williams€was€socializing,€drinking€and€getting€high€on€crackÏcocaine.€€During€the€evening,€Ms.€Williams€checked€on€her€car€two€or€three€timesÏand€saw€the€Defendant€and€ð ðSweet€Peaðð€(Corey€Hunter)€hanging€around.€ÏThey€were€agitating€to€get€her€car.€€When€she€was€leaving€to€go€back€home,Ïshe€got€in€the€vehicle€and€began€to€remove€the€ð ðclubðð€from€the€steering€wheel.€ÏThe€Defendant€and€Hunter€approached€the€car€with€the€Defendant€on€theÏdriverððs€side€and€Hunter€on€the€passengerððs€side.€€They€threatened€Ms.€WilliamsÏand€hit€her€on€the€side€of€the€neck€and€face€with€a€bottle€or€club.€€SheÏrelinquished€the€vehicle€because€she€knew€the€Defendant€had€a€gun.€€ThisÏwas€somewhere€between€8:00€and€10:00€p.m.ÌÌà àMs.€Williams€returned€to€her€friendððs€apartment€and€stayed€within€theÏcomplex€that€evening.€€She€did€not€sleep.€€Ms.€Williams€did€not€report€the€theft€Ïto€the€police€although€a€pay€telephone€was€nearby€because€she€was€afraid€ofÏthe€Defendant€and€did€not€want€to€be€seen€calling€the€police.€ÌÌà àMeanwhile,€the€Defendant€and€Hunter€drove€the€stolen€vehicle€aroundÏuntil€it€developed€mechanical€problems€and€stopped€running.€€They€pulled€theÏcar€over€€on€Leath€Street€in€front€of€William€Walkerððs€house.€€Mr.€œWalker›€and€hisÍfamily€were€sitting€out€in€their€yard€and€drinking€beer€at€approximately€11:30Ïwhen€he€saw€two€black€males€in€the€car.€€Mr.€Walker€knew€the€victim,€BarryÏWatts,€and€saw€him€pull€his€car€up€to€the€stalled€vehicle.€€€The€streetlight€wasÏdim,€but€Mr.€Walker€saw€the€victim€get€out€of€his€vehicle€and€appear€to€help€theÏtwo€men.€€He€described€both€of€them€as€six€feet€tall€with€slender€builds€andÏdark€complexions.€€One€man€looked€like€he€had€long€ð ðnappyðð€œhair.€€It›€appearedÏthat€they€œfirst€tried›€to€jump€start€the€vehicle,€then€the€two€men€got€into€the€victimððsÏvehicle.€€One€man€sat€in€the€front€passenger€seat€and€the€other€got€into€theÏback€seat.€€The€victim€drove€them€away.€€Later,€the€stalled€vehicle€wasÏidentified€as€belonging€to€Henry€Clark,€€who€was€initially€a€suspect.ÌÌà àJohnny€Broady€testified€that€on€June€17,€he€got€off€from€work€at€5:00€p.m.Ïand€was€near€his€home€at€approximately€œ5:30›€p.m.€€He€saw€the€victim€onÏBethel€Street€and€the€victim€stopped€his€car€and€talked€to€him.€€The€victim€gaveÏhis€pager€number€to€Broady.€€Broady€and€his€friends,€including€a€lady€he€wasÏentertaining,€went€to€his€home€on€Pearce€Street€at€approximately€6:30€to€7:00Ïp.m.€€After€about€thirty€minutes,€Broady€paged€the€victim€to€buy€some€crackÏcocaine.€€The€victim€delivered€the€crack€to€Broadyððs€house€at€approximatelyÏ7:30€or€8:00€p.m.€€Broady€paged€the€victim€one€more€time€at€about€10:00€toÏ10:15€p.m.€to€buy€more€crack.ÌÌà àThe€victim€arrived€on€Pearce€Street€with€the€Defendant€and€Hunter€in€theÏcar€with€him.€€Broady€wanted€the€victim€to€come€in€the€house,€but€the€victim€toldÏBroady€to€ride€with€them.€€Broady€was€reluctant€because€he€would€leave€hisÏguests,€but€agreed€to€go€with€the€victim.€€They€headed€towards€Chelsea€Street,Ïturned€onto€Fifth€Street,€and€then€stopped€at€Greenlaw€Avenue€to€drop€off€theÏDefendant€and€Hunter.€€The€men€had€been€talking€about€buying€marijuana.€ÏThey€pulled€into€the€parking€lot€at€Johnsonððs€Market.€€The€victim€turned€off€hisÏheadlights€before€rolling€to€a€stop.€€Broady€opened€his€door€to€get€out€andÏlooked€back€in.€€He€saw€the€Defendant€pull€a€gun,€either€a€.45€caliber€or€9Ïmillimeter,€on€the€victim€and€told€him€to€ð ðdrop€itðð,€in€other€words,€to€give€theÏDefendant€his€money€and€valuables.€€Broady€testified€that€Hunter€nudged€himÏand€held€a€gun€to€his€head€and€likewise€told€him€to€ð ðdrop€it.ðð€€Broady€said€heÏdidnððt€have€anything.€€The€Defendant€fired€the€pistol€at€the€victim.€€BroadyÏjumped€out€of€the€car€and€ran€behind€the€market.€€He€grabbed€a€pipe€to€protectÏhimself€and€peeked€around€the€corner€to€see€if€anyone€was€chasing€him.€€ÌÌà àHe€saw€the€brake€lights€go€off€and€the€front€car€door€open.€€The€victim€fellÏout€of€the€car€and€the€Defendant€slid€into€the€driverððs€seat.€€€€The€car€sped€off,Ïheading€east€on€Greenlaw€Avenue.€€Broady€ran€over€to€the€victim€along€withÏDarryl€Pryor,€who€had€seen€the€incident€from€his€apartment.€€Broady€did€notÏstay,€but€told€Pryor€where€he€could€be€found.€€Broady€testified€at€trial€that€in€aÍstatement€to€the€œpolice,›€he€stated€that€he€never€really€looked€directly€at€theÏDefendant€because€it€was€dark€in€the€vehicle,€but€that€he€saw€the€DefendantððsÏface€from€the€flash€of€the€gun€when€it€fired.€€He€did€not€know€the€Defendant€byÏname€at€the€time€of€the€offense,€but€testified€that€he€was€positive€that€theÏDefendant€was€the€individual€who€shot€the€victim.€€He€had€seen€the€DefendantÏfrom€a€distance€around€his€neighborhood.€€While€on€the€stand,€BroadyÏdescribed€the€Defendantððs€hair€as€having€a€jheri€curl.€€ÌÌà àœDarryl›€œPryor€testified€that€he€›was€sitting€outside€his€apartment€aroundÏ11:00€p.m.€when€he€noticed€a€car€approach€and€pull€into€the€market.€€HeÏnoticed€the€vehicleððs€light€go€off€before€it€came€to€a€stop.€€He€heard€a€ð ðpopðð€andÏgot€behind€a€tree.€€Although€it€is€unclear€whether€before€or€after€he€heard€theÏgunshot,€he€saw€a€black€male€run€from€the€vehicle.€€Afterwards,€someone€wasÏpushed€out€of€the€car.€€The€vehicle€pulled€off€and€drove€down€Fifth€Street.€€HeÏwent€to€the€victim,€who€was€lying€face€down€and€breathing€laboriously€as€if€heÏwere€suffocating.€€He€spoke€with€Broady,€who€did€not€stay€at€the€scene€forÏlong.€€Pryor€called€911.ÌÌà àPolice€officers€arrived€at€12:02€a.m€and€secured€the€scene.€€TheÏDefendant€was€dead€when€the€paramedics€arrived.€€Police€recovered€sevenÏrocks€of€crack€cocaine€in€the€victimððs€navel.€€€The€medical€examiner€determinedÍthat€the€victim€died€as€a€result€of€a€gunshot€wound€to€the€arm€which€entered€hisÏright€lung,€severed€two€major€arteries€and€lodged€in€his€left€œlung,›€œcausing€severe›Ïbleeding.€€œThe›€gun€was€fired€within€œtwelve›€inches€from€the€victim.€€€ÌÌà àCorey€Hunter,€who€was€with€the€Defendant€during€the€commission€of€theÏcrime,€testified€at€trial.€€He€stated€that€the€Defendant€lived€in€the€Cedar€CourtÏApartments€and€he€met€him€there.€€They€wanted€to€go€to€a€teenager€club€calledÏ380€Beale.€€They€had€no€transportation€and€because€it€would€take€thirtyÏminutes€to€walk€there,€they€wanted€a€car.€€He€testified€that€Florene€Williams€letÏthem€use€the€car€in€exchange€for€a€rock€of€crack€cocaine.€€They€took€the€car€andÏit€broke€down€on€the€way€to€Beale€Street.€€A€œheavyset›€man€with€dark€skinÏstopped€to€help€and€checked€under€the€hood.€€€When€they€determined€theÏvehicle€could€not€be€revived,€they€asked€for€a€ride.€€The€victim€agreed€to€takeÏthem€part€of€the€way€to€Greenlaw€Avenue.€€The€victim€drove€to€Broadyððs€houseÏand€picked€him€up.€€The€victim€pulled€in€an€alley€to€drop€them€off€when€theÏDefendant€pulled€a€gun€and€told€him€to€ð ðDrop€it€off.ðð€€The€victim€said€ð ðUhððÏbecause€he€was€startled€and€the€Defendant€shot€him.€€€The€victim€fell€out€of€theÏcar€onto€the€street.€€The€back€door€was€open€and€Hunter€wanted€to€get€out,€butÏthe€Defendant€refused.€€They€left€the€car€on€Marble€Street,€then€walked€to€BealeÏStreet.€€The€vehicle€found€on€Marble€Street€was€later€identified€as€the€victimððs.€ÍHunter€was€afraid€to€leave€the€Defendant€because€the€Defendant€had€a€gun.ÏHe€finally€€left€the€Defendant€after€they€were€on€Beale€Street€for€a€few€minutes.€€ÌÌà àHunter€was€later€arrested€and€gave€a€statement€to€police.€€After€that,€heÏsigned€an€affidavit€that€his€prior€statements€implicating€the€Defendant€wereÏfalse.€€He€testified€that€the€affidavit€was€made€at€the€behest€of€the€DefendantððsÏgang€members,€who€had€assaulted€him€in€jail.€€Hunter€did€not€report€the€assault.€ÏThe€affidavit€stated€that€the€police€promised€to€let€Hunter€go€if€he€implicated€theÏDefendant.€€Hunter€testified€that€the€affidavit€was€false€and€that€his€statementÏmade€to€the€police€and€his€testimony€in€court€was€the€truth.€€€€ÌÌà àSergeant€James€Fitzpatrick€testified€at€trial€that€he€took€Corey€HunterððsÏstatement€at€the€police€department.€€Fitzpatrick€denied€telling€Hunter€that€heÏwould€be€released€if€he€identified€the€shooter.ÌÌà àThe€Defendant€was€convicted€of€first„degree€felony€murder€committed€inÏthe€perpetration€of€a€robbery€and€sentenced€to€life€imprisonment.€€In€his€onlyÏissue€in€this€appeal,€he€contends€that€the€evidence€was€insufficient€to€supportÏthe€verdict€of€guilt.€€When€an€accused€challenges€the€sufficiency€of€the€convictingÏevidence,€the€standard€is€whether,€after€reviewing€the€evidence€in€the€light€mostÏfavorable€to€the€prosecution,€any€rational€trier€of€fact€could€have€found€theÍessential€elements€of€the€crime€beyond€a€reasonable€doubt.€€òòJackson€v.ÏVirginiaóó,€443€U.S.€307,€319€(1979).€€Questions€concerning€the€credibility€of€theÏwitnesses,€the€weight€and€value€to€be€given€the€evidence,€as€well€as€all€factualÏissues€raised€by€the€evidence,€are€resolved€by€the€trier€of€fact,€not€this€court.€ÏòòState€v.€Pappasóó,€754€S.W.2d€620,€623€(Tenn.€Crim.€App.€1987).€€Nor€may€thisÏcourt€reweigh€or€reevaluate€the€evidence.€€òòState€v.€Cabbageóó,€571€S.W.2d€832,Ï835€(Tenn.€1978).€€ÌÌà àA€jury€verdict€approved€by€the€trial€judge€accredits€the€Stateððs€witnessesÏand€resolves€all€conflicts€in€favor€of€the€State.€€òòState€v.€Graceóó,€493€S.W.2d€474,Ï476€(Tenn.€1973).€€On€appeal,€the€State€is€entitled€to€the€strongest€legitimateÏview€of€the€evidence€and€all€inferences€therefrom.€€òòCabbageóó,€571€S.W.2d€atÏ835.€€Because€a€verdict€of€guilt€removes€the€presumption€of€innocence€andÏreplaces€it€with€a€presumption€of€guilt,€the€accused€has€the€burden€in€this€courtÏof€illustrating€why€the€evidence€is€insufficient€to€support€the€verdict€returned€byÏthe€trier€of€fact.€€òòState€v.€Tuggleóó,€639€S.W.2d€913,€914€(Tenn.€1982);€òòGraceóó,€493ÏS.W.2d€at€476.ÌÌÌà àA€crime€may€be€established€by€circumstantial€evidence€alone.€€òòState€v.ÏTharpeóó,€726€S.W.2d€896,€899„900€(Tenn.€1987).€€However,€before€an€accusedÍmay€be€convicted€of€a€criminal€offense€based€only€upon€circumstantialÏevidence,€the€facts€and€circumstances€ð ðmust€be€so€strong€and€cogent€as€toÏexclude€every€other€reasonable€hypothesis€save€the€guilt€of€the€defendant.ðð€ÏòòState€v.€Crawfordóó,€225€Tenn.€478,€482,€470€S.W.2d€610,€612€(1971).€€In€otherÏwords,€a€ð ðweb€of€guilt€must€be€woven€around€the€defendant€from€which€heÏcannot€escape€and€from€which€facts€and€circumstances€the€jury€could€draw€noÏother€reasonable€inference€save€the€guilt€of€the€defendant€beyond€a€reasonableÏdoubt.ðð€€òòId.óó€at€484,€613.€€ÌÓ  Óà àÌÓ  Óà àAfter€a€careful€review€of€the€record,€we€find€that€the€evidence€proves€thatÏthe€Defendant€killed€the€victim€during€an€attempt€to€rob€him.€€However,€theÏDefendant€argues€that€the€conviction€was€based€on€accomplice€testimony€thatÏwas€not€sufficiently€corroborated.€€He€asserts€that€Hunter€was€the€only€witnessÏwho€witnessed€the€crime€and€positively€identified€the€Defendant.ÌÌà àIt€is€well€established€in€Tennessee€that€a€defendant€may€not€beÏconvicted€solely€upon€the€uncorroborated€testimony€of€an€accomplice.€€òòSeeóó,€òòe.g.óó,€ÏòòState€v.€Bigbeeóó,€885€S.W.2d€797,€803€(Tenn.1994).€€Such€corroboratingÏevidence€"may€be€direct€or€entirely€circumstantial,€and€need€not€be€adequate,€inÏand€of€itself€to€support€a€conviction,"€as€long€as€it€"legitimately€tends€to€connectÏthe€defendant€with€the€commission€of€the€crime€charged."€€€òòBigbeeóó,€885€S.W.2dÍat€803€œ(quoting›œ)›€òòState€v.€Gayloróó,€862€S.W.2d€546,€552€(Tenn.€Crim.€App.€1992).€ÏHowever,€"it€is€not€necessary€that€the€corroboration€extend€to€every€part€of€theÏaccomplice's€evidence."€€òòId.óó€€Also,€the€corroboration€may€be€sufficient€althoughÏ"the€evidence€is€slight€and€entitled,€when€standing€alone,€to€little€consideration."€€ÏòòId.óó€€Whether€a€witness'€testimony€has€been€sufficiently€corroborated€is€a€matterÏentrusted€to€the€jury€as€the€trier€of€fact.€€€òòId.óóÌÌà àFurthermore,€the€threshold€question€of€whether€the€witness€was€anÏaccomplice€must€be€answered.€€An€accomplice€is€one€ð ðwho€knowingly,Ïvoluntarily,€and€with€common€intent€unites€with€the€principal€offender€in€theÏcommission€of€a€crime.ðð€€òòState€v.€Greenóó,€915€S.W.2d€827,€831€(Tenn.€Crim.ÏApp.€1995).€€The€test€œi›œs›€whether€the€alleged€accomplice€can€be€indicted€for€theÏcrime,€however,€a€defense€of€duress€or€coercion€may€be€asserted.€€òòId.óó€ÏEstablishing€whether€the€witness€is€an€accomplice€is€a€question€for€the€jury.€€òòId.óóÌÌà àWe€believe€that€the€evidence€suggests€that€Hunter€may€have€been€anÏaccomplice€to€the€crime.€€In€particular,€Broady€testified€that€when€the€DefendantÏpulled€the€gun€on€the€victim,€Hunter€also€pulled€œa€gun›€and€demanded€thatÏBroady€ð ðDrop€it€off.ðð€€Having€determined€that€Hunter€was€œan€accomplice,›€weÏaddress€whether€there€was€sufficient€corroboration€of€his€testimony.€€AlthoughÏHunter€was€the€only€witness€at€the€time€the€crime€was€committed€who€knewÍwho€the€Defendant€was,€other€witnesses€sufficiently€placed€the€Defendant€atÏthe€crime€scene.€€Florene€Williams€said€the€Defendant€took€her€boyfriendððsÏvehicle€with€Hunter.€€That€same€vehicle€was€seen€by€William€Walker€when€itÏbroke€down.€€Two€black€males,€one€with€long€hair,€left€the€vehicle€and€got€intoÏthe€victim,€Barry€œWattsðð,›€car.€€Walker€knew€the€victim€and€saw€the€two€get€in€hisÏcar.€€Johnny€Broady€saw€the€victim€driving€his€vehicle€with€two€passengers.€ÏHe€did€not€know€the€Defendantððs€name€nor€did€he€see€him€very€well,€but€laterÏidentified€the€Defendant€as€the€man€he€saw€in€the€car.€€Darryl€Pryor€saw€aÏman€get€pushed€out€of€the€car€after€he€was€shot.€€When€he€saw€the€man€upÏclose,€he€recognized€him€as€Barry€Watts.€€The€vehicle€that€was€abandoned€onÏMarble€Street€belonged€to€the€victim.ÌÌà àAlthough€there€is€circumstantial€evidence€linking€the€Defendant€to€theÏcrime,€we€believe€that€it€provides€substantial€corroboration€of€Hunterððs€testimony.€ÏThis€other€evidence€legitimately€links€the€Defendant€to€the€crime€and€clearlyÏleads€one€to€no€other€conclusion€than€that€the€Defendant€committed€the€crime.€ÏObviously,€the€jury€accredited€the€testimony€of€the€Stateððs€witnesses€inÏrendering€its€verdict.€€We€will€not€disturb€the€juryððs€finding€in€this€appeal.ÌÌà àThe€Defendant€also€argues€that€Hunterððs€testimony€should€have€beenÏexcluded€because€it€was€tainted.€€He€argues€that€the€State€offered€HunterððsÍfreedom€in€exchange€for€testimony€implicating€the€Defendant.€€He€proffersÏevidence€that€the€State€issued€a€nolle€prosequi€regarding€Hunter€after€he€testifiedÏat€the€Defendantððs€trial.€€We€first€note€that€because€the€defendant€has€failed€toÏcite€authority€to€support€his€argument,€this€issue€is€waived.€€Tenn.€Ct.€Crim.ÏApp.€R.€10(b);€òòState€v.€Killebrewóó,€760€S.W.2d€228,€231€(Tenn.€Crim.€App.Ï1988).ÌÌà àHowever,€even€if€we€were€to€address€this€issue,€we€would€conclude€thatÏit€lacks€merit.€€While€there€is€evidence€that€Hunter€signed€an€affidavit€stating€thatÏthe€police€promised€that€he€would€not€be€prosecuted€if€he€identified€theÏDefendant,€he€explained€that€he€was€coerced€into€writing€the€statement€by€theÏDefendantððs€gang€members.€€Hunter€denied€that€he€was€œgiven›€anything€inÏreturn€for€his€testimony.€€Sergeant€Fitzpatrick€testified€that€he€never€made€anyÏoffers€of€leniency€in€exchange€for€implicating€the€Defendant.€€As€this€Court€hasÏnoted:ÌÒ  ÒÒ ° ÒÒ ` ÒÒ ° ÒÓÓIt€is€generally€recognized€that€a€humble,€contrite,€and€conscientiousÏrepentant€who€'throws€himself€upon€the€mercy€of€the€court'€usuallyÏfares€much€better€than€does€the€adamant€accused€who€is€adjudgedÏguilty€after€a€lengthy€trial.€€While€one€indicted€for€crime€in€the€position€ofÏcooperating€with€the€government€should€not€be€threatened€or€assuredÏthe€court€will€grant€favored€treatment€in€return€for€his€assistance,€thereÏis€no€proscription€against€his€hoping€that€his€valuable€help€will€result€inÏleniency.Ò
